AN ACT concerning 1 
 
Wetlands and Waterways – Riparian Rights – Voluntary Registry and Notice 2 
 
FOR the purpose of requiring the Department of the Environment to establish and 3 
maintain a voluntary registry on the Department’s website for property owners who 4 
have registered a claim of riparian rights with the Department; requiring the 5 
Governor to appropriate funds to the Department to cover the cost of establishing 6 
and maintaining the registry; requiring the holder of a covenant for riparian rights 7 
to be provided notice of a certain proposed project at a certain time; and generally 8 
relating to riparian rights.  9

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15 
That the Laws of Maryland read as follows: 16

 (A) (1) THE DEPARTMENT SHALL ESTA BLISH AND MAINTAIN A PUBLICLY 19 
ACCESSIBLE VOLUNTARY REGISTRY ON THE DEPARTMENT ’S WEBSITE OF PROPERT Y 20 
OWNERS WHO HAVE REGI STERED A CLAIM OF RI PARIAN RIGHTS WITH T HE 21 
DEPARTMENT . 22 
  
 (2) THE DEPARTMENT SHALL DETE RMINE THE INFORMATIO N THAT A 23  2 	HOUSE BILL 149  
 
 
PROPERTY OWNER IS RE QUIRED TO SUBMIT TO BE INCLUDED IN THE R EGISTRY 1 
UNDER PARAGRAPH (1) OF THIS SUBSECTION . 2 
 
 (3) THE GOVERNOR SHALL APPROP RIATE FUNDS TO THE 3 
DEPARTMENT TO COVER T HE COST OF ESTABLISH ING AND MAINTAINING TH E 4 
REGISTRY. 5 
 
 (B) THE HOLDER OF A COVEN ANT FOR RIPARIAN RIG HTS, INCLUDING A 6 
COMMUNITY ASSOCIATIO N, SHALL BE PROVIDED NO TICE OF A PROPOSED P ROJECT 7 
IN THE IMMEDIATE ARE A OF THE PROPERTY SU BJECT TO THE COVENAN T AT THE 8 
BEGINNING OF THE STATE OR LOCAL PERMITTIN G OR OTHER APPROVAL PROCESS 9 
FOR THE PROPOSED PRO JECT. 10 
  
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 11 
October 1, 2022. 12
