2727 An Act relative to a three year study for stormwater engineering to protect habitats along state
2828 highways.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. The division of highways within the Massachusetts Department of
3232 2Transportation, established pursuant to section 37 of chapter 6C of the General Laws, shall
3333 3conduct a study over 3 years on the steps necessary to protect vulnerable habitats, especially
3434 4wetlands and waterways, along state highways. The study shall include an analysis of: (i) the
3535 5drainage infrastructure along state highways; (ii) the presence of harmful contaminants from road
3636 6surfaces and road construction in stormwater along state highways; (iii) the level and type of
3737 7pollution in habitats resulting from drainage from state highways; and (iv) potential mitigation
3838 8strategies to reduce and eventually eliminate pollution caused by state highway drainage.
3939 9 SECTION 2. Not later than June 30, 2028, the division of highways shall submit its
4040 10report containing the results of the study conducted pursuant to section 1, together with any
4141 11proposed legislative or regulatory changes, to the clerks of the house of representatives and the 2 of 2
4242 12senate, the joint committee on transportation and the joint committee on environment and natural
4343 13resources.
