2626 An Act ensuring access to executive physical exams.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Chapter 32A of the General Laws, as appearing in the 2020 Official
3030 2Edition, is hereby amended by inserting after section 30 the following section:
3131 3 Section 31. (a) Any coverage offered by the commission to any active or retired
3232 4employee of the commonwealth insured under the group insurance commission shall provide
3333 5coverage for the provision of an annual executive physical examination.
3434 6 (b) Reimbursement provided under subsection (a) of this section for an annual executive
3535 7physical examination in an inpatient setting shall be provided separately from the existing
3636 8hospital payment for inpatient services.
3737 9 SECTION 2. Chapter 118E of the General Laws, as appearing in the 2020 Official
3838 10Edition, is hereby amended by inserting after section 10N the following section: 2 of 4
3939 11 Section 10O. (a) The division and its contracted health insurers, health plans, health
4040 12maintenance organizations, behavioral health management firms and third party administrators
4141 13under contract to a Medicaid managed care organization or primary care clinician plan shall
4242 14provide coverage for the provision of an annual executive physical examination.
4343 15 (b) Reimbursement provided under subsection (a) of this section for an annual executive
4444 16physical examination in an inpatient setting shall be provided separately from the existing
4545 17hospital payment for inpatient services.
4646 18 SECTION 3. Chapter 175 of the General Laws, as appearing in the 2020 Official Edition,
4747 19is hereby amended by inserting after section 47PP the following:
4848 20 Section 47QQ. (a) An individual policy of accident and sickness insurance issued
4949 21pursuant to section 108 and sickness insurance issued pursuant to section 110 shall provide
5050 22benefits for residents of the Commonwealth and all group members having a principal place of
5151 23employment within the Commonwealth coverage for the provision of an annual executive
5252 24physical examination.
5353 25 (b) Reimbursement provided under subsection (a) of this section for an annual executive
5454 26physical examination in an inpatient setting shall be provided separately from the existing
5555 27hospital payment for inpatient services.
5656 28 SECTION 4. Chapter 176A of the General Laws, as appearing in the 2020 Official
5757 29Edition, is hereby amended by inserting after section 8QQ the following:
5858 30 Section 8RR. (a) Any contract between a subscriber and the corporation under an
5959 31individual or group hospital service plan that is delivered, issued or renewed within or without 3 of 4
6060 32the Commonwealth shall provide to all individual subscribers and members within the
6161 33Commonwealth and to all group members having a principal place of employment within the
6262 34Commonwealth coverage for the provision an annual physical examination.
6363 35 (b) Reimbursement provided under subsection (a) of this section for an annual executive
6464 36physical examination in an inpatient setting shall be provided separately from the existing
6565 37hospital payment for inpatient services.
6666 38 SECTION 5. Chapter 176B of the General Laws, as appearing in the 2020 Official
6767 39Edition, is hereby amended by inserting after section 4QQ the following:
6868 40 Section 4RR. (a) Any subscription certificate under an individual or group medical
6969 41service agreement that is delivered, issued or renewed within or without the Commonwealth
7070 42shall provide to all individual subscribers and members within the Commonwealth and to all
7171 43group members having a principal place of employment within the Commonwealth coverage for
7272 44the provision of an annual executive physical examination.
7373 45 (b) Reimbursement provided under subsection (a) of this section for an annual executive
7474 46physical examination in an inpatient setting shall be provided separately from the existing
7575 47hospital payment for inpatient services.
7676 48 SECTION 6. Chapter 176G of the General Laws, as appearing in the 2020 Official
7777 49Edition, is hereby amended by inserting after section 4GG the following:
7878 50 Section 4HH: (a) Any individual or group health maintenance contract that is issued,
7979 51renewed or delivered within or without the Commonwealth shall provide to residents of the 4 of 4
8080 52Commonwealth and to persons having a principal place of employment within the
8181 53Commonwealth coverage for the provision of an annual executive physical examination.
8282 54 (b) Reimbursement provided under subsection (a) of this section for an annual executive
8383 55physical examination in an inpatient setting shall be provided separately from the existing
8484 56hospital payment for inpatient services.
8585 57 SECTION 7. Sections 1 through 6 of this act shall apply to all policies, contracts and
8686 58certificates of health insurance subject to chapters 32A, chapter 118E, chapter 175, chapter
8787 59176A, chapter 176B, and chapter 176G which are delivered, issued or renewed on or after
8888 60September 1, 2026.
