Young Introduced and read first time: February 11, 2022 Assigned to: Appropriations and Health and Government Operations A BILL ENTITLED AN ACT concerning 1 Funding for Wage Increases for Medical Provider Workers 2 FOR the purpose of requiring that, in certain fiscal years, certain funding provided in the 3 legislative appropriation to the Medical Care Programs Administration for medical 4 care provider reimbursements be used for wage increases for health care workers 5 and staff in nursing homes who provide direct care to residents; and generally 6 relating to funding for medical care provider reimbursements. 7 BY repealing and reenacting, with amendments, 8 Article – Health – General 9 Section 16–201.4(b) 10 Annotated Code of Maryland 11 (2019 Replacement Volume and 2021 Supplement) 12 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 13 That the Laws of Maryland read as follows: 14 Article – Health – General 15 16–201.4. 16 (b) (1) The Governor’s proposed budget for fiscal year 2021 shall include a 4% 17 rate increase for providers over the funding provided in the legislative appropriation for 18 the immediately preceding fiscal year in Program M00Q01.03 Medical Care Provider 19 Reimbursements – Medical Care Programs Administration and Program M00Q01.07 20 Maryland Children’s Health Program – Medical Care Programs Administration. 21 (2) The Governor’s proposed budget for fiscal year 2022 shall include a 4% 22 rate increase for providers over the funding provided in the legislative appropriation for 23 the immediately preceding fiscal year in Program M00Q01.03 Medical Care Provider 24 Reimbursements – Medical Care Programs Administration and Program M00Q01.07 25 2 HOUSE BILL 1350 Maryland Children’s Health Program – Medical Care Programs Administration. 1 (3) The Governor’s proposed budget for fiscal year 2023 shall include a 4% 2 rate increase for providers over the funding provided in the legislative appropriation for 3 the immediately preceding fiscal year in Program M00Q01.03 Medical Care Provider 4 Reimbursements – Medical Care Programs Administration and Program M00Q01.07 5 Maryland Children’s Health Program – Medical Care Programs Administration. 6 (4) The Governor’s proposed budget for fiscal year 2024 shall include a 4% 7 rate increase for providers over the funding provided in the legislative appropriation for 8 the immediately preceding fiscal year in Program M00Q01.03 Medical Care Provider 9 Reimbursements – Medical Care Programs Administration and Program M00Q01.07 10 Maryland Children’s Health Program – Medical Care Programs Administration. 11 (5) The Governor’s proposed budget for fiscal year 2025 shall include a 4% 12 rate increase for providers over the funding provided in the legislative appropriation for 13 the immediately preceding fiscal year in Program M00Q01.03 Medical Care Provider 14 Reimbursements – Medical Care Programs Administration and Program M00Q01.07 15 Maryland Children’s Health Program – Medical Care Programs Administration. 16 (6) The Governor’s proposed budget for fiscal year 2026 shall include a 4% 17 rate increase for providers over the funding provided in the legislative appropriation for 18 the immediately preceding fiscal year in Program M00Q01.03 Medical Care Provider 19 Reimbursements – Medical Care Programs Administration and Program M00Q01.07 20 Maryland Children’s Health Program – Medical Care Programs Administration. 21 (7) THE FUNDING PROVIDED IN THE LEGISLATIVE APPROPRIATIO N 22 FOR PROGRAM M00Q01.03 MEDICAL CARE PROVIDER REIMBUR SEMENTS 23 – MEDICAL CARE PROGRAMS ADMINISTRATION IN PAR AGRAPHS (3) THROUGH (6) 24 OF THIS SUBSECTION S HALL BE USED TO FUND WAGE INCREASES FOR : 25 (I) HEALTH CARE WORKERS ; AND 26 (II) STAFF IN NURSING HOME S WHO PROVIDE DIRECT CARE TO 27 RESIDENTS, INCLUDING HOUSEKEEPI NG, LAUNDRY, NUTRITIONAL, AND ACTIVITIES 28 SERVICES. 29 (8) The Governor’s proposed budget for fiscal year [2021] 2024 and each 30 fiscal year thereafter shall be presented in the same manner, including object and program 31 information, as in the fiscal year [2020] 2023 budget. 32 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 33 October 1, 2022. 34
