2626 An Act streamlining the prior authorization process.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 Notwithstanding any special or general law to the contrary, the commissioner of
3030 2insurance shall develop a list of services that are appropriate for real-time automated approvals
3131 3of prior authorization requests of covered services when the clinical information submitted
3232 4electronically by a provider clearly establishes that the patient meets the medical necessity
3333 5criteria for the requested service. In developing the list, the commissioner shall seek input from
3434 6the Massachusetts Collaborative and other interested stakeholders, and focus on services with
3535 7high prior authorization approval rates and clearly established clinical treatment protocols. The
3636 8division of insurance shall publish the list on its website not later than January 1, 2027. Carriers
3737 9that require prior authorization for services on the published list shall implement an automated
3838 10process for the real-time approval of covered services that clearly meet medical necessity criteria
3939 11not later than January 1, 2028.
