27 | 27 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
28 | 28 | | of the same, as follows: |
---|
29 | 29 | | 1 SECTION 1. Chapter 21 of the General Laws, as appearing in the 2022 Official Edition, |
---|
30 | 30 | | 2is hereby amended by inserting after chapter 21O the following chapter:- |
---|
31 | 31 | | 3 CHAPTER 21P. |

32 | 32 | | 4 MASSACHUSETTS HOTEL PACKAGING REDUCTION ACT |
---|
33 | 33 | | 5 Section 1. As used in this chapter, the following words shall have the following meanings |
---|
34 | 34 | | 6unless the context clearly requires otherwise: |
---|
35 | 35 | | 7 “Department”, the department of environmental protection. |
---|
36 | 36 | | 8 "Hotel", a building or portion of a building regularly used for the lodging of guests |
---|
37 | 37 | | 9including an apartment hotel, a motel or a boarding house, regardless of whether meals are |
---|
38 | 38 | | 10served. 2 of 2 |
---|
39 | 39 | | 11 "Hospitality personal care product", a product provided by a hotel and intended to be |
---|
40 | 40 | | 12applied to or used on the human body or any part thereof for cleansing, conditioning or |
---|
41 | 41 | | 13moisturizing including, but not limited to, shampoo, conditioner, lotion and liquid soap. |
---|
42 | 42 | | 14 "Small plastic bottle", a plastic container with a capacity of less than 12 ounces. |
---|
43 | 43 | | 15 Section 2. A hotel shall not provide any small plastic bottle containing a hospitality |
---|
44 | 44 | | 16personal care product. |
---|
45 | 45 | | 17 Section 3. A hotel that violates section 2 shall receive a warning notice detailing the |
---|
46 | 46 | | 18hotel's requirement to correct the violation within thirty days from the date the notice is sent. A |
---|
47 | 47 | | 19hotel shall be liable for a civil penalty of two hundred fifty dollars for the first violation after |
---|
48 | 48 | | 20receiving a warning and failing to correct the violation within thirty days and five hundred |
---|
49 | 49 | | 21dollars for any subsequent violation in the same calendar year. A hearing or opportunity to be |
---|
50 | 50 | | 22heard shall be provided prior to the assessment of any civil penalty. |
---|
51 | 51 | | 23 Section 4. The department shall enforce the provisions of this act. |
---|
52 | 52 | | 24 Section 5. This act shall take effect January 1, 2027. |
