2929 Proposal for a legislative amendment to the Constitution prohibiting eminent domain takings.
3030 A majority of all the members elected to the Senate and House of Representatives, in
3131 joint session, hereby declares it to be expedient to alter the Constitution by the adoption of the
3232 following Article of Amendment, to the end that it may become a part of the Constitution [if
3333 similarly agreed to in a joint session of the next General Court and approved by the people at the
3434 state election next following]:
3535 ARTICLE OF AMENDMENT.
3636 1 A majority of all the members elected to the Senate and House of Representatives, in
3737 2joint session, hereby declares it to be expedient to alter the Constitution by the adoption of the
3838 3following Article of Amendment, to the end that it may become a part of the Constitution [if
3939 4similarly agreed to in a joint session of the next General Court and approved by the people at the
4040 5state election next following]:
4141 6 ARTICLE OF AMENDMENT 2 of 2
4242 7 The taking of land or interests therein by eminent domain for private commercial or
4343 8economic development is hereby declared not to be a public use of the commonwealth under the
4444 9first paragraph of Article X of Part the First of the Constitution.
