2828 An Act ensuring access to full spectrum pregnancy care.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Section 17C of chapter 32A of the General Laws, as appearing in the 2022
3232 2Official Edition, is hereby amended by striking out, in the first paragraph, the words “or certified
3333 3nurse midwife;” and inserting in place thereof the following words:- “certified nurse midwife, or
3434 4licensed midwife;” and is further amended in the second paragraph by striking out the words “or
3535 5certified nurse midwife” and inserting in place thereof the following words:- “certified nurse
3636 6midwife, or licensed certified professional midwife”.
3737 7 SECTION 2. Said section 17C of said chapter 32A, as so appearing, is hereby further
3838 8amended by striking out in the third paragraph, in each instance, the following words:- “for
3939 9abortion or abortion-related care”. 2 of 5
4040 10 SECTION 3. Said section 17C of said chapter 32A, as so appearing, is hereby further
4141 11amended by inserting after the fifth paragraph the following paragraph:-
4242 12 The commission shall ensure plan compliance with this section.
4343 13 SECTION 4. Section 10A of Chapter 118E of the General Laws, as appearing in the 2022
4444 14Official Edition, is hereby amended by striking out, in the first paragraph, the words “or certified
4545 15nurse midwife;” and inserting in place thereof the following words:- “certified nurse midwife, or
4646 16licensed midwife;” and is further amended in the second paragraph by striking out the words “or
4747 17certified nurse midwife” and inserting in place thereof the following words:- “certified nurse
4848 18midwife, or licensed certified professional midwife”.
4949 19 SECTION 5. Said section 10A of said chapter 118E, as so appearing, is hereby further
5050 20amended by inserting after the third paragraph the following two paragraphs:-
5151 21 Nothing in this section shall be construed to deny or restrict the division’s authority to
5252 22ensure its contracted health insurers, health plans, health maintenance organizations, behavioral
5353 23health management firms and third-party administrators under contract to a Medicaid managed
5454 24care organization or primary care clinician plan are in compliance with this chapter.
5555 25 The division shall ensure plan compliance with this chapter.
5656 26 SECTION 6. Section 47F of chapter 175 of the General Laws, as appearing in the 2022
5757 27Official Edition, is hereby amended by striking out, in the second paragraph, the words “or
5858 28certified nurse midwife;” and inserting in place thereof the following words:- “certified nurse
5959 29midwife, or licensed midwife;” and is further amended in the third paragraph by striking out the 3 of 5
6060 30following words” or certified nurse midwife” and inserting in place thereof the following words:-

6262 32 SECTION 7. Said section 47F of said chapter 175, as so appearing, is hereby further
6363 33amended by striking out in the fourth paragraph, in each instance, the following words:- “for

6666 36amended by inserting after the seventh paragraph the following paragraph:-

6868 38 SECTION 9. Section 8H of chapter 176A of the General Laws, as appearing in the 2022
6969 39Official Edition, is hereby amended by striking out, in the second paragraph, the words “or

105105 75certificates of health insurance subject to chapters 32A, 118E, 175, 176A, 176B and 176G of the
106106 76General Laws that are delivered, issued or renewed 6 months from the effective date of this act.
