| 28 | 28 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |

| 29 | 29 | | of the same, as follows: |

| 30 | 30 | | 1 SECTION 1. Section 8 of chapter 371 of the acts of 1964 is hereby amended by adding |
|---|
| 31 | 31 | | 2the following words:-, or in the opinion of the department of agricultural resources or the water |
|---|
| 32 | 32 | | 3resources commission, the diversion of such waters would endanger the environmental health of |
|---|
| 33 | 33 | | 4the associated ponds and rivers. |

| 34 | 34 | | 5 SECTION 2. Section 9 of said chapter of said acts is hereby amended by adding the |

| 35 | 35 | | 6following paragraph:- |

| 36 | 36 | | 7 Furthermore, Silver Lake, Monponsett Pond and Furnace Pond shall be managed at all |

| 37 | 37 | | 8times, unless prevented by drought, such that there is continuous flow provided to all the out- |

| 38 | 38 | | 9flowing rivers, including Jones River, Stump Brook and Herring Brook, to support and sustain |

| 39 | 39 | | 10their water quality as well as maintain the health and function of the ecosystem. |
