AN ACT concerning 1 
 
Food Supplement Benefits – Students – Eligibility 2 
(SNAP for Students) 3 
 
FOR the purpose of requiring the Department of Human Services to provide food 4 
supplement benefits to certain students enrolled in an institution of higher education 5 
who meet a certain eligible income threshold; and generally relating to food 6 
supplement benefits for students. 7 
 
BY repealing and reenacting, with amendments, 8

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18 
That the Laws of Maryland read as follows: 19

 Except as provided in [§ 5–503] §§ 5–503 AND 5–503.1 of this subtitle, if any 22 
provision of this subtitle conflicts with any federal law, the federal law shall prevail. 23

5–503.1. 1 
 
 (A) IN THIS SECTION, “ELIGIBLE INCOME THRE SHOLD” MEANS, BASED ON 2 
THE INCOME OF A STUD ENT OR THE STUDENT ’S FAMILY: 3 
 
 (1) A STUDENT’S EXPECTED FAMILY CO NTRIBUTION IS $0 ON THE 4 
MOST RECENT FREE APPLICATION FOR FEDERAL STUDENT AID; OR 5 
 
 (2) A STUDENT IS ELIGIBL E TO PARTICIPATE IN A STATE OR 6 
FEDERALLY FINANCED W ORK STUDY PROGRAM .  7 
 
 (B) THE DEPARTMENT SHALL PROV IDE FOOD SUPPLEMENT BENEFITS TO A 8 
STUDENT WHO : 9 
 
 (1) IS A RESIDENT OF THE STATE; 10 
 
 (2) IS ENROLLED IN AN INSTI TUTION OF HIGHER EDU CATION FOR AT 11 
LEAST 15 CREDIT HOURS PER YEAR ; AND 12 
 
 (3) MEETS THE ELIGIBLE I NCOME THRESHOLD . 13 
 
 (C) FOR FISCAL YEAR 2025 AND EACH FISCAL YEAR THEREAFTER , THE 14 
GOVERNOR SHALL INCLUD E IN THE ANNUAL BUDG ET BILL AN APPROPRIATION IN 15 
AN AMOUNT SUFFICIENT TO REIMBURSE THE DEPARTMENT FOR EXPENDITURES 16 
MADE UNDER THIS SECT ION IN THE SECOND PRIOR FISCAL YEAR. 17 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That :  18 
 
 (a) Subject to the provisions of this section, Section 1 of this Act shall take effect 19 
contingent on the expiration of the expanded student eligibility for benefits under the 20 
federal Supplemental Nutrition Assistance Program, as modified by the Consolidated 21 
Appropriations Act, 2021. 22 
 
 (b) If the expanded student eligibility expires due to the end of the COVID–19 23 
public health emergency and no substantially similar federal legislation is enacted in its 24 
place, Section 1 of this Act shall take effect within 30 days after the expiration. 25 
 
 (c) The Department of Human Services shall notify the Department of Legislative 26 
Services within 5 days after the expiration of expanded student eligibility benefits. 27 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That , subject to the provisions of 28 
Section 2 of this Act, this Act shall take effect June 1, 2022. 29
