26	26	An Act relative to the head injury treatment services trust fund.
27	27	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
28	28	of the same, as follows:
29	29	1 SECTION 1. Section 59 of Chapter 10 of the General Laws, as appearing in the 2020
30	30	2Official Edition , is hereby amended by striking out the word “and”, in line 4, and inserting after
31	31	3the figure “24”, in line 4, the following words:- and Section 13B”
32	32	4 SECTION 2. Section 13B(b) of Chapter 90 of the General Laws, as appearing in the 2020
33	33	5Official Edition, is hereby amended by adding, after the word “offense” the following words:-
34	34	6provided that $50 of each fine collected under this section shall be deposited into the head injury
35	35	7treatment services trust fund.
36	36	8 SECTON 3. Section 20 of Chapter 90 of the General Laws, as appearing in the 2020
37	37	9Official Edition, is hereby amended in the fourth paragraph by striking in the first sentence the
38	38	10number “50” and replacing it with the number “100”; and further, by striking in the second
39	39	11sentence the number “50” and replacing it with the number “100”. 2 of 4
40	40	12 SECTION 4. Section 24 (1)(a)(1) of Chapter 90 of the General Laws, as appearing in the
41	41	132020 Official Edition, is hereby amended by striking out the second paragraph and inserting in
42	42	14place thereof the following paragraph:-
43	43	15 There shall be an assessment of $250 against a person who is convicted of, is placed on
44	44	16probation for, or is granted a continuance without a finding for or otherwise pleads guilty to or
45	45	17admits to a finding of sufficient facts of operating a motor vehicle while under the influence of
46	46	18intoxicating liquor, marijuana, narcotic drugs, depressants or stimulant substances under this
47	47	19section; provided, however, that 100 per cent of the amount collected under this assessment shall
48	48	20be deposited monthly by the court with the state treasurer for who shall deposit it into the Head
49	49	21Injury Treatment Services (HITS) Trust Fund.
50	50	22 SECTION 5. Section 24 (1)(a)(1) of Chapter 90 of the General Laws, as appearing in the
51	51	232020 Official Edition, is further amended in the fourth paragraph by inserting at the end thereof
52	52	24the following:-
53	53	25 75 per cent of the fines collected in this section shall be deposited monthly by the court
54	54	26with the state treasurer for who shall deposit into the Head Injury Treatment Services Trust Fund.
55	55	27 SECTION 6. Section 24 (1)(a)(1) of Chapter 90 of the General Laws, as appearing in the
56	56	282020 Official Edition, is further amended in the fifth paragraph by inserting at the end thereof the
57	57	29following:-
58	58	30 75 per cent of the fines collected in this section shall be deposited monthly by the court
59	59	31with the state treasurer for who shall deposit it into the Head Injury Treatment Services (HITS)

61	61	33 SECTION 7. Section 24 (1)(a)(1) of Chapter 90 of the General Laws, as appearing in the
62	62	342020 Official Edition, is further amended in the sixth paragraph by inserting at the end thereof
63	63	35the following:- 75 per cent of the fines collected in this section shall be deposited monthly by the
64	64	36court with the state treasurer for who shall deposit it into the Head Injury Treatment Services
65	65	37Trust Fund.
66	66	38 SECTION 8. Section 24 (1)(a)(1) of Chapter 90 of the General Laws, as appearing in the
67	67	392020 Official Edition, is further amended in the seventh paragraph by inserting at the end thereof
68	68	40the following:-
69	69	41 75 per cent of the fines collected in this section shall be deposited monthly by the court
70	70	42with the state treasurer for who shall deposit it into the Head Injury Treatment Services (HITS)
71	71	43Trust Fund.
72	72	44 SECTION 9. Section 24 (1)(a)(1) of Chapter 90 of the General Laws, as so appearing in
73	73	45the 2020 Official Edition, is further amended in the eighth paragraph by inserting at the end
74	74	46thereof the following:-
75	75	47 75 per cent of the fines collected in this section shall be deposited monthly by the court
76	76	48with the state treasurer for who shall deposit it into the Head Injury Treatment Services (HITS)
77	77	49Trust Fund.
78	78	50 SECTION 10. Section 24 (1)(a)(1) of Chapter 90 of the General Laws, as appearing in
79	79	51the 2020 Official Edition, is further amended in the ninth paragraph by inserting at the end

81	81	53 75 per cent of the fines collected in this section shall be deposited monthly by the court
82	82	54with the state treasurer for who shall deposit it into the Head Injury Treatment Services (HITS)
83	83	55Trust Fund.
84	84	56 SECTION 11. Section 24 (1)(a)(1) of Chapter 90 of the General Laws, as appearing in
85	85	57the 2020 Official Edition, is further amended in the tenth paragraph by inserting at the end
86	86	58thereof the following:-
87	87	59 75 per cent of the fines collected in this section shall be deposited monthly by the court
88	88	60with the state treasurer for who shall deposit it into the Head Injury Treatment Services (HITS)
89	89	61Trust Fund.
90	90	62 SECTION 12. Section 24 (1)(a)(1) of Chapter 90 of the General Laws, as appearing in
91	91	63the 2020 Official Edition, is further amended in the eleventh paragraph by inserting at the end
92	92	64thereof the following:-
93	93	65 75 per cent of the fines collected in this section shall be deposited monthly by the court
94	94	66with the state treasurer for who shall deposit it into the Head Injury Treatment Services (HITS)
95	95	67Trust Fund.
96	96	68 SECTION 13. Section 20 of Chapter 90 of the General Laws, as appearing in the 2020
97	97	69Official Edition, is further amended in the in the first sentence of the fourth paragraph by striking
98	98	70out the word “$50” and inserting “$75” and in the second sentence of the fourth paragraph by
99	99	71striking out the word “$50” and inserting “$75”.
