26	26	An Act increasing access to acute hospital at home services.
27	27	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
28	28	of the same, as follows:
29	29	1 SECTION 1. Chapter 32A of the General Laws, as appearing in the 2022 official edition,
30	30	2is hereby amended by inserting at the end thereof the following:
31	31	3 Section XX. The commission shall provide to any active or retired employee of the
32	32	4commonwealth who is insured under the group insurance commission coverage and
33	33	5reimbursement on par with in-person services for the cost of hospital at home services provided
34	34	6by an acute care hospital participating in the Centers for Medicare and Medicaid Services Acute
35	35	7Hospital Care at Home Program.
36	36	8 SECTION 2. Chapter 175 of the General Laws, as appearing in the 2022 official edition,
37	37	9is hereby amended by inserting at the end thereof the following:
38	38	10 Section XX. An individual policy of accident and sickness insurance issued under section
39	39	11108 that provides hospital expense and surgical expense insurance and any group blanket or
40	40	12general policy of accident and sickness insurance issued under section 110 that provides hospital 2 of 3
41	41	13expense and surgical expense insurance, which is issued or renewed within or without the
42	42	14commonwealth, shall provide coverage and reimbursement on par with in-person services for the
43	43	15cost of hospital at home services provided by an acute care hospital participating in the Centers
44	44	16for Medicare and Medicaid Services Acute Hospital Care at Home Program.
45	45	17 SECTION 3. Chapter 176A of the General Laws, as appearing in the 2022 official
46	46	18edition, is hereby amended by inserting at the end thereof the following:
47	47	19 Section XX. A contract between a subscriber and the corporation under an individual or
48	48	20group hospital service plan which provides hospital expense and surgical expense insurance,
49	49	21except contracts providing supplemental coverage to Medicare or other governmental programs,
50	50	22delivered, issued or renewed by agreement between the insurer and the policyholder, within or
51	51	23without the commonwealth, shall provide coverage and reimbursement on par with in-person
52	52	24services for the cost of hospital at home services provided by an acute care hospital participating
53	53	25in the Centers for Medicare and Medicaid Services Acute Hospital Care at Home Program.
54	54	26 SECTION 4. Chapter 176B of the General Laws, as appearing in the 2022 official
55	55	27edition, is hereby amended by inserting at the end thereof the following:
56	56	28 Section XX. Any subscription certificate under an individual or group medical service
57	57	29agreement, except certificates which provide supplemental coverage to medicare or other
58	58	30governmental programs, which is delivered, issued for delivery or renewed in the
59	59	31commonwealth, shall provide coverage and reimbursement on par with in-person services for the
60	60	32cost of hospital at home services provided by an acute care hospital participating in the Centers
61	61	33for Medicare and Medicaid Services Acute Hospital Care at Home Program. 3 of 3
62	62	34 SECTION 5. Chapter 176G of the General Laws, as appearing in the 2022 official
63	63	35edition, is hereby amended by inserting at the end thereof the following:
64	64	36 Section XX. Individual and group health maintenance contracts shall provide coverage
65	65	37and reimbursement on par with on-person services for the cost of hospital at home services
66	66	38provided by an acute care hospital participating in the Centers for Medicare and Medicaid
67	67	39Services Acute Hospital Care at Home Program.
68	68	40 SECTION 6. Chapter 176I of the General Laws, as appearing in the 2022 official edition,
69	69	41is hereby amended by inserting at the end thereof the following:
70	70	42 Section XX. An organization entering into a preferred provider contract shall provide
71	71	43coverage and reimbursement for the cost of hospital at home services provided by an acute care
72	72	44hospital participating in the Centers for Medicare and Medicaid Services Acute Hospital Care at
73	73	45Home Program.
