2727 An Act relative to improved special needs transportation and student safety, "John's Law".
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 Chapter 71B of the General Laws, as appearing in the 2020 Official Edition is hereby
3131 2amended by inserting after section 8 the following section:
3232 3 Section 8A. (a) As used in this section, the term “special transportation van” shall mean a
3333 4van, bus, or other motor vehicle used exclusively or primarily to transport school-age children
3434 5with disabilities or other persons with disabilities.
3535 6 (b) Any bus driver, monitor, or qualified attendant responsible for transporting a school-
3636 7age child with a disability on a special transportation van shall be trained and certified in first
3737 8aid, including cardiopulmonary resuscitation.
3838 9 (c) School districts shall provide any bus driver, monitor, or qualified attendant
3939 10responsible for transporting a school-age child with a disability on a special transportation van 2 of 2
4040 11with a written report pertaining to each school-age child with a disability such bus driver,
4141 12monitor or qualified attendant is responsible for transporting. The report shall identify any
4242 13sensory, neurological, emotional, communication, physical, intellectual or health impairment, or
4343 14a combination thereof, that the district believes may affect the safety of the child during
4444 15transportation on the special transportation van. The school district shall only provide the
4545 16written report pursuant to this subsection if provision of such report is required by the student’s
4646 17individualized education program or the school district has received written consent from a
4747 18parent or guardian of the student.
