| 31 | 31 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 32 | 32 | | of the same, as follows: |
|---|
| 33 | 33 | | 1 SECTION 1. Section 8G of chapter 26 of the General Laws is hereby amended by adding |
|---|
| 34 | 34 | | 2at the end thereof the following paragraph:- |
|---|
| 35 | 35 | | 3 Upon a declaration of an emergency in any area of the commonwealth by the governor or |
|---|
| 36 | 36 | | 4upon the declaration by the commissioner of insurance that severe weather conditions or other |
|---|
| 37 | 37 | | 5circumstances have resulted in a claims emergency, and notwithstanding any other provision of |
|---|
| 38 | 38 | | 6this section, an insurer may appoint temporary qualified appraisers to facilitate the prompt |
|---|
| 39 | 39 | | 7resolution of claims arising out of the emergency by notifying the Board either in writing, |
|---|
| 40 | 40 | | 8electronically or by facsimile. An appraiser already licensed in another state or an appraiser who |
|---|
| 41 | 41 | | 9works for an insurer that does business in Massachusetts and who regularly appraises motor 2 of 2 |
|---|
| 42 | 42 | | 10vehicles in a state where an appraiser license is not required shall be considered a qualified |
|---|
| 43 | 43 | | 11appraiser. A qualified appraiser so appointed shall be considered licensed for all purposes of this |
|---|
| 44 | 44 | | 12section, that that status shall terminate upon a determination by the commissioner of insurance |
|---|
| 45 | 45 | | 13that temporary appraisers are no longer required to facilitate the resolution of claims. |
|---|
| 46 | 46 | | 14 SECTION 2. This act shall take effect on enactment. |
