| 30 | 30 | | 1 Subsection (e) of section 9D of chapter 118E of the General Laws, as appearing in the |
|---|
| 31 | 31 | | 22022 Official Edition, is hereby amended by adding the following new paragraph:- |
|---|
| 32 | 32 | | 3 (7) In contracting with a nursing home licensed under section 71 of chapter 111, any |
|---|
| 33 | 33 | | 4MassHealth senior care options program with which the department or division contracts to |
|---|
| 34 | 34 | | 5provide and coordinate services on a capitated basis shall reimburse the nursing home for care |
|---|
| 35 | 35 | | 6and services provided to a MassHealth member at an amount not less than the current applicable |
|---|
| 36 | 36 | | 7Medicaid fee-for-service payment rate established under 101 CMR 206; provided, however, that |
|---|
| 37 | 37 | | 8such reimbursement payments shall include room and board and all rate add-ons specified |
|---|
| 38 | 38 | | 9pursuant to 101 CMR 206 for the purposes of ensuring access to critical services and facilitating |
|---|
| 39 | 39 | | 10transitions from hospitals to nursing facilities. |
