2929 An Act appointing temporary qualified appraisers for damage covered by auto insurance
3030 policies.
3131 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3232 of the same, as follows:
3333 1 SECTION 1. Section 8G of chapter 26 of the General Laws is hereby amended by adding
3434 2at the end thereof the following paragraph:-
3535 3 Upon a declaration of an emergency in any area of the commonwealth by the governor or
3636 4upon the declaration by the commissioner of insurance that severe weather conditions or other
3737 5circumstances have resulted in a claims emergency, and notwithstanding any other provision of
3838 6this section, an insurer may appoint temporary qualified appraisers to facilitate the prompt
3939 7resolution of claims arising out of the emergency by notifying the Board either in writing,
4040 8electronically or by facsimile. An appraiser already licensed in another state or an appraiser who
4141 9works for an insurer that does business in Massachusetts and who regularly appraises motor 2 of 2
4242 10vehicles in a state where an appraiser license is not required shall be considered a qualified
4343 11appraiser. A qualified appraiser so appointed shall be considered licensed for all purposes of this
4444 12section, that that status shall terminate upon a determination by the commissioner of insurance
4545 13that temporary appraisers are no longer required to facilitate the resolution of claims.
4646 14 SECTION 2. This act shall take effect on enactment.
