28 | 28 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |

29 | 29 | | of the same, as follows: |

30 | 30 | | 1 SECTION 1. Chapter 7D of the General Laws is hereby amended by adding the |
---|
31 | 31 | | 2following new section:- |
---|
32 | 32 | | 3 Section 12. Fair software licensing |
---|
33 | 33 | | 4 (a) A contract for the licensing of software applications, which are intended to be |
---|
34 | 34 | | 5installed by a governmental body and designed to run on generally available desktop or server |
---|
35 | 35 | | 6hardware, shall not limit such governmental body’s ability to install or run the software on the |
---|
36 | 36 | | 7hardware of the governmental body’s choosing. |
---|
37 | 37 | | 8 (b) The secretary of technology services and security may promgulate regulations or |
---|
38 | 38 | | 9otherwise issue administrative directives to carry out the purposes of this section. 2 of 2 |

39 | 39 | | 10 SECTION 2. Section 1 shall apply to any contract or addendum for the licensing of |
---|
40 | 40 | | 11software applications on or after the effective date of this act. |
