2727 An Act ensuring internet security and privacy.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 Chapter 93 of the General Laws, as appearing in the 2022 Official Edition, is hereby
3131 2amended by inserting after section 114 the following section:-
3232 3 Section 115. Notwithstanding any other general or special law to the contrary, no
3333 4telecommunications or internet service provider that has entered into a franchise agreement,
3434 5right-of-way-agreement, or other contract with the commonwealth of Massachusetts or a political
3535 6subdivision, or that uses facilities that are subject to such agreements, even if it is not a party to
3636 7the agreement, or otherwise operates in the commonwealth of Massachusetts may collect, use,
3737 8disclose or otherwise disseminate, personal information from a customer resulting from the
3838 9customer’s use of the telecommunications or internet service provider without express written
3939 10approval from the customer. No such telecommunication or internet service provider shall add an 2 of 2
4040 11additional surcharge for customers that do not provide their express written approval, and said
4141 12providers shall not refuse to provide services to a customer on the grounds that the customer has
4242 13not approved collection, use, disclosure or other forms of dissemination of the customer’s
4343 14personal information”.
