[Brackets] indicate matter deleted from existing law. *hb1408* HOUSE BILL 1408 E2 2lr3016 CF SB 758 By: Delegate Bridges Introduced and read first time: February 17, 2022 Assigned to: Rules and Executive Nominations A BILL ENTITLED AN ACT concerning 1 Criminal Procedure – Live Video Streaming of Public Proceedings 2 FOR the purpose of requiring the court to make available to the public live video streaming 3 of all public proceedings for criminal cases involving a crime of violence; prohibiting 4 a certain live video streaming from depicting a jury; and generally relating to live 5 video streaming of certain court proceedings. 6 BY repealing and reenacting, with amendments, 7 Article – Criminal Procedure 8 Section 1–201 9 Annotated Code of Maryland 10 (2018 Replacement Volume and 2021 Supplement) 11 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12 That the Laws of Maryland read as follows: 13 Article – Criminal Procedure 14 1–201. 15 (a) (1) Except as provided in [subsection] SUBSECTIONS (b) AND (C) of this 16 section, a person may not record or broadcast any criminal matter, including a trial, 17 hearing, motion, or argument, that is held in trial court or before a grand jury. 18 (2) This prohibition applies to the use of television, radio, and photographic 19 or recording equipment. 20 (b) Subsection (a) of this section does not apply to the use of electronic or 21 photographic equipment approved by the court: 22 2 HOUSE BILL 1408 (1) to take the testimony of a child victim under § 11–303 of this article; 1 [or] 2 (2) to perpetuate a court record; OR 3 (3) TO STREAM LIVE VIDEO IN ACCORDANCE WITH S UBSECTION (C) OF 4 THIS SECTION. 5 (c) (1) THE COURT SHALL MAKE AVAILABLE TO THE PUB LIC LIVE VIDEO 6 STREAMING OF ALL PUB LIC PROCEEDINGS FOR CRIMINAL CASES INVOL VING A 7 CRIME OF VIOLENCE UN DER § 14–101 OF THE CRIMINAL LAW ARTICLE. 8 (2) A JURY MAY NOT BE VISI BLE IN A LIVE VIDEO STREAMING UNDER 9 THIS SUBSECTION . 10 (D) A person who violates this section may be held in contempt of court. 11 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 12 October 1, 2022. 13
