28 | 28 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
29 | 29 | | of the same, as follows: |
---|
30 | 30 | | 1 Section 22 of chapter 90 of the General Laws, as appearing in the 2022 Official Edition, |
---|
31 | 31 | | 2is hereby amended by inserting after subsection (j) the following new subsection:- |
---|
32 | 32 | | 3 (k) Temporary Restoration for Individuals Returning from Incarceration |
---|
33 | 33 | | 4 (1) The registrar shall temporarily restore the driver’s license or right to operate of any |
---|
34 | 34 | | 5individual returning from incarceration upon application, provided that: |
---|
35 | 35 | | 6 The individual was previously licensed under this chapter. |
---|
36 | 36 | | 7 The individual enters into a payment agreement to pay down any outstanding fees, fines, |
---|
37 | 37 | | 8or civil penalties owed to the Registry of Motor Vehicles in regular installments, as determined |
---|
38 | 38 | | 9by the registrar. |
---|
39 | 39 | | 10 (2) Such restored licenses shall remain valid only so long as the individual complies with |
---|
40 | 40 | | 11the terms of the payment agreement. If the individual fails to make required payments, the 2 of 2 |
---|
41 | 41 | | 12registrar may revoke the license following a written notice and opportunity to cure the payment |
---|
42 | 42 | | 13default within thirty days. |
---|
43 | 43 | | 14 (3) Nothing in this subsection shall preclude the registrar from revoking or suspending a |
---|
44 | 44 | | 15restored license for reasons unrelated to the payment agreement, as provided elsewhere in this |
---|
45 | 45 | | 16chapter. |
---|
46 | 46 | | 17 (4) The registrar shall promulgate regulations to implement this subsection, including |
---|
47 | 47 | | 18eligibility criteria, installment payment schedules, and procedures for reinstating licenses after |
---|
48 | 48 | | 19default. |
