2828 An Act promoting continuity of health coverage for children.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 Section 9A of chapter 118E of the General Laws shall be amended by adding the
3232 2following section:-
3333 3 Section 17. (a) Residents of the commonwealth under age 19 who are enrolled in
3434 4MassHealth shall qualify for at least 12 months of continuous eligibility.
3535 5 (b) Continuous eligibility established under subsection (a) shall not apply in the following
3636 6circumstances: (i) the child turns 19, except when MassHealth provides continuous eligibility to
3737 7residents over age 19; (ii) the child ceases to be a state resident; (iii) the child or the child’s
3838 8representative requests voluntary disenrollment;
3939 9 (iv) eligibility is determined to have been erroneously granted because of agency error or 2 of 2
4040 10 fraud, abuse, or perjury attributed to the child or the child’s representative; or (v) the
4141 11child is deceased.
4242 12 (c) The executive office of health and human services shall maximize federal financial
4343 13participation for the coverage and benefits under this section; provided, however, that coverage
4444 14and benefits provided under this section shall not only be contingent upon the availability of
4545 15federal financial participation.
