AN ACT concerning 1 
 
Public Health – Sickle Cell Disease – Testing at a Community–Based Health Fair 2 
 
FOR the purpose of requiring the Maryland Department of Health to authorize certain 3 
persons to offer and perform testing for detecting sickle cell disease at a  4 
community–based health fair; authorizing the person to provide information on and 5 
resources for living with sickle cell disease while performing testing at a  6 
community–based health fair; and generally relating to testing for sickle cell disease. 7

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 13 
That the Laws of Maryland read as follows: 14 
 
Article – Health – General 15

 (A) IN THIS SECTION, “COMMUNITY –BASED HEALTH FAIR” MEANS AN EVENT 17 
THAT OFFERS HEALTH C ARE SERVICES TO AN I NDIVIDUAL FOR FREE OR USING A 18 
SLIDING FEE SCALE TH AT IS SPONSORED BY : 19 
 
 (1) THE FEDERAL GOVERNMENT , THE STATE, OR A LOCAL 20 
GOVERNMENT ;  21 
 
 (2) A NONPROFIT ORGANIZATI ON THAT IS EXEMPT FR OM TAXATION 22 
UNDER § 501(C)(3) OF THE INTERNAL REVENUE CODE; OR 23  2 	HOUSE BILL 1170  
 
 
 
 (3) A NONPROFIT COMMUNITY ORGANIZATION THAT HA S THE STATED 1 
PURPOSE OF PROVIDING HEALTH SERVIC ES TO LOW–INCOME INDIVIDUALS .  2 
 
 (B) THE DEPARTMENT SHALL AUTHORIZE A PERSON WHO IS QUALIFIED TO 3 
OFFER OR PERFORM LAB ORATORY TESTING IN THE STATE, AS DETERMINED BY THE 4 
DEPARTMENT , TO OFFER AND PERFORM LABORATORY TESTING FOR DETECTING 5 
SICKLE CELL DISEASE AT A COMMUNITY –BASED HEALTH FAIR IN THE STATE. 6 
 
 (C) A PERSON WHO IS AUTHORIZED TO PERFORM TESTING UNDER 7 
SUBSECTION (B) OF THIS SECTION MAY PROVIDE INFORMATION ON AND RESOURCES 8 
FOR LIVING WITH SICK LE CELL DISEASE WHILE PERFORMING TESTING AT A 9 
COMMUNITY –BASED HEALTH FAIR . 10 
 
 (D) THE DEPARTMENT SHALL ADOP T REGULATIONS TO CARRY OUT THIS 11 
SECTION.  12 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 13 
October 1, 2022. 14
