2727 An Act relative to insurer responsibility to the operating budgets of health care oversight entities.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 SECTION 1. Section 6 of chapter 6D of the General Laws is hereby amended by striking
3131 2clause (b) and replacing it with following:-
3232 3 (b) Each acute hospital, ambulatory surgical center, non-hospital provider organization,
3333 4pharmaceutical manufacturing company, pharmacy benefit manager and surcharge payor shall
3434 5pay to the commonwealth an amount for the estimated expenses of the commission.
3535 6 and is further amended in said section and chapter by adding the following clause:-
3636 7 (g) The assessed amount for surcharge payors shall be not less than 30 per cent nor more
3737 8than 40 per cent of the amount appropriated by the general court for the expenses of the
3838 9commission minus amounts collected from: (i) filing fees; (ii) fees and charges generated by the
3939 10commission; and (iii) federal matching revenues received for these expenses or received
4040 11retroactively for expenses of predecessor agencies. Surcharge payors amount of the estimated 2 of 2
4141 12expense of the commission may be assessed and transferred in accordance with sections 64 and
4242 1366 of chapter 118E; provided further that such amount shall not be less than the health policy
4343 14commission revenue amount.
4444 15 SECTION 2. Section 7 of chapter 12C of the General Laws is hereby amended by
4545 16striking clause (b) and replacing it with the following:-
4646 17 (b) Each acute hospital, ambulatory surgical center, non-hospital provider organization,
4747 18pharmaceutical manufacturing company, pharmacy benefit manager and surcharge payor shall
4848 19pay to the commonwealth an amount for the estimated expenses of the center and for the other
4949 20purposes described in this chapter which shall include any transfer made to the Community
5050 21Hospital Reinvestment Trust Fund established in section 2TTTT of chapter 29.
5151 22 and is further amended in said section and chapter adding the following clause:-
5252 23 (g) The assessed amount for surcharge payors shall be not less than 30 per cent nor more
5353 24than 40 per cent of the amount appropriated by the general court for the expenses of the center
5454 25and for the other purposes described in this chapter which shall include any transfer made to the
5555 26Community Hospital Reinvestment Trust Fund established in section 2TTTT of chapter 29
5656 27minus amounts collected from: (i) filing fees; (ii) fees and charges generated by the center’s
5757 28publication or dissemination of reports and information; and (iii) federal matching revenues
5858 29received for these expenses or received retroactively for expenses of predecessor agencies.
5959 30Surcharge payors amount of the estimated expense of the commission may be assessed and
6060 31transferred in accordance with sections 64 and 66 of chapter 118E; provided further that such
6161 32amount shall not be less than the center for health information and analysis revenue amount.
