BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 14 That the Laws of Maryland read as follows: 15 Article – Human Services 16 5–101. 17 (a) In this title the following words have the meanings indicated. 18 (c) “Department” means the Department of Human Services. 19 5–301. 20 (a) In this subtitle the following words have the meanings indicated. 21 (b) “COMMUNITY SERVICE ” MEANS A STRUCTURED P ROGRAM WITH 22 EMBEDDED ACTIVITIES IN WHICH INDIVIDUALS PERFORM UNPAID WORK : 23 (1) FOR THE DIRECT BENEF IT OF THE COMMUNITY ; AND 24 (2) UNDER THE GUIDANCE A ND SUPPORT OF A PUBL IC OR NONPROFIT 25 ORGANIZATION . 26 (C) “FIP” means the Family Investment Program. 27 [(c)] (D) “Nonprofit organization” means a religious, charitable, or volunteer 28 organization that is exempt from taxation under § 501(c) of the Internal Revenue Code. 29 [(d)] (E) “Recipient” means each individual in a FIP case. 30 HOUSE BILL 1043 3 [(e)] (F) “Temporary cash assistance” means the cash assistance component of 1 the FIP that is funded wholly or partly through Title IV, Part A, of the Social Security Act. 2 [(f)] (G) “Third party payee” means: 3 (1) an individual that the Department approves; 4 (2) a nonprofit organization; 5 (3) a for–profit organization; or 6 (4) a governmental unit, including a local department. 7 [(g)] (H) “Transitional assistance” means assistance provided to a recipient 8 whose temporary cash assistance has been terminated for noncompliance with FIP 9 requirements. 10 [(h)] (I) “Work activity” means: 11 (1) job search activity; 12 (2) subsidized employment in either the public or private sector; 13 (3) work experience; 14 (4) on–the–job training; 15 (5) community service; 16 (6) training directly related to employment; or 17 (7) education directly related to employment. 18 (J) “WORK EXPERIENCE ” MEANS UNPAID WORK AC TIVITY, PERFORMED IN 19 RETURN FOR TEMPORARY CASH ASSISTANCE , THAT PROVIDES AN IND IVIDUAL WITH 20 AN OPPORTUNITY TO AC QUIRE THE GENERAL SK ILLS, KNOWLEDGE , AND WORK 21 HABITS NECESSARY TO OBTAIN EMPLOYMENT . 22 5–308. 23 (a) (1) (i) In this subsection the following words have the meanings 24 indicated. 25 (ii) “Target work rate” means the rate established for the State by 26 the U.S. Department of Health and Human Services based on the State’s caseload reduction 27 4 HOUSE BILL 1043 credit under the federal Temporary Assistance for Needy Families program, 42 U.S.C. 1 22–601 et seq. 2 (iii) “Work participation rate” means the federal work participation 3 rate established by the U.S. Department of Health and Human Services under the federal 4 Temporary Assistance for Needy Families program, 42 U.S.C. 22–601 et seq. 5 (2) A family may be eligible for assistance under this subtitle only if the 6 family includes: 7 (i) a minor child who resides with a custodial parent or other adult 8 caretaker who is a relative of the child; or 9 (ii) a pregnant individual. 10 (3) Assistance shall be provided to an applicant or recipient under this 11 subtitle only if the applicant or recipient: 12 (i) resides in the State at the time of application for assistance; 13 (ii) if applicable: 14 1. has applied for child support services with the appropriate 15 local child support enforcement office at the time of application for assistance; and 16 2. complies with the requirements of the local child support 17 enforcement office; 18 (iii) [has engaged in job search activities as requested by the 19 Department; 20 (iv)] participates in work activity under this subtitle; and 21 [(v)] (IV) meets all other FIP requirements that the Secretary 22 establishes by regulation. 23 (4) Subject to paragraph (5) of this subsection, the Department shall allow 24 an applicant or a recipient to meet the work activity requirement for a maximum of 24 25 months by engaging in: 26 (i) a minimum of 20 hours per week of vocational education that 27 leads to an associate degree, a diploma, or a certificate; or 28 (ii) an average of at least 20 hours per week of education directly 29 related to employment, which may include: 30 HOUSE BILL 1043 5 1. an adult basic education program; 1 2. an English as a second language program; or 2 3. a GED program. 3 (5) (I) 1. FOR PURPOSES OF REPOR TING THE WORK 4 PARTICIPATION RATE , THE STATE SHALL REPORT ON LY THE WORK ACTIVITI ES IN 5 WHICH AN INDIVIDUAL IS ENGAGED IN WORK . 6 2. AN INDIVIDUAL SHALL B E CONSIDERED ENGAGED IN 7 WORK IF THE INDIVIDU AL PARTICIPATES IN ANY OF THE FOLLOWING WOR K 8 ACTIVITIES: 9 A. SATISFACTORY ATTENDA NCE AT A SECONDARY 10 SCHOOL OR IN A COURS E OF STUDY LEADING T O A HIGH SCHOOL EQUI VALENCY 11 CREDENTIAL; 12 B. ON–THE–JOB TRAINING; 13 C. SUBSIDIZED EMPLOYMEN T IN EITHER THE PUBLIC OR 14 PRIVATE SECTOR ; OR 15 D. UNSUBSIDIZED EMPLOYM ENT. 16 3. THE DEPARTMENT MAY NOT RE QUIRE AN 17 INDIVIDUAL TO VERIFY THE HOURS OF PARTICI PATION IN WORK ACTIV ITY THAT IS 18 NOT CONSIDERED BEING ENGAGED IN WORK . 19 (II) If the work participation rate does not exceed the target work 20 rate by AT LEAST 10% in any month, the Department, after providing at least 30 days prior 21 notice to the Senate Finance Committee and the House Appropriations Committee, may, 22 UNTIL THE WORK PART ICIPATION RATE EXCEE DS THE TARGET WORK R ATE BY AT 23 LEAST 10% FOR 3 CONSECUTIVE MONTHS , suspend the application of: 24 1. paragraph (4) of this subsection to new applicants [until 25 the work participation rate exceeds the target work rate by 10% for 3 consecutive months]; 26 OR 27 2. SUBPARAGRAPH (I) OF THIS PARAGRAPH . 28 (III) 1. SUBJECT TO SUBSUBPARA GRAPHS 2 AND 3 OF THIS 29 SUBPARAGRAPH , TO VERIFY SUBSIDIZED AND UNSUBSIDIZED EMP LOYMENT AND 30 ON–THE–JOB TRAINING FOR PUR POSES OF THE WORK PA RTICIPATION RATE , THE 31 6 HOUSE BILL 1043 DEPARTMENT SHALL VERI FY AN INDIVIDUAL ’S EMPLOYMENT ON COMM ENCEMENT 1 OF THE WORK ACTIVITY AND USE THE ACTUAL H OURS OF EMPLOYMENT 2 PARTICIPATION TO PRO JECT THE HOURS OF EM PLOYMENT PARTICIPATI ON FOR A 3 MAXIMUM PERIOD OF 6 MONTHS. 4 2. NOT LATER THAN AT THE END OF A 6–MONTH PERIOD 5 OR AT THE TIME THE DEPARTMENT RECEIVES I NFORMATION THAT AN I NDIVIDUAL’S 6 ACTUAL HOURS OF EMPL OYMENT PARTICIPATION HAVE CHANGED , WHICHEVER IS 7 SOONER, THE DEPARTMENT SHALL VERI FY THE INDIVIDUAL ’S CURRENT, ACTUAL 8 AVERAGE HOURS OF EMP LOYMENT PARTICIPATION TO P ROJECT THE HOURS OF 9 EMPLOYMENT PARTICIPA TION FOR UP TO AN AD DITIONAL 6 MONTHS. 10 3. THE DEPARTMENT MAY NOT RE QUIRE AN 11 INDIVIDUAL TO VERIFY ACTUAL HOURS OF EMPL OYMENT PARTICIPATION AT A 12 FREQUENCY OTHER THAN THAT REQUIRED UNDER THIS SUBPARAGRAPH . 13 (6) THE DEPARTMENT MAY REQUIR E A WORK–ELIGIBLE INDIVIDUAL 14 TO PARTICIPATE IN WO RK ACTIVITY FOR A MA XIMUM OF: 15 (I) 30 HOURS PER WEEK FOR A N INDIVIDUAL WITH A CHILD AT 16 LEAST 6 YEARS OLD; 17 (II) 20 HOURS PER WEEK FOR A SINGLE PARENT OR CARETAKER 18 RELATIVE WITH A CHIL D UNDER THE AGE OF 6 YEARS; 19 (III) A COMBINED AVERAGE O F 35 HOURS PER WEEK FOR A 20 FAMILY WITH TWO WORK –ELIGIBLE PARENTS WHO DO NOT RECEIVE FEDER ALLY 21 FUNDED CHILD CARE AS SISTANCE; OR 22 (IV) A COMBINED AVERAGE O F 55 HOURS PE R WEEK FOR A 23 FAMILY WITH TWO WORK –ELIGIBLE PARENTS WHO RECEIVE FEDERALLY FU NDED 24 CHILD CARE ASSISTANC E, PROVIDED THAT AN ADU LT IN THE FAMILY DOE S NOT 25 HAVE A DISABILITY OR IS NOT CARING FOR A CHILD WITH A DISABIL ITY. 26 (7) (I) A WORK–ELIGIBLE INDIVIDUAL MAY CHOOSE TO 27 PARTICIPATE IN WORK ACTIVITY FOR MORE TH AN THE REQUIRED WEEK LY HOURS 28 UNDER PARAGRAPH (6) OF THIS SUBSECTION , UP TO A MAXIMUM OF 40 HOURS PER 29 WEEK, PROVIDED THAT WORKIN G THE ADDITIONAL HOU RS DOES NOT VIOLATE THE 30 FEDERAL FAIR LABOR STANDARDS ACT. 31 (II) THE DEPARTMENT MAY NOT RE DUCE THE TEMPORARY 32 CASH ASSISTANCE OF A N INDIVIDUAL, AS PROVIDED IN § 5–312(E)(1)(I) OF THIS 33 SUBTITLE, IF THE INDIVIDUAL IS MEETING THE DEPARTMENT ’S MINIMUM WORK 34 HOUSE BILL 1043 7 ACTIVITY PARTICIPATI ON REQUIREMENT AND P ARTICIPATING IN WOR K ACTIVITY 1 FOR LESS THAN 40 HOURS PER WEEK . 2 (8) THE DEPARTMENT SHALL ACCE PT VERIFICATION OF A N 3 INDIVIDUAL’S WORK ACTIVITY PART ICIPATION THROUGH MU LTIPLE METHODS , 4 INCLUDING ELECTRONIC SUBMISSION. 5 (b) (1) An individual may not be required to meet the work activity 6 requirement under subsection [(a)(2)(iv)] (A)(3)(III) of this section if the individual is 7 exempt under criteria the Secretary establishes. 8 (2) The criteria shall include exemptions for: 9 (i) SUBJECT TO PARAGRAPH (3) OF THIS SUBSECTION , adults 10 who are required to care for a child who is a recipient under the age of 1 year; [and] 11 (ii) subject to paragraph [(3)] (4) of this subsection, adults and 12 children who are recipients and who are severely disabled; AND 13 (III) ADULTS WHO HAVE NOT RECEIVED ASSISTANCE FOR AT 14 LEAST 12 6 MONTHS. 15 (3) AN EXEMPTION BASED ON AN ADULT’S REQUIREMENT TO CAR E 16 FOR A CHILD WHO IS A RECIPIENT UNDER THE AGE OF 1 YEAR MAY NOT BE 17 RESTRICTED TO A MAXI MUM NUMBER OF MON THS IN THE ADULT ’S LIFETIME. 18 (4) An individual’s exemption because of severe disability is limited to 12 19 months unless: 20 (i) the individual applies for Supplemental Security Income; and 21 (ii) the application is approved, pending, or on appeal. 22 [(4)] (5) Assistance for an individual who qualifies for an exemption 23 under this subsection but who voluntarily participates in a work activity may not be 24 reduced or terminated as a result of the participation in the work activity. 25 (c) (1) Assistance for an individual may not be reduced or terminated for 26 noncompliance with the work activity requirement if the individual has good cause under 27 the criteria established by the Secretary. 28 (2) The criteria shall provide that any of the following are sufficient to show 29 good cause: 30 (i) temporary illness or incapacity; 31 8 HOUSE BILL 1043 (ii) court–required appearances or temporary incarceration; 1 (iii) domestic violence; 2 (iv) a family crisis that threatens normal family functioning, 3 including: 4 1. experiencing homelessness whereby a family: 5 A. lacks a fixed, regular, and adequate nighttime residence, 6 or shares the housing of other persons due to the loss of housing, economic hardship, or a 7 similar reason; 8 B. lives in a motel, hotel, trailer park, or camping ground due 9 to a lack of alternative accommodations; 10 C. lives in an emergency shelter or transitional housing; 11 D. resides in a primary nighttime residence that is a public 12 or private place not designed for or ordinarily used as a regular sleeping accommodation 13 for human beings; or 14 E. lives in a car park, public space, vacant or abandoned 15 building, substandard housing, bus station, train station, or similar setting; 16 2. a housing crisis, including eviction, foreclosure, or other 17 loss of housing; or 18 3. receiving a utility disconnection notice or having a utility 19 disconnected; 20 (v) a breakdown in transportation arrangements; 21 (vi) a breakdown in child care arrangements or lack of child care for 22 a child or children who are 12 years old or younger; 23 (vii) for a single parent caring for a child younger than 6 years old 24 who is unable to obtain child care: 25 1. the unavailability of appropriate child care within a 26 reasonable distance from the parent’s home or work site; 27 2. the unavailability or unsuitability of informal child care 28 by a relative or others; or 29 HOUSE BILL 1043 9 3. the unavailability or unsuitability of appropriate and 1 affordable child care arrangements; 2 (viii) a lack of supportive services identified and agreed on by an 3 individual and a local department; or 4 (ix) the failure of a local department to offer or provide a reasonable 5 accommodation to an individual with a disability. 6 (d) Subject to the State budget, a legal immigrant is entitled to assistance under 7 this subtitle if the immigrant: 8 (1) meets FIP eligibility requirements under this subtitle and any other 9 requirements imposed by the State; and 10 (2) (i) arrived in the United States before August 22, 1996; or 11 (ii) arrived in the United States on or after August 22, 1996 and is 12 not eligible for federally funded cash assistance. 13 5–308.1. 14 (A) THE PURPOSE OF WORK E XPERIENCE IS TO IMPR OVE THE 15 EMPLOYABILITY OF IND IVIDUALS WHO CANNOT FIND UNSUBSIDIZED FU LL–TIME 16 EMPLOYMENT . 17 (B) THE DEPARTMENT MAY REF ER AN INDIVIDUAL TO WORK EXPERIENCE 18 FOR WORK ACTIVITY IF : 19 (1) PRIVATE SECTOR EMPLO YMENT IS NOT AVAILAB LE; 20 (2) THE MAXIMUM WORK EXP ERIENCE PLACEMENT FO R THE 21 INDIVIDUAL DOES NOT EXCEED 90 DAYS IN A 3–YEAR PERIOD; 22 (3) THE DEPARTMENT OFFERS THE INDIVIDUAL AT LEAST THREE 23 WORK ACTIVITY OPTION S THAT INCLUDE : 24 (I) SUBJECT TO SUBSECTIO N (C) OF THIS SECTION , ONLY ONE 25 WORK EXPERIENCE OPTI ON; AND 26 (II) AT LEAST ONE OPTION THAT IS WORK ACTIVIT Y OR A 27 PROGRAM FUNDED BY TH E FEDERAL WORKFORCE INNOVATION AND OPPORTUNITY 28 ACT; 29 10 HOUSE BILL 1043 (4) THE INDIVIDUAL CHOOS ES THE WORK EXPERIEN CE FOR WORK 1 ACTIVITY; 2 (5) THE DEPARTMENT INFORMS TH E INDIVIDUAL THAT TH E 3 INDIVIDUAL MA Y SUBSEQUENTLY CHANG E TO DIFFERENT WORK ACTIVITY; AND 4 (6) THE WORK EXPERIENCE PROVIDES SKILLS THAT MATCH THE 5 INDIVIDUAL’S PERSONAL, CAREER, AND FAMILY GOALS TO SUPPORT ECONOMIC 6 MOBILITY; AND 7 (7) THE WORK SITE MEETS THE REQUIREMENTS OF SUBSECTION (D) 8 OF THIS SECTION. 9 (C) IF THE DEPARTMENT OFFERS WOR K EXPERIENCE AS WORK ACTIVITY, 10 THE DEPARTMENT MAY NOT OF FER COMMUNITY SERVIC E AS WORK ACTIVITY . 11 (D) (1) FOR A WORK SITE TO QU ALIFY AS AN APPROPRI ATE PLACEMENT 12 FOR WORK EXPERIENCE UNDER THIS SECTION , THE WORK SITE MUST : 13 (I) BE SUPERVISED BY AN EMPLOYER, A WORK SITE SPONSOR , 14 OR ANY OTHER RESPONS IBLE PARTY ON AN ONG OING BASIS AT LEAST ONCE EACH 15 DAY IN WHICH THE IND IVIDUAL IS SCHEDULED TO PARTICIPATE IN TH E WORK 16 EXPERIENCE; 17 (II) OFFER PARTICIPANTS M ARKETABLE SKILLS NECE SSARY TO 18 OBTAIN EMPLOYMENT IN LOCAL HIGH–GROWTH INDUSTRIES ID ENTIFIED IN THE 19 STATE; AND 20 (III) BE LIMITED TO NOT MO RE THAN FIVE WORK EX PERIENCE 21 PLACEMENTS AT ANY GI VEN TIME. 22 (2) SUBJECT TO SUBSECTION (E)(2) OF THIS SECTION , A WORK SITE 23 SHALL BE DISQUALIFIE D FROM HAVING ANY IN DIVIDUALS IN WORK EX PERIENCE 24 PLACEMENTS FOR A 5–YEAR PERIOD IF, IN A 1–YEAR PERIOD, THE WORK SITE DOES 25 NOT HIRE THE GREATER OF: 26 (I) IF ONLY ONE INDIVIDU AL WAS PLACED IN THE WORK SITE 27 FOR WORK EXPERIENCE , THE INDIVIDUAL; OR 28 (II) 50% OF INDIVIDUALS PLACE D IN THE WORK SITE F OR WORK 29 EXPERIENCE. 30 HOUSE BILL 1043 11 (E) (1) IF AT ANY TIME THE RE QUIREMENTS OF SUBSEC TION (B) OF THIS 1 SECTION ARE NOT MET , AN INDIVIDUAL PLACED IN WORK EXPERIENCE M AY 2 REQUEST A TRANSFER T O DIFFERENT WORK ACT IVITY. 3 (2) AN INDIVIDUAL WHO TRA NSFERS FROM THE WORK SITE UNDER 4 PARAGRAPH (1) OF THIS SUBSECTION MAY NOT BE C OUNTED FOR PURPOSES OF THE 5 HIRING REQUIREMENT U NDER SUBSECTION (D)(2) OF THIS SECTION. 6 5–308.2. 7 (A) THE PURPOSE OF COMMUN ITY SERVICE IS TO IM PROVE THE 8 EMPLOYABILITY OF IND IVIDUALS WHO CANNOT FIND UNSUBSIDIZED FU LL–TIME 9 EMPLOYMENT . 10 (B) COMMUNITY SERVICE SHA LL: 11 (1) BE LIMITED TO PROJEC TS THAT SERVICE A US EFUL COMMUNITY 12 PURPOSE IN FIELDS IN CLUDING HEALTH , SOCIAL SERVICE , ENVIRONMENTAL 13 PROTECTION , EDUCATION, URBAN AND RURAL DEVE LOPMENT, WELFARE, 14 RECREATION , PUBLIC FACILITIES , PUBLIC SAFETY, AND CHILD CARE ; AND 5 (7) WHEN MAKING APPROPRI ATE COMMUNITY SERVIC E 6 ASSIGNMENTS , THE DEPARTMENT HAS CONSID ERED THE INDIVIDUAL ’S PRIOR 7 TRAINING, EXPERIENCE, AND SKILLS. 8 (D) IF THE DEPARTMENT OFFERS COM MUNITY SERVICE AS WO RK ACTIVITY, 9 THE DEPARTMENT MAY NOT OF FER WORK EXPERIENCE AS WORK ACTIVITY . 10 (E) IF AT ANY TIME THE RE QUIREMENTS OF SUBSEC TION (C) OF THIS 11 SECTION ARE NOT MET , AN INDIVIDUAL PLACED IN COMMUNITY SERVICE MAY 12 REQUEST A TRANSFER T O DIFFERENT WORK ACT IVITY. 13 5–322. 14 (a) On or before October 1 each year, the Department shall report to the General 15 Assembly, in accordance with § 2–1257 of the State Government Article, the following 16 information: 17 (1) for the preceding year: 18 [(1)] (I) the number of recipients who engaged in vocational education or 19 education directly related to employment; 20 [(2)] (II) the number of recipients who completed vocational education or 21 education directly related to employment; 22 [(3)] (III) the number of recipients who obtained or maintained 23 employment for 6 months, 12 months, 18 months, and 24 months after completing 24 vocational education or education directly related to employment; and 25 [(4)] (IV) the average earnings of recipients who obtained or maintained 26 employment for 6 months, 12 months, 18 months, and 24 months after completing 27 vocational education or education directly related to employment; AND 28 (2) FOR THE PRECEDING FI SCAL YEAR , THE FOLLOWING 29 INFORMATION ON WORK EXPERIENCE AND COMMU NITY SERVICE WORK AC TIVITY 30 PLACEMENTS : 31 HOUSE BILL 1043 13 (I) INFORMATION ON THE W ORK SITES AND THE PU BLIC, 1 PRIVATE, AND NONPROFIT ORGANI ZATIONS THAT HAVE EN GAGED TEMPORARY 2 CASH ASSISTANCE RECI PIENTS IN WORK EXPER IENCE AND COMMUNITY SERVICE, 3 INCLUDING: 4 1. A LIST, ORGANIZED BY COUNTY , OF ALL WORK SITES 5 IN THE STATE, INCLUDING UNITS OF STATE, FEDERAL, AND LOCAL GOVERNMENT 6 THAT HAVE ENGAGED TE MPORARY CASH ASSISTA NCE RECIPIENTS IN WO RK 7 EXPERIENCE; 8 2. FOR EACH WORK SITE : 9 A. THE TOTAL NUMBER OF WORK EXPERIENCE 10 PLACEMENTS FOR THE Y EAR; 11 B. THE POSITION, JOB DUTIES, NUMBER OF HOURS , AND 12 MARKET SALARY RATE F OR THE JOB BEING PER FORMED BY THE TEMPOR ARY CASH 13 ASSISTANCE RECIPIENT S ENGAGED IN WORK EX PERIENCE; AND 14 C. THE NUMBER OF TEMPOR ARY CASH ASSISTANCE 15 RECIPIENTS ENGAGED I N WORK EXPERIENCE WH O WERE HIRED BY THE WORK SITE 16 FOR UNSUBSIDIZED EMP LOYMENT; AND 17 3. ANY WORK SITES THAT WERE DISQUALIFIED AS AN 18 APPROPRIATE PLACEMEN T FOR WORK EXPERIENC E UNDER § 5–308.1(D)(2) OF THIS 19 SUBTITLE; AND 20 4. A LIST, ORGANIZED BY COUNTY , OF ALL PUBLIC AND 21 NONPROFIT ORGANIZATI ONS IN THE STATE THAT HAVE ENGAG ED TEMPORARY CASH 22 ASSISTANCE RECIPIENT S IN COMMUNITY SERVI CE; 23 (II) INFORMATION , ORGANIZED BY THE NUM BER, 24 JURISDICTION, RACE, ETHNICITY, AGE, AND GENDER OF INDIVI DUALS WHO 25 PARTICIPATED IN WORK EXPERIENCE AND COMMU NITY SERVICE; AND 26 (III) INFORMATION ON THE E MPLOYMENT OUTCOMES O F 27 INDIVIDUALS WHO PART ICIPATED IN WORK EXP ERIENCE, INCLUDING THE NUMBER 28 OF INDIVIDUALS IN WO RK EXPERIENCE WHO WERE PROVIDED DIRECT ENTR Y INTO 29 A FULL–TIME JOB WITH A WAGE THAT: 30 1. EQUALS OR EXCEEDS TH E STATE MINIMUM WAGE ; 31 2. EQUALS OR EXCEEDS 150% OF THE STATE MINIMUM 32 WAGE; AND 33 14 HOUSE BILL 1043 3. EQUALS OR EXCEEDS 200% OF THE STATE MINIMUM 1 WAGE. 2 (b) The information in the report required under subsection [(a)] (A)(1) of this 3 section shall be broken down by the types of vocational education or education programs in 4 which the recipients engaged, including: 5 (1) associate degree programs; 6 (2) vocational education programs that do not lead to an associate degree; 7 (3) postsecondary education programs that are not included in items (1) or 8 (2) of this subsection; 9 (4) adult basic education programs; 10 (5) English as a second language programs; and 11 (6) GED programs. 12 SECTION 2.
