39	39	SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 19

46	46	(a) (1) In this section the following words have the meanings indicated. 23

50	50	(8) “Speed monitoring system” means a device with one or more motor 1
51	51	vehicle sensors producing recorded images of motor vehicles traveling at speeds at least 12 2
52	52	miles per hour above the posted speed limit. 3

54	54	(b) (1) (i) A speed monitoring system may not be used in a local jurisdiction 4
55	55	under this section unless its use is authorized by the governing body of the local jurisdiction 5
56	56	by local law enacted after reasonable notice and a public hearing. 6

58	58	(vi) This section applies to a violation of this subtitle recorded by a 7
59	59	speed monitoring system that meets the requirements of this subsection and has been 8
60	60	placed: 9

62	62	1. In Montgomery County or Prince George’s County, on a 10
63	63	highway in a residential district, as defined in § 21–101 of this title, with a maximum posted 11
64	64	speed limit of 35 miles per hour, which speed limit was established using generally accepted 12
65	65	traffic engineering practices; 13

67	67	2. In a school zone with a posted speed limit of at least 20 14
68	68	miles per hour; 15

70	70	3. In Prince George’s County: 16

72	72	A. Subject to subparagraph (vii)1 of this paragraph, on 17
73	73	Maryland Route 210 (Indian Head Highway); or 18

75	75	B. On that part of a highway located within the grounds of 19
76	76	an institution of higher education as defined in § 10–101(h) of the Education Article, or 20
77	77	within one–half mile of the grounds of a building or property used by the institution of 21
78	78	higher education where generally accepted traffic and engineering practices indicate that 22
79	79	motor vehicle, pedestrian, or bicycle traffic is substantially generated or influenced by the 23
80	80	institution of higher education; 24

82	82	4. Subject to subparagraph (vii)2 of this paragraph, on 25
83	83	Interstate 83 in Baltimore City; [or] 26

85	85	5. In Anne Arundel County, on Maryland Route 175 (Jessup 27
86	86	Road) between the Maryland Route 175/295 interchange and the Anne Arundel 28
87	87	County–Howard County line; OR 29

89	89	6. IN ANNE ARUNDEL COUNTY, ON MARYLAND ROUTE 30
90	90	648 (BALTIMORE–ANNAPOLIS BOULEVARD) AT THE INTE RSECTIONS WITH 31
91	91	CYPRESS CREEK ROAD AND BRANDYWINE AVENUE. 32

93	93	(viii) Before activating a speed monitoring system, the local 33
94	94	jurisdiction shall: 34

98	98	1. Publish notice of the location of the speed monitoring 1
99	99	system on its website and in a newspaper of general circulation in the jurisdiction; 2

101	101	2. Ensure that each sign that designates a school zone is 3
102	102	proximate to a sign that: 4

104	104	A. Indicates that speed monitoring systems are in use in the 5
105	105	school zone; and 6

107	107	B. Is in accordance with the manual for and the specifications 7
108	108	for a uniform system of traffic control devices adopted by the State Highway Administration 8
109	109	under § 25–104 of this article; 9

111	111	3. With regard to a speed monitoring system established on 10
112	112	Maryland Route 210 (Indian Head Highway) in Prince George’s County, based on proximity 11
113	113	to an institution of higher education under subparagraph (vi)3 of this paragraph, on 12
114	114	Interstate 83 in Baltimore City, [or] in Anne Arundel County on Maryland Route 175 13
115	115	(Jessup Road) between the Maryland Route 175/295 interchange and the Anne Arundel 14
116	116	County–Howard County line, OR IN ANNE ARUNDEL COUNTY ON MARYLAND ROUTE 15
117	117	648 (BALTIMORE–ANNAPOLIS BOULEVARD) AT THE INTERSECTIONS WITH 16
118	118	CYPRESS CREEK ROAD AND BRANDYWINE AVENUE, ensure that all speed limit signs 17
119	119	approaching and within the segment of highway on which the speed monitoring system is 18
120	120	located include signs that: 19

122	122	A. Are in accordance with the manual and specifications for 20
123	123	a uniform system of traffic control devices adopted by the State Highway Administration 21
124	124	under § 25–104 of this article; and 22

126	126	B. Indicate that a speed monitoring system is in use; and 23

128	128	4. With regard to a speed monitoring system placed on 24
129	129	Maryland Route 210 (Indian Head Highway) in Prince George’s County, Interstate 83 in 25
130	130	Baltimore City, [or] in Anne Arundel County on Maryland Route 175 (Jessup Road) 26
131	131	between the Maryland Route 175/295 interchange and the Anne Arundel–Howard County 27
132	132	line, OR IN ANNE ARUNDEL COUNTY ON MARYLAND ROUTE 648 28
133	133	(BALTIMORE–ANNAPOLIS BOULEVARD) AT THE INTERSECTIONS WITH CYPRESS 29
134	134	CREEK ROAD AND BRANDYWINE AVENUE, ensure that each sign that indicates that a 30
135	135	speed monitoring system is in use is proximate to a device that displays a real–time posting 31
136	136	of the speed at which a driver is traveling. 32

138	138	(c) (1) Unless the driver of the motor vehicle received a citation from a police 33
139	139	officer at the time of the violation, the owner or, in accordance with subsection (f)(4) of this 34
140	140	section, the driver of a motor vehicle is subject to a civil penalty if the motor vehicle is 35
141	141	recorded by a speed monitoring system while being operated in violation of this subtitle. 36
