27 | 27 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|

29 | 29 | | 1 SECTION 1. Chapter 32A of the General Laws, as appearing in the 2020 Official |
---|
30 | 30 | | 2Edition, is hereby amended by inserting after section 30 the following section: |
---|
31 | 31 | | 3 Section 31. (a) Any coverage offered by the commission to any active or retired |
---|
32 | 32 | | 4employee of the commonwealth insured under the group insurance commission shall provide |
---|
33 | 33 | | 5coverage for the provision of an annual executive physical examination. |
---|
34 | 34 | | 6 (b) Reimbursement provided under subsection (a) of this section for an annual executive |
---|
35 | 35 | | 7physical examination in an inpatient setting shall be provided separately from the existing |
---|
36 | 36 | | 8hospital payment for inpatient services. |
---|
37 | 37 | | 9 SECTION 2. Chapter 118E of the General Laws, as appearing in the 2020 Official |
---|
38 | 38 | | 10Edition, is hereby amended by inserting after section 10N the following section: 2 of 4 |

39 | 39 | | 11 Section 10O. (a) The division and its contracted health insurers, health plans, health |
---|
40 | 40 | | 12maintenance organizations, behavioral health management firms and third party administrators |
---|
41 | 41 | | 13under contract to a Medicaid managed care organization or primary care clinician plan shall |
---|
42 | 42 | | 14provide coverage for the provision of an annual executive physical examination. |
---|
43 | 43 | | 15 (b) Reimbursement provided under subsection (a) of this section for an annual executive |
---|
44 | 44 | | 16physical examination in an inpatient setting shall be provided separately from the existing |
---|
45 | 45 | | 17hospital payment for inpatient services. |
---|
46 | 46 | | 18 SECTION 3. Chapter 175 of the General Laws, as appearing in the 2020 Official Edition, |
---|
47 | 47 | | 19is hereby amended by inserting after section 47PP the following: |
---|
48 | 48 | | 20 Section 47QQ. (a) An individual policy of accident and sickness insurance issued |
---|
49 | 49 | | 21pursuant to section 108 and sickness insurance issued pursuant to section 110 shall provide |
---|
50 | 50 | | 22benefits for residents of the Commonwealth and all group members having a principal place of |
---|
51 | 51 | | 23employment within the Commonwealth coverage for the provision of an annual executive |
---|
52 | 52 | | 24physical examination. |
---|
53 | 53 | | 25 (b) Reimbursement provided under subsection (a) of this section for an annual executive |
---|
54 | 54 | | 26physical examination in an inpatient setting shall be provided separately from the existing |
---|
55 | 55 | | 27hospital payment for inpatient services. |
---|
56 | 56 | | 28 SECTION 4. Chapter 176A of the General Laws, as appearing in the 2020 Official |
---|
57 | 57 | | 29Edition, is hereby amended by inserting after section 8QQ the following: |

58 | 58 | | 30 Section 8RR. (a) Any contract between a subscriber and the corporation under an |
---|
59 | 59 | | 31individual or group hospital service plan that is delivered, issued or renewed within or without 3 of 4 |
---|
60 | 60 | | 32the Commonwealth shall provide to all individual subscribers and members within the |
---|
61 | 61 | | 33Commonwealth and to all group members having a principal place of employment within the |
---|
62 | 62 | | 34Commonwealth coverage for the provision an annual physical examination. |
---|
63 | 63 | | 35 (b) Reimbursement provided under subsection (a) of this section for an annual executive |
---|
64 | 64 | | 36physical examination in an inpatient setting shall be provided separately from the existing |
---|
65 | 65 | | 37hospital payment for inpatient services. |

66 | 66 | | 38 SECTION 5. Chapter 176B of the General Laws, as appearing in the 2020 Official |
---|
67 | 67 | | 39Edition, is hereby amended by inserting after section 4QQ the following: |

68 | 68 | | 40 Section 4RR. (a) Any subscription certificate under an individual or group medical |
---|
69 | 69 | | 41service agreement that is delivered, issued or renewed within or without the Commonwealth |
---|
70 | 70 | | 42shall provide to all individual subscribers and members within the Commonwealth and to all |
---|
71 | 71 | | 43group members having a principal place of employment within the Commonwealth coverage for |
---|
72 | 72 | | 44the provision of an annual executive physical examination. |
---|
73 | 73 | | 45 (b) Reimbursement provided under subsection (a) of this section for an annual executive |
---|
74 | 74 | | 46physical examination in an inpatient setting shall be provided separately from the existing |
---|
75 | 75 | | 47hospital payment for inpatient services. |

76 | 76 | | 48 SECTION 6. Chapter 176G of the General Laws, as appearing in the 2020 Official |

77 | 77 | | 49Edition, is hereby amended by inserting after section 4GG the following: |

78 | 78 | | 50 Section 4HH: (a) Any individual or group health maintenance contract that is issued, |
---|
79 | 79 | | 51renewed or delivered within or without the Commonwealth shall provide to residents of the 4 of 4 |
---|
80 | 80 | | 52Commonwealth and to persons having a principal place of employment within the |
---|
81 | 81 | | 53Commonwealth coverage for the provision of an annual executive physical examination. |

82 | 82 | | 54 (b) Reimbursement provided under subsection (a) of this section for an annual executive |

83 | 83 | | 55physical examination in an inpatient setting shall be provided separately from the existing |

85 | 85 | | 57 SECTION 7. Sections 1 through 6 of this act shall apply to all policies, contracts and |

86 | 86 | | 58certificates of health insurance subject to chapters 32A, chapter 118E, chapter 175, chapter |
---|
87 | 87 | | 59176A, chapter 176B, and chapter 176G which are delivered, issued or renewed on or after |
---|
88 | 88 | | 60September 1, 2026. |
