A BILL ENTITLED 
 
AN ACT concerning 1 
 
Solid Waste Disposal and Diversion and On–Farm Composting and Compost Use 2 
 
FOR the purpose of establishing the On–Farm Composting and Compost Use Grant Fund 3 
as a special, nonlapsing fund; requiring interest earnings of the On–Farm 4 
Composting and Compost Use Grant Fund to be credited to the Fund; establishing a 5 
solid waste disposal surcharge to be paid, on a quarterly basis beginning on a certain 6 
date, to the Comptroller by owners or operators of refuse disposal facilities in the 7 
State; establishing the Environmental Stewardship Fund as a special, nonlapsing 8 
fund; requiring interest earnings of the Environmental Stewardship Fund to be 9 
credited to the Fund; requiring the Comptroller, on an annual basis, to transfer 10 
certain solid waste disposal surcharge revenue to certain funds for certain purposes; 11 
specifying that certain solid waste disposal surcharge revenue transferred to the 12 
State Recycling Trust Fund may not revert to the General Fund; requiring certain 13 
revenue transferred to the State Recycling Trust Fund to be used by the Office of 14 
Recycling in the Department of the Environment to award certain grants; and 15 
generally relating to solid waste disposal and diversion and on–farm composting and 16

 (1) FOR WHICH AN APPLICANT CLEARLY DESCRIBES HO W THE 23 
PROJECT WILL SUPPORT ON–FARM COMPOSTING OR C OMPOST USE;  24 
 
 (2) THAT COMPLY WITH COMAR 26.04.11, COMAR 15.18.04, AND 25 
OTHER RELEVANT REGUL ATIONS;  26 
 
 (3) THAT DIVERT ORGANIC W ASTE FROM REFUSE DISPOSAL 27 
FACILITIES TO INSTEA D BE COMPOSTED WHERE THE RESULTING COMPOS T IS 28 
RETURNED TO MARYLAND SOIL TO SUPP ORT FOOD PRODUCTION ;  29  6 	HOUSE BILL 1070  
 
 
 
 (4) FOR WHICH AN APPLICAN T DEMONSTRATE S KNOWLEDGE OF BEST 1 
PRACTICES IN THE FIE LD AND HOW TO INCORPORATE T HOSE BEST PRACTICES IN 2 
THE PROJECT; 3 
 
 (5) THAT SERVE A FARM OWNED OR OPER ATED BY A FARMER WHO IS 4 
A LOW–INCOME INDIVIDUAL, A SOCIALLY DISADVANTAG ED INDIVIDUAL, A WOMAN, 5 
OR A VETERAN;  6 
 
 (6) THAT SERVE A LOW–INCOME OR SOCIALLY D ISADVANTAGED 7 
COMMUNITY ; OR 8 
 
 (7) THAT ENGAGE SMALL OR DIVE RSE FARMING OPERATIO NS.  9 
 
Article – Environment 10 
 
9–201. 11 
 
 (a) In this subtitle the following words have the meanings indicated. 12 
 
 (e) “Refuse disposal system” includes: 13 
 
 (1) An incinerator; 14 
 
 (2) A transfer station; 15 
 
 (3) A landfill system; 16 
 
 (4) A landfill; 17 
 
 (5) A solid waste processing facility; and 18 
 
 (6) Any other solid waste acceptance facility. 19 
 
9–1701. 20 
 
 (a) In this subtitle the following words have the meanings indicated. 21 
 
 (d) “Composting” means the controlled aerobic biological decomposition of organic 22 
waste material in accordance with the standards established by the Secretary under this 23 
title. 24 
 
 (m) “Office” means the Office of Recycling within the Department. 25

 (q) “Recycling” means any process in which recyclable materials are collected, 1 
separated, or processed and returned to the marketplace in the form of raw materials or 2 
products. 3

 (f) (1) There is a State Recycling Trust Fund. 5 
 
 (2) The Fund shall consist of: 6 
 
 (i) The newsprint recycling incentive fee; 7 
 
 (ii) The telephone directory recycling incentive fee collected under § 8 
9–1709 of this subtitle; 9 
 
 (iii) The covered electronic device manufacturer registration fee 10 
collected under § 9–1728 of this subtitle; 11 
 
 (IV) THE SOLID WASTE DIS POSAL SURCHARGE REVE NUE 12 
TRANSFERRED TO THE FUND UNDER § 9–17A–03(F)(3)(II) OF THIS TITLE; 13 
 
 [(iv)] (V) All fines and penalties collected under this subtitle; 14 
 
 [(v)] (VI) Money appropriated in the State budget to the Fund; and 15 
 
 [(vi)] (VII) Any other money from any other source accepted for the 16 
benefit of the Fund. 17 
 
 (3) The Secretary shall administer the Fund. 18 
 
 (4) The Treasurer shall hold the Fund separately and the Comptroller shall 19 
account for the Fund. 20 
 
 (5) (I) [At] EXCEPT AS PROVIDED I N SUBPARAGRAPH (II) OF THIS 21 
PARAGRAPH , AT the end of each fiscal year, any unspent or unencumbered balance in the 22 
Fund that exceeds $2,000,000 shall revert to the General Fund of the State in accordance 23 
with § 7–302 of the State Finance and Procurement Article. 24 
 
 (II) 1. THE SOLID WASTE DISPO SAL SURCHARGE REVENU E 25 
TRANSFERRED TO THE FUND UNDER § 9–17A–02(F)(3)(II) OF THIS TITLE IS NOT 26 
SUBJECT TO § 7–302 OF THE STATE FINANCE AND PROCUREMENT ARTICLE AND 27 
MAY NOT REVERT TO TH E GENERAL FUND OF THE STATE. 28 
 
 2. THE OFFICE MAY ESTABLISH A SOLID WASTE 29 
DISPOSAL SURCHARGE ACCOUNT IN THE FUND. 30

 (6) In accordance with the State budget, the Fund shall be used only: 1 
 
 (i) To provide grants to the counties to be used by the counties to 2 
develop and implement local recycling plans; 3 
 
 (ii) To provide grants to counties that have addressed methods for 4 
the separate collection and recycling of covered electronic devices in accordance with §  5 
9–1703(c)(1) of this subtitle; 6 
 
 (iii) To provide grants to municipalities to be used by the 7 
municipalities to implement local covered electronic device recycling programs; [and] 8 
 
 (IV) TO PROVIDE GRANTS UND ER §§ 9–17A–04 AND 9–17A–05 9 
OF THIS TITLE; AND 10 
 
 [(iv)] (V) To carry out the purposes of the land management 11 
administration. 12 
 
 (7) (i) The Treasurer shall invest the money in the Fund in the same 13 
manner as other State money may be invested. 14 
 
 (ii) Any investment earnings of the Fund shall be credited to the 15 
General Fund of the State. 16

OWNER OR OPERATOR OF A REFUSE DISPOSAL FA CILITY IN THE STATE. 28

 (B) (1) THE SOLID WASTE DISPO SAL SURCHARGE IS $5 PER TON OF SOLID 1 
WASTE PROCESSED BY A REFUSE DISPOSAL SYSTEM. 2 
 
 (2) ON OR BEFORE JANUARY 1, 2028, AND EVERY 5 YEARS 3 
THEREAFTER , THE OFFICE SHALL: 4 
 
 (I) ADJUST THE SOLID WASTE DISPOSAL SURCHARGE IN 5 
ACCORDANCE WITH THE CONSUMER PRICE INDEX FOR THE MID–ATLANTIC 6 
DIVISION; AND 7 
 
 (II) EVALUATE THE SOLID WA STE DISPOSAL SURCHAR GE TO 8 
DETERMINE WHETHER AD JUSTMENTS TO THE SUR CHARGE ARE NECESSARY . 9 
 
 (C) IF A SURCHARGE HAS BE EN ASSESSED ON AN OWNER OR OPERATOR OF 10 
A TRANSFER STATION , THE SOLID WASTE DISPO SAL SURCHARGE MAY NOT BE 11 
ASSESSED ON AN OWNER OR OPERATOR OF A REFUSE DISPOSAL SYSTEM THAT 12 
RECEIVES THE SOLID W ASTE FOR FINAL DISPO SAL.  13 
 
 (D) (1) THE COMPTROLLER SHALL COL LECT THE SOLID WASTE 14 
DISPOSAL SURCHARGE AS SESSED UNDER THIS SE CTION AND DEPOSIT TH E REVENUE 15 
INTO THE ENVIRONMENTAL STEWARDSHIP FUND ESTABLISHED UNDE R § 9–17A–03 16 
OF THIS SUBTITLE. 17 
 
 (2) (I) BEGINNING APRIL 1, 2023, ON A QUARTERLY BASIS , AN 18 
OWNER OR OPERATOR OF A REFUSE DISPOSAL SY STEM SHALL COMPLETE AND 19 
SUBMIT, UNDER OATH , A RETURN AND PAY THE SOLID WASTE DISP OSAL SURCHARGE 20 
TO THE COMPTROLLER . 21 
 
 (II) A RETURN SUBMITTED UND ER SUBPARAGRAPH (I) OF THIS 22 
PARAGRAPH SHALL INCLUDE INFORMATION ON THE NUMBER OF TONS OF SO LID 23 
WASTE ACCEPTED FOR DISPOSAL, TRANSFER, OR COLLECTION , AS APPROPRIATE , 24 
DURING THE REPORTING PERIOD . 25 
 
 (E) THE COMPTROLLER MAY ADOPT REGULATIONS TO CARRY OUT THIS 26 
SECTION. 27

SUBJECT TO § 7–302 OF THE STATE FINANCE AND PROCUREMENT ARTICLE. 12

PREVENT ILLEGAL DUMP ING IN THE STATE;  28

THE LOCAL COMMUNITY , INCLUDING JOBS CREATED FOR THE COMMUNITY , JOB 12 
TRAINING, OR SUPPORT FOR HIRING A ND LEADERSHIP DEVELOPMENT PRACTICE S 13 
THAT ARE INCLUSIVE A ND PROVIDE LIVING WA GES; AND 14 
 
 (7) THAT CLEAN UP DEBRIS IN AREAS A FFECTED BY ILLEGAL 15 
DUMPING AND INCORPORATE COMP ONENTS OF WASTE PREVENTION AND REUSE, 16

 (a) (2) (i) Notwithstanding any other provision of law, and unless 8 
inconsistent with a federal law, grant agreement, or other federal requirement or with the 9 
terms of a gift or settlement agreement, net interest on all State money allocated by the 10 
State Treasurer under this section to special funds or accounts, and otherwise entitled to 11 
receive interest earnings, as accounted for by the Comptroller, shall accrue to the General 12 
Fund of the State. 13 
 
 (ii) The provisions of subparagraph (i) of this paragraph do not apply 14 
to the following funds: 15 
 
 144. the Health Equity Resource Community Reserve Fund; 16 
[and] 17 
 
 145. the Access to Counsel in Evictions Special Fund; 18
