2727 An Act ensuring senior care organization quality and accountability.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 Subsection (e) of section 9D of chapter 118E of the General Laws, as appearing in the
3131 22022 Official Edition, is hereby amended by adding the following new paragraph:-
3232 3 (7) In contracting with a nursing home licensed under section 71 of chapter 111, any
3333 4MassHealth senior care options program with which the department or division contracts to
3434 5provide and coordinate services on a capitated basis shall reimburse the nursing home for care
3535 6and services provided to a MassHealth member at an amount not less than the current applicable
3636 7Medicaid fee-for-service payment rate established under 101 CMR 206; provided, however, that
3737 8such reimbursement payments shall include room and board and all rate add-ons specified
3838 9pursuant to 101 CMR 206 for the purposes of ensuring access to critical services and facilitating
3939 10transitions from hospitals to nursing facilities.
