2626 An Act increasing access to acute hospital at home services.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Chapter 32A of the General Laws, as appearing in the 2022 official edition,
3030 2is hereby amended by inserting at the end thereof the following:
3131 3 Section XX. The commission shall provide to any active or retired employee of the
3232 4commonwealth who is insured under the group insurance commission coverage and
3333 5reimbursement on par with in-person services for the cost of hospital at home services provided
3434 6by an acute care hospital participating in the Centers for Medicare and Medicaid Services Acute
3535 7Hospital Care at Home Program.
3636 8 SECTION 2. Chapter 175 of the General Laws, as appearing in the 2022 official edition,
3737 9is hereby amended by inserting at the end thereof the following:
3838 10 Section XX. An individual policy of accident and sickness insurance issued under section
3939 11108 that provides hospital expense and surgical expense insurance and any group blanket or
4040 12general policy of accident and sickness insurance issued under section 110 that provides hospital 2 of 3
4141 13expense and surgical expense insurance, which is issued or renewed within or without the
4242 14commonwealth, shall provide coverage and reimbursement on par with in-person services for the
4343 15cost of hospital at home services provided by an acute care hospital participating in the Centers
4444 16for Medicare and Medicaid Services Acute Hospital Care at Home Program.
4545 17 SECTION 3. Chapter 176A of the General Laws, as appearing in the 2022 official
4646 18edition, is hereby amended by inserting at the end thereof the following:
4747 19 Section XX. A contract between a subscriber and the corporation under an individual or
4848 20group hospital service plan which provides hospital expense and surgical expense insurance,
4949 21except contracts providing supplemental coverage to Medicare or other governmental programs,
5050 22delivered, issued or renewed by agreement between the insurer and the policyholder, within or
5151 23without the commonwealth, shall provide coverage and reimbursement on par with in-person
5252 24services for the cost of hospital at home services provided by an acute care hospital participating
5353 25in the Centers for Medicare and Medicaid Services Acute Hospital Care at Home Program.
5454 26 SECTION 4. Chapter 176B of the General Laws, as appearing in the 2022 official
5555 27edition, is hereby amended by inserting at the end thereof the following:
5656 28 Section XX. Any subscription certificate under an individual or group medical service
5757 29agreement, except certificates which provide supplemental coverage to medicare or other
5858 30governmental programs, which is delivered, issued for delivery or renewed in the
5959 31commonwealth, shall provide coverage and reimbursement on par with in-person services for the
6060 32cost of hospital at home services provided by an acute care hospital participating in the Centers
6161 33for Medicare and Medicaid Services Acute Hospital Care at Home Program. 3 of 3
6262 34 SECTION 5. Chapter 176G of the General Laws, as appearing in the 2022 official
6363 35edition, is hereby amended by inserting at the end thereof the following:
6464 36 Section XX. Individual and group health maintenance contracts shall provide coverage
6565 37and reimbursement on par with on-person services for the cost of hospital at home services
6666 38provided by an acute care hospital participating in the Centers for Medicare and Medicaid
6767 39Services Acute Hospital Care at Home Program.
6868 40 SECTION 6. Chapter 176I of the General Laws, as appearing in the 2022 official edition,
6969 41is hereby amended by inserting at the end thereof the following:
7070 42 Section XX. An organization entering into a preferred provider contract shall provide
7171 43coverage and reimbursement for the cost of hospital at home services provided by an acute care
7272 44hospital participating in the Centers for Medicare and Medicaid Services Acute Hospital Care at
7373 45Home Program.
