2828 An Act relative to increasing consumer access to licensed rehabilitation counselors.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Section 22 of chapter 32A of the General Laws, as appearing in the 2022
3232 2Official Edition, is hereby amended by striking out the last paragraph and inserting in place
3333 3thereof the following paragraph:-
3434 4 For the purposes of this section, "licensed mental health professional" shall mean a
3535 5licensed physician who specializes in the practice of psychiatry, a licensed psychologist, a
3636 6licensed independent clinical social worker, a licensed mental health counselor, a licensed nurse
3737 7mental health clinical specialist, a licensed marriage and family therapist or a licensed
3838 8rehabilitation counselor within the lawful scope of practice for such therapist. 2 of 3
3939 9 SECTION 2. Section 47B of chapter 175 of the General Laws, as so appearing, is hereby
4040 10amended by striking out the next to last paragraph and inserting in place thereof the following
4141 11paragraph:-
4242 12 For the purposes of this section, "licensed mental health professional" shall mean a
4343 13licensed physician who specializes in the practice of psychiatry, a licensed psychologist, a
4444 14licensed independent clinical social worker, a licensed mental health counselor, a licensed nurse
4545 15mental health clinical specialist, a licensed marriage and family therapist, or a licensed
4646 16rehabilitation counselor within the lawful scope of practice for such therapist.
4747 17 SECTION 3. Section 8A of chapter 176A of the General Laws, as so appearing, is
4848 18hereby amended by striking out the next to last paragraph and inserting in place thereof the
4949 19following paragraph:-
5050 20 For the purposes of this section, "licensed mental health professional" shall mean a
5151 21licensed physician who specializes in the practice of psychiatry, a licensed psychologist, a
5252 22licensed independent clinical social worker, a licensed mental health counselor, a licensed nurse
5353 23mental health clinical specialist, a licensed marriage and family therapist, or a licensed
5454 24rehabilitation counselor within the lawful scope of practice for such therapist.
5555 25 SECTION 4. Section 4A of 176B of the General Laws, as so appearing, is hereby
5656 26amended by striking out the next to last paragraph and inserting in place thereof the following
5757 27paragraph:-
5858 28 For the purposes of this section, "licensed mental health professional" shall mean a
5959 29licensed physician who specializes in the practice of psychiatry, a licensed psychologist, a
6060 30licensed independent clinical social worker, a licensed mental health counselor, a licensed nurse 3 of 3
6161 31mental health clinical specialist, a licensed marriage and family therapist, or a licensed
6262 32rehabilitation counselor within the lawful scope of practice for such therapist.
6363 33 SECTION 5. Section 4M of 176G of the General Laws, as so appearing, is hereby
6464 34amended by striking out the next to last paragraph and inserting in place thereof the following
6565 35paragraph:-
6666 36 For the purposes of this section, "licensed mental health professional" shall mean a
6767 37licensed physician who specializes in the practice of psychiatry, a licensed psychologist, a
6868 38licensed independent clinical social worker, a licensed mental health counselor, a licensed nurse
6969 39mental health clinical specialist, a licensed marriage and family therapist, or a licensed
7070 40rehabilitation counselor within the lawful scope of practice for such therapist.
