BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 1 That the Laws of Maryland read as follows: 2 Article – Education 3 3–108.1. 4 (c) There is a Baltimore City Board of School Commissioners of the Baltimore 5 City Public School System. 6 (d) (1) The board consists of: 7 (i) Except as provided in paragraph (2) of this subsection, nine 8 voting members appointed by the Mayor from a list of qualified individuals submitted to 9 the Mayor by the panel; 10 (ii) Two elected voting members; and 11 (iii) One voting student member [appointed] ELECTED as provided 12 in subsection (m) of this section. 13 (2) If the Mayor elects not to appoint a member from a list submitted by 14 the panel under paragraph (1)(i) of this subsection, the Mayor shall reconvene the panel to 15 submit additional names of qualified candidates. 16 (m) (1) The student member shall be a student enrolled in the Baltimore City 17 Public School System who shall be [selected by the Associated Student Congress of 18 Baltimore City] ELECTED BY THE HIGH SCHOOL STUDENTS OF BALTIMORE CITY IN 19 ACCORDANCE WITH PROC EDURES ESTABLISHED B Y THE BOARD. 20 (2) The term of a student member is 1 year. 21 (3) A student member may not serve more than two consecutive full terms. 22 (4) [The] SUBJECT TO PARAGRAPH (6) OF THIS SUBSECTION , THE 23 student member may vote on all matters before the board except those relating to[: 24 (i) Personnel; 25 (ii) Capital and operating budgets; 26 (iii) School closings, reopenings, and boundaries; 27 (iv) Collective bargaining decisions; 28 (v) Student disciplinary matters; and 29 HOUSE BILL 797 3 (vi) Appeals to the board as provided under §§ 4–205 and 6–202 of 1 this article] § 6–202(A) OF THIS ARTICLE . 2 (5) [The] UNLESS INVITED TO ATT END BY THE AFFIRMATIVE VOTE OF 3 A MAJORITY OF THE CO UNTY BOARD, THE student member may not attend or participate 4 in an executive or special session of the board THAT RELATES TO HEARINGS HELD 5 UNDER § 6–202(A) OF THIS ARTICLE . 6 (6) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE BOARD 7 MAY DETERMINE , ON A CASE –BY–CASE BASIS, WHETHER A MATTER UND ER 8 CONSIDERATION IS COV ERED BY THE EXCLUSIO NARY PROVISION IN PA RAGRAPH (4) 9 OF THIS SUBSECTION . 10 (7) EXCEPT AS PROVIDED IN PARAGRAPHS (4), (5), AND (6) OF THIS 11 SUBSECTION, THE STUDENT MEMBER H AS THE SAME RIGHTS A ND PRIVILEGES AS AN 12 ELECTED OR APPOINTED MEMBER. 13 3–201. 14 (a) (1) In this subtitle, “elected member” means a voting member elected under 15 subsection (d) or (e) of this section or a member appointed to an elected position on the 16 county board under subsection (e)(3) of this section. 17 (2) “Elected member” does not include the [nonvoting] student member 18 selected under subsection (f) of this section. 19 (b) The Allegany County Board consists of: 20 (1) Five elected members; and 21 (2) One [nonvoting] student member, who is to advise the other members 22 of the county board on the viewpoint of students who attend Allegany County public schools. 23 (f) (1) The [nonvoting] student member of the county board shall be: 24 (i) A twelfth grade student, in good standing, and regularly enrolled 25 in an Allegany County public school; 26 (ii) A resident of Allegany County for at least 2 years; and 27 (iii) Of good character. 28 (2) The [nonvoting] student member shall be nominated and elected for a 29 1–year term during the school year prior to the school year that the member is to serve on 30 4 HOUSE BILL 797 the county board in accordance with procedures adopted by the Allegany County 1 Association of Student Councils. 2 (3) If a vacancy occurs in the student member’s position before the end of 3 the term, a qualified student shall be selected for the remainder of the term in accordance 4 with procedures of the Allegany County Association of Student Councils. 5 (4) EXCEPT AS PROVIDED IN PARAGRAPHS (5), (6), AND (7) OF THIS 6 SUBSECTION, THE STUDENT MEMBER H AS THE SAME RIGHTS A ND PRIVILEGES AS AN 7 ELECTED MEMBER . 8 (5) UNLESS INVITED TO ATT END BY THE AFFIRMATI VE VOTE OF A 9 MAJORITY OF THE COUN TY BOARD, THE STUDENT MEMBER M AY NOT ATTEND AN 10 EXECUTIVE SESSION TH AT RELATES TO HEARIN GS HELD UNDER § 6–202(A) OF THIS 11 ARTICLE. 12 (6) SUBJECT TO PARAGRAPH (7) OF THIS SUBSECTION , THE STUDENT 13 MEMBER SHALL VOTE ON ALL MATTERS EXCEPT THOSE RELATING TO § 6–202(A) OF 14 THIS ARTICLE. 15 (7) ON A MAJORITY VOTE OF THE ELECTED MEMBERS, THE COUNTY 16 BOARD MAY DETERMINE , ON A CASE–BY–CASE BASIS, WHETHER A MATTER UND ER 17 CONSIDERATION IS COV ERED BY THE EXCLUSIO NARY PROVISION IN PA RAGRAPH (6) 18 OF THIS SUBSECTION. 19 3–204. 20 (a) All actions of the county board shall be taken at a public meeting and a record 21 of the meeting and all actions shall be made public. 22 (b) This section does not prohibit the county board from meeting and deliberating 23 in executive session, provided that any action of the board, together with the individual 24 vote of each member, is contained in a public record. 25 (c) [A nonvoting] EXCEPT FOR EXECUTIVE SESSIONS RELATED TO 26 HEARINGS UNDER § 6–202(A) OF THIS ARTICLE, THE student member may [not] attend 27 executive sessions of the county board. 28 3–2A–01. 29 (a) The Anne Arundel County Board of Education consists of: 30 (1) Seven nonpartisan elected members; and 31 (2) One student member. 32 HOUSE BILL 797 5 3–2A–06. 1 (A) The affirmative vote of at least five members of the county board is required 2 for the approval of any action. 3 (B) THE STUDENT MEMBER HAS T HE SAME RIGHTS AND P RIVILEGES AS AN 4 ELECTED MEMBER . 5 3–2B–01. 6 (a) The Baltimore County Board of Education consists of: 7 (1) Seven nonpartisan elected members; 8 (2) Four appointed members; and 9 (3) One student member. 10 3–2B–05. 11 (a) The student member shall: 12 (1) Be an 11th or a 12th grade student in the Baltimore County public 13 school system elected by the middle school and high school students of the county in 14 accordance with procedures established by the Baltimore County student councils; 15 (2) Serve for 1 year; and 16 (3) Advise the county board on the thoughts and feelings of students. 17 (b) Unless invited to attend by an affirmative vote of a majority of the county 18 board, the student member may not attend an executive session that relates to[: 19 (1) Hearings on appeals of special education placements; 20 (2) Hearings] HEARINGS held under § 6–202(a) of this article[; or 21 (3) Collective bargaining]. 22 (c) Subject to subsection (d) of this section, the student member may vote on all 23 matters except those relating to[: 24 (1)] § 6–202(a) of this article[; 25 (2) Collective bargaining; 26 6 HOUSE BILL 797 (3) Capital and operating budgets; and 1 (4) School closings, reopenings, and boundaries]. 2 (d) On a majority vote of the nonstudent members, the county board may 3 determine, on a case–by–case basis, whether a matter under consideration is covered by 4 the exclusionary [provisions listed] PROVISION in subsection (c) of this section. 5 (E) EXCEPT AS PROVIDED IN SUBSECTION S (B), (C), AND (D) OF THIS 6 SECTION, THE STUDENT MEMBER H AS THE SAME RIGHTS A ND PRIVILEGES AS AN 7 ELECTED OR APPOINTED MEMBER. 8 3–301. 9 (a) The Calvert County Board consists of five voting members and one 10 [nonvoting] VOTING student member. 11 (h) (1) The student member shall: 12 (i) Be an eleventh or twelfth grade student in the Calvert County 13 public school system elected by the high school students of the county in accordance with 14 procedures established by the school system; 15 (ii) Serve for 1 year beginning on June 1; 16 (iii) Be a [nonvoting] VOTING member; and 17 (iv) Advise the board on the thoughts and feelings of the students. 18 (2) EXCEPT AS PROVIDED IN PARAGRAPHS (3), (4), AND (5) OF THIS 19 SUBSECTION, THE STUDENT MEMBER H AS THE SAME RIGHTS A ND PRIVILEGES AS AN 20 ELECTED MEMBER . 21 [(2)] (3) Unless invited to attend by an affirmative vote of a majority of 22 the county board, the student may not attend an executive session THAT RELATES TO 23 HEARINGS HELD UNDER § 6–202(A) OF THIS ARTICLE . 24 (4) SUBJECT TO PARAGRAPH (5) OF THIS SUBSECTION , THE STUDENT 25 MEMBER SHALL VOTE ON ALL MATTERS EXCEPT T HOSE RELATING TO § 6–202(A) OF 26 THIS ARTICLE. 27 (5) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE COUNTY 28 BOARD MAY DETERMINE , ON A CASE–BY–CASE BASIS, WHETHER A MATTER UND ER 29 HOUSE BILL 797 7 CONSIDERATION IS COV ERED BY THE EXCLUSIO NARY PROVISION IN PA RAGRAPH (4) 1 OF THIS SUBSECTION . 2 3–3A–01. 3 (a) In this subtitle the following words have the meanings indicated. 4 (d) (2) “Elected member” does not include the [nonvoting] student members 5 [selected] ELECTED under § 3–3A–02(f) of this subtitle. 6 3–3A–02. 7 (a) The Caroline County Board of Education consists of: 8 (1) Three elected members; 9 (2) Two appointed members; and 10 (3) Two [nonvoting] student members. 11 (f) (1) A student member of the county board shall: 12 (i) Be a regularly enrolled eleventh or twelfth grade student of good 13 character and in good standing in a Caroline County public high school during the student’s 14 term in office; 15 (ii) Be [selected] ELECTED in the student’s tenth or eleventh grade 16 in accordance with paragraph (3) of this subsection; and 17 (iii) 1. Serve for a term of 1 year; and 18 2. If the student is in the twelfth grade, continue to serve 19 after graduation and until a successor is [selected] ELECTED and qualifies. 20 (2) Each high school in the county shall be represented by a student 21 member of the county board. 22 (3) (i) [For nomination to the county board, the student body shall 23 submit to the principal of the high school a list of nominees that contains the names of 24 eligible students] THE NOMINATION AND EL ECTION PROCESS SHALL BE DETERMINED 25 BY THE COUNTY BOARD . 26 (ii) [The principal of the high school shall select the student member 27 from the list of nominees submitted to the principal under subparagraph (i) of this 28 paragraph] THE PROCESS ADOPTED UNDER SUBPARAGRAPH (I) OF THIS PARAGRAPH 29 8 HOUSE BILL 797 SHALL INCLUDE A METHOD TO FILL A V ACANCY OF THE STUDENT MEMBER IF A 1 VACANCY OCCURS DURIN G THE TERM OF THE ST UDENT MEMBER . 2 (4) [If a vacancy in the position of student member occurs during the term 3 of a student member, the principal of the high school represented on the county board shall 4 select another student member using the method set forth under paragraph (3) of this 5 subsection] EXCEPT AS PROVIDED IN PARAGRAPHS (5), (6), AND (7) OF THIS 6 SUBSECTION, THE STUDENT MEMBER H AS THE SAME RIGHTS A ND PRIVILEGES AS AN 7 ELECTED OR APPOINTED MEMBER. 8 (5) UNLESS INVITED TO ATT END BY THE AFFIRMATI VE VOTE OF A 9 MAJORITY OF THE COUN TY BOARD, THE STUDENT MEMBER M AY NOT ATTEND AN 10 EXECUTIVE SESSION TH AT RELATES TO HEARIN GS HELD UNDER § 6–202(A) OF THIS 11 ARTICLE. 12 (6) SUBJECT TO PARAGRAPH (7) OF THIS SUBSECTION , THE STUDENT 13 MEMBER SHALL VOTE ON ALL MATTERS EXCEPT T HOSE RELATING TO § 6–202(A) OF 14 THIS ARTICLE. 15 (7) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE COUNTY 16 BOARD MAY DETERMINE , ON A CASE–BY–CASE BASIS, WHETHER A MATTER UND ER 17 CONSIDERATION IS COV ERED BY THE EXCLUSIONARY PRO VISION IN PARAGRAPH (6) 18 OF THIS SUBSECTION . 19 3–401. 20 (a) The Carroll County Board consists of: 21 (1) Five voting members; 22 (2) Subject to subsection (f) of this section, one [nonvoting] VOTING 23 student [representative] MEMBER; and 24 (3) The County Commissioners, who are nonvoting ex officio members. 25 (f) (1) The student [representative] MEMBER shall: 26 (i) Be an eleventh or a twelfth grade student in the Carroll County 27 public school system elected by the high school students of the county in accordance with 28 procedures established by the school system; 29 (II) VOTE ON MATTERS BEFOR E THE BOARD; 30 [(ii)] (III) Be a student government association representative at the 31 student’s high school; 32 HOUSE BILL 797 9 [(iii)] (IV) Serve for 1 year beginning on July 1 after the election of 1 the student representative; 21 and 22 (2) One [nonvoting] VOTING student member. 23 (f) (1) The student member shall: 24 (i) Be an eleventh or twelfth grade student in the Cecil County 25 public school system elected by the high school students of the county in accordance with 26 procedures established by the school system; and 17 (ii) One student member. 18 (h) (1) The student member of the Charles County Board shall be an 11th or 19 12th grade student in the Charles County Public School System. 20 (2) The student member, and an alternate, shall be [selected by the 21 Charles County Association of Student Councils] ELECTED IN ACCORDANC E WITH 22 PROCEDURES ESTABLISH ED BY THE COUNTY BOA RD. 23 (3) The term of the student member shall be 1 year. 24 (4) (i) The student member shall be a voting member of the board. 25 (ii) [The] SUBJECT TO PARAGRAPH (6) OF THIS SUBSECTION , 26 THE student member may vote on all matters before the board except those relating to[: 27 1. and 24 (2) One [nonvoting] VOTING student member from each public high school 25 in the county. 26 (g) (1) Each student member shall: 27 (i) Be a twelfth grade student in the Dorchester County public 28 school system elected by the high school students of the public school that the student 29 attends, in accordance with procedures established by the school system; 25 (ii) Serve for 1 year beginning on July 1 after the election of the 26 member; 27 (iii) Be a [nonvoting] VOTING member; and 28 (iv) Advise the county board on the thoughts and feelings of students. 29 HOUSE BILL 797 13 (2) EXCEPT AS PROVIDED IN PARAGRAPHS (3), (4), AND (5) OF THIS 1 SUBSECTION, THE STUDENT MEMBER H AS THE SAME RIGHTS A ND PRIVILEGES AS A 2 VOTING MEMBER . 3 [(2)] (3) Unless invited to attend by an affirmative vote of a majority of 4 the county board, the student member may not attend an executive session THAT RELATES 5 TO HEARINGS HELD UND ER § 6–202(A) OF THIS ARTICLE . 6 (4) SUBJECT TO PARAGRAPH (5) OF THIS SUBSECTION , THE STUDENT 7 MEMBER SHALL VOTE ON ALL MATTERS EXCEPT T HOSE RELATING TO § 6–202(A) OF 8 THIS ARTICLE. 9 (5) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE COUNTY 10 BOARD MAY DETERMINE , ON A CASE–BY–CASE BASIS, WHETHER A MATTER UND ER 11 CONSIDERATION IS COV ERED BY THE EXCLUSIO NARY PROVISION IN PA RAGRAPH (4) 12 OF THIS SUBSECTION . 13 3–601. 14 (a) (1) In this subtitle, “elected member” means a member of the county board 15 elected under subsection (b)(1) or (2) of this section or appointed to fill a vacancy under 16 subsection (e)(3) of this section. 17 (2) “Elected member” does not include the student member [selected] 18 ELECTED under subsection (f) of this section. 19 (b) The Garrett County Board consists of: 20 (1) One elected member from each county commissioner district; 21 (2) Two elected members from the county at large; and 22 (3) One [nonvoting] student member. 23 (d) (2) The student member shall be [selected] ELECTED in accordance with 24 subsection (f) of this section. 25 (f) (1) [Each May, the elected members of the county board shall select a 26 student member, and an alternate to serve in the event of a vacancy in the student 27 member’s position, from among candidates recommended by the Garrett County 28 Association of Student Councils] THE STUDENT MEMBER AND AN ALTERNATE SHALL 29 BE ELECTED BY THE HIGH SCHOOL STUDENTS OF GARRETT COUNTY IN 30 ACCORDANCE WITH PROC EDURES ESTABLISHED B Y THE COUNTY BOARD. 31 (2) The term of the student member is 1 year and begins on July 1. 32 14 HOUSE BILL 797 (3) To be considered for the position of student member, or as the alternate 1 for the student member’s position, a student shall: 2 (i) Be a sophomore or junior in high school at the time of applying; 3 (ii) Have attended Garrett County public schools for at least 2 years; 4 (iii) Be in good academic standing and have maintained a grade 5 average of at least 80% during the previous 2 academic years; and 6 (iv) Not have experienced significant attendance or disciplinary 7 problems during the student’s high school career. 8 (4) [(i) The Garrett County Association of Student Councils shall 9 propose procedures governing the selection of candidates for the student member’s position. 10 (ii) The procedures proposed under this paragraph are subject to the 11 approval of the elected members of the board. 12 (iii) The procedures adopted under this paragraph shall provide for 13 the selection of up to four candidates, selected by the Garrett County Association of Student 14 Councils by secret ballot, for the position of student member. The names of the candidates 15 shall be forwarded to the elected members of the county board for final selection of the 16 student member and of an alternate. 17 (5)] The student member: 18 (i) Shall attend all regular meetings of the county board; 19 (ii) May attend special public meetings of the county board; 20 (iii) Shall attend all meetings of the Garrett County Association of 21 Student Councils; and 22 (iv) Shall continue to meet all the requirements for selection to the 23 student member position. 24 (5) EXCEPT AS PROVIDED IN PARAGRAPHS (6), (7), AND (8) OF THIS 25 SUBSECTION, THE STUDENT MEMBER H AS THE SAME RIGHTS A ND PRIVILEGES AS AN 26 ELECTED MEMBER . 27 (6) [The] UNLESS INVITED TO ATT END BY AN AFFIRMATIV E VOTE OF 28 A MAJORITY OF THE CO UNTY BOARD , THE student member may not attend executive 29 sessions of the county board THAT RELATE TO HEARI NGS HELD UNDER § 6–202(A) OF 30 THIS ARTICLE. 31 HOUSE BILL 797 15 (7) SUBJECT TO PARAGRAPH (8) OF THIS SUBSECTION , THE STUDENT 1 MEMBER SHALL VOTE ON ALL MATTERS EXCEPT T HOSE RELATING TO § 6–202(A) OF 2 THIS ARTICLE. 3 (8) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE COUNTY 4 BOARD MAY DETERMINE , ON A CASE–BY–CASE BASIS, WHETHER A MATTER UND ER 5 CONSIDERATION IS COV ERED BY THE EXCLUSIO NARY PROVISION IN PA RAGRAPH (7) 6 OF THIS SUBSECTION . 7 3–6A–01. 8 (a) (1) In this subtitle, “elected member” means a voting member elected under 9 subsection (d) or I of this section or a member appointed to an elected position on the 10 Harford County Board of Education under subsection (f)(1) of this section. 11 (2) “Elected member” does not include a: 12 (i) County superintendent of schools serving as an ex officio member 13 of the county board; or 14 (ii) Student member selected under subsection (g) of this section. 15 (b) The county board consists of: 16 (1) Six elected members; 17 (2) Three appointed members; 18 (3) The county superintendent of schools, who is an ex officio nonvoting 19 member; and 20 (4) One student member. 21 (g) (1) The student member of the county board shall be elected by the high 22 school students of the county in accordance with procedures established by the Harford 23 County public school system. 24 (2) The student member shall: 25 (i) Be an eleventh or twelfth grade student, in good standing, and 26 regularly enrolled in the Harford County public school system; 27 (ii) Be a student government association representative at the 28 student’s high school; 29 16 HOUSE BILL 797 (iii) Serve for 1 year beginning on July 1 after the election of the 1 member; 2 (iv) Except as otherwise provided in paragraph (3) of this subsection, 3 be a voting member; and 4 (v) Advise the county board on the thoughts and feelings of students 5 in the Harford County public schools. 6 (3) (i) Except as [otherwise] provided in [subparagraph (iii)] 7 SUBPARAGRAPHS (II) THROUGH (IV) of this paragraph, the student member of the 8 county board has the same rights and privileges as a member appointed or elected under 9 subsection (d) of this section. 10 (ii) Unless invited to attend by an affirmative vote of a majority of 11 the county board, the student member may not attend an executive session of the county 12 board [addressing a matter on which a student member is prohibited from voting on under 13 subparagraph (iii) of this paragraph] RELATING TO HEARINGS HELD UNDER § 6–202(A) 14 OF THIS ARTICLE . 15 (iii) [The] SUBJECT TO SUBPARAGRA PH (IV) OF THIS 16 PARAGRAPH , THE student member shall vote on and participate in all matters except 17 those relating to[: 18 1. Geographical attendance areas under § 4–109 of this 19 article; 20 2. Acquisition and disposition of real property and matters 21 pertaining to school construction under § 4–115 of this article; 22 3. Employment of architects under § 4–117 of this article; 23 4. Donations under § 4–118 of this article; 24 5. Condemnation under § 4–119 of this article; 25 6. Consolidation of schools and transportation of students 26 under § 4–120 of this article; 27 7. Appointment and salary of a county superintendent under 28 §§ 4–201 and 4–202 of this article; 29 8. Employee discipline and other appeals under § 4–205(c) of 30 this article; 31 9. Budgetary matters under Title 5 of this article; 32 HOUSE BILL 797 17 10. Appointment and promotion of staff under § 6–201 of this 1 article; 2 11. Discipline of certificated staff under § 6–202 of this article; 3 12. Collective bargaining for certificated employees under 4 Title 6, Subtitle 4 of this article; 5 13. Collective bargaining for noncertificated employees under 6 Title 6, Subtitle 5 of this article; 7 14. Student suspension and expulsion under § 7–305 of this 8 article; and 9 15. School calendar and curriculum] § 6–202(A) OF THIS 10 ARTICLE. 11 (IV) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE 12 COUNTY BOARD MAY DET ERMINE, ON A CASE–BY–CASE BASIS, WHETHER A MATTER 13 UNDER CONSIDERATION IS COVERED BY THE EX CLUSIONARY PROVISION IN 14 SUBPARAGRAPH (III) OF THIS PARAGRAPH . 15 3–701. 16 (a) (1) The Howard County Board consists of: 17 (i) Seven elected members; and 18 (ii) One student member. 19 (f) (1) The student member shall be a bona fide resident of Howard County 20 and a regularly enrolled junior or senior year student from a Howard County public high 21 school. 22 (2) The student member shall serve for a term of 1 year beginning on July 23 1 after the member’s election, subject to confirmation of the election results by the county 24 board. 25 (3) The nomination and election process for the student member: 26 (i) Shall be approved by the Howard County Board of Education; 27 (ii) Shall include a provision that provides for the replacement of one 28 or both of the final candidates if one or both of them are unable, ineligible, or disqualified 29 to proceed in the election; and 30 18 HOUSE BILL 797 (iii) Shall allow for any student in grades 6 through 11 enrolled in a 1 Howard County public school to vote directly for one of the two student member candidates. 2 (4) The student member candidate who receives the second highest 3 number of votes in the direct election: 4 (i) Shall become the alternate student member; and 5 (ii) Shall serve if the student member who is elected is unable, 6 ineligible, or disqualified to complete the student member’s term of office. 7 (5) Except as provided in paragraphs (6) [and], (7), AND (8) of this 8 subsection, the student member has the same rights and privileges as an elected member. 9 (6) Unless invited to attend by the affirmative vote of a majority of the 10 county board, the student member may not attend a closed session [addressing a matter on 11 which a student member is prohibited from voting under paragraph (7) of this subsection] 12 RELATING TO HEARINGS HELD UNDER § 6–202(A) OF THIS ARTICLE . 13 (7) [The] SUBJECT TO PARAGRAPH (8) OF THIS SUBSECTION , THE 14 student member shall vote on all matters except those relating to[: 15 (i) Geographical attendance areas under § 4–109 of this article; and 5 (xiv) Student suspension and expulsion under § 7–305 of this article] 6 § 6–202(A) OF THIS ARTICLE . 7 (8) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE COUNTY 8 BOARD MAY DETE RMINE, ON A CASE–BY–CASE BASIS, WHETHER A MATTER UND ER 9 CONSIDERATION IS COV ERED BY THE EXCLUSIO NARY PROVISION IN PA RAGRAPH (7) 10 OF THIS SUBSECTION . 11 [(8)] (9) The student member may not receive compensation but, after 12 submitting expense vouchers, shall be reimbursed for out–of–pocket expenses incurred in 13 connection with official duties, in accordance with the procedures and regulations 14 established by the county board. 15 3–801. 16 (a) The Kent County Board consists of [five]: 17 (1) FIVE ELECTED members; AND 18 (2) ONE STUDENT MEMBER . 19 (F) (1) THE STUDENT MEMBER OF THE COUNTY BOARD SHA LL BE 20 ELECTED BY THE HIGH SCHOOL STUDENTS OF T HE COUNTY IN ACCORDA NCE WITH 21 PROCEDURES ESTABLISH ED BY THE COUNTY BOARD . 22 (2) THE STUDENT MEMBER SH ALL: 23 (I) BE AN ELEVENTH OR TWELFTH GRADE STU DENT, IN GOOD 24 STANDING, AND REGULARLY ENROLL ED IN THE KENT COUNTY PUBLIC SCHOOL 25 SYSTEM; 26 (II) SERVE FOR 1 YEAR BEGINNING JULY 1 AFTER THE 27 ELECTION OF THE MEMB ER; 28 (III) EXCEPT AS OTHERWISE P ROVIDED IN PARAGRAPH (3) OF 29 THIS SUBSECTION, BE A VOTING MEMBER ; AND 30 20 HOUSE BILL 797 (IV) ADVISE THE COUNTY BOA RD ON THE THOUGHTS A ND 1 FEELINGS OF STUDENTS IN THE KENT COUNTY PUBLIC SCHOOLS . 2 (3) (I) EXCEPT AS PROVIDED IN SUBPARAGRAPH S (II) THROUGH 3 (IV) OF THIS PARAGRAPH , THE STUDENT MEMBER O F THE COUNTY BOARD HAS THE 4 SAME RIGHTS AND PRIV ILEGES AS AN ELECTED MEMBER. 5 (II) UNLESS INVITED TO ATT END BY AN AFFIRMATIV E VOTE OF 6 A MAJORITY OF THE CO UNTY BOARD, THE STUDENT MEMBER M AY NOT ATTEND AN 7 EXECUTIVE SESSION OF THE COUNTY BOARD REL ATING TO HEARINGS HELD UNDER 8 § 6–202(A) OF THIS ARTICLE. 9 (III) SUBJECT TO SUBPARAGRA PH (IV) OF THIS PARAGRAPH , 10 THE STUDENT MEMBER SHALL VOTE ON AND PARTICIP ATE IN ALL MATTERS E XCEPT 11 THOSE RELATING TO § 6–202(A) OF THIS ARTICLE. 12 (IV) ON A MAJORITY VOTE OF THE ELECTE D MEMBERS , THE 13 COUNTY BOARD MAY DET ERMINE, ON A CASE–BY–CASE BASIS, WHETHER A MATTER 14 UNDER CONSIDERATION IS COVERED BY THE EX CLUSIONARY PROVISION IN 15 SUBPARAGRAPH (III) OF THIS PARAGRAPH . 16 3–803. 17 (a) The chairman of the county board is entitled to receive $2,400 annually as 18 compensation and the other ELECTED members are entitled to receive $2,000 each 19 annually as compensation. 20 (b) The chairman and the other ELECTED members are entitled to the allowances 21 for travel and other expenses provided in the Kent County budget. 22 3–1002. 23 (b) The Prince George’s County Board consists of 14 members as follows: 24 (1) Nine elected members, each of whom resides in a different school board 25 district; 26 (2) Four appointed members; and 27 (3) One student member selected under subsection (g)(2) of this section. 28 (g) (1) The student member shall be an eleventh or twelfth grade student in 29 the Prince George’s County public school system during the student’s term in office. 30 HOUSE BILL 797 21 (2) An eligible student shall file a nomination form at least 2 weeks before 1 a special election meeting of the Prince George’s Regional Association of Student 2 Governments. Nomination forms shall be made available in the administrative offices of all 3 public senior high schools in the county, the office of student concerns, and the office of the 4 president of the regional association. The delegates to the regional association annually 5 shall elect the student member to the board at a special election meeting to be held each 6 school year. 7 (3) [The] SUBJECT TO PARAGRAPH (4) OF THIS SUBSECTION , THE 8 student member may vote on all matters before the board except those relating to[: 9 (i) Capital and operating budgets; 10 (ii) School closings, reopenings, and boundaries; 11 (iii) Collective bargaining decisions; 12 (iv) Student disciplinary matters; 13 (v) Teacher and administrator disciplinary matters as provided 14 under § 6–202(a) of this article; and 15 (vi) Other personnel matters] § 6–202(A) OF THIS ARTICLE . 16 (4) On an affirmative vote of a majority of the elected and appointed 17 members of the county board, the board may determine if a matter before the board relates 18 to [a subject that the student member may not vote on under paragraph (3) of this 19 subsection] § 6–202(A) OF THIS ARTICLE . 20 (5) Unless invited to attend by an affirmative vote of a majority of the 21 elected and appointed members of the county board, the student member may not attend 22 an executive session that relates to [hearings on appeals of special education placements,] 23 hearings held under § 6–202(a) of this article[, or collective bargaining]. 24 (6) EXCEPT AS PROVIDED IN PARAGRAPHS (3), (4), AND (5) OF THIS 25 SUBSECTION, THE STUDENT MEMBER HAS T HE SAME RIGHTS AND P RIVILEGES AS AN 26 ELECTED OR APPOINTED MEMBER. 27 [(6)] (7) The Prince George’s Regional Association of Student 28 Governments may establish procedures for the election of the student member of the county 29 board. 30 [(7)] (8) The election procedures established by the Prince George’s 31 Regional Association of Student Governments are subject to the approval of the elected and 32 appointed members of the county board. 33 22 HOUSE BILL 797 3–10A–01. 1 (a) The Queen Anne’s County Board consists of: 2 (1) Five [voting,] nonpartisan, elected members; and 3 (2) One [nonvoting] student representative from each public high school in 4 the county. 5 (b) The five [voting,] nonpartisan, elected members shall be elected by the voters 6 of the entire county at a general election in accordance with subsection (c) of this section. 7 (c) (1) (i) One [voting] ELECTED member shall reside in and be elected 8 from each of the four county commissioner districts; and 9 (ii) One ELECTED member shall reside in the county and be elected 10 from the county at large. 11 (2) (i) [A] AN ELECTED member from a county commissioner district 12 who no longer resides in the district may not continue as a member of the county board. 13 (ii) A member at large who no longer resides in the county may not 14 continue as a member of the county board. 15 (3) A candidate elected to the county board shall be a registered voter and 16 resident of Queen Anne’s County for at least 3 years. 17 (d) (1) Subject to paragraph (2) of this subsection, each elected [voting] 18 member serves for a term of 4 years beginning on the first Monday in December after the 19 member’s election and until a successor is elected and qualifies. 20 (2) The initial terms of the elected [voting] members are staggered as 21 follows: 22 (i) The three members elected to the county board at the general 23 election in November 2008 who receive the highest number of votes cast from among the 24 successful candidates at that election shall serve for a term of 6 years; and 25 (ii) The two members elected to the county board at the general 26 election in November 2008 who receive the least number of votes cast from among the 27 successful candidates at that election shall serve for a term of 4 years. 28 (3) (i) In case of a vacancy on the county board, the Governor shall 29 appoint a qualified person to serve on the county board until a successor is elected and 30 qualifies. 31 HOUSE BILL 797 23 (ii) If the vacancy occurs before the filing deadline for candidates for 1 the primary election that is held in the second year of the term, the individual appointed 2 under subparagraph (i) of this paragraph shall serve until a successor is elected at the next 3 general election and qualifies. 4 (iii) If the vacancy occurs after the filing deadline for candidates for 5 the primary election that is held in the second year of the term, the individual appointed 6 under subparagraph (i) of this paragraph shall serve for the remainder of the term of the 7 vacating member and until a successor is elected at the next general election and qualifies. 8 (e) (1) The [nonvoting] student [members] REPRESENTATIVES of the county 9 board shall be elected from each of the public high schools in the county by their respective 10 student bodies. 11 (2) Each student [member] REPRESENTATIVE shall: 12 (i) Be an eleventh or twelfth grade student in good standing in the 13 Queen Anne’s County public school system; 14 (ii) Be a student government association representative at the 15 student’s high school; 16 (iii) Serve for 1 year beginning on July 1 after the election of the 17 member; 18 (iv) [Be nonvoting] VOTE ON MATTERS BEFOR E THE BOARD; and 19 (v) Advise the county board on the thoughts and feelings of students 20 in the Queen Anne’s County public schools. 21 (3) EXCEPT AS PROVIDED IN PARAGRAPH S (4), (5), AND (6) OF THIS 22 SUBSECTION, THE STUDENT REPRESENTATIVES HAVE THE SAME RIGHTS AND 23 PRIVILEGES AS AN ELECTED MEMBER. 24 [(3)] (4) Unless invited to attend by an affirmative vote of a majority of 25 the county board, the student [member] REPRESENTATIVES may not attend an executive 26 session of the county board RELATING TO HEARINGS HELD UNDER § 6–202(A) OF THIS 27 ARTICLE. 28 (5) SUBJECT TO PARAGRAPH (6) OF THIS SUBSECTION , THE STUDENT 29 REPRESENTATIVES SHALL VOTE ON AND PA RTICIPATE IN ALL MAT TERS EXCEPT 30 THOSE RELATING TO § 6–202(A) OF THIS ARTICLE. 31 (6) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE COUNTY 32 BOARD MAY DETER MINE, ON A CASE–BY–CASE BASIS, WHETHER A MATTER UND ER 33 24 HOUSE BILL 797 CONSIDERATION IS COV ERED BY THE EXCLUSIO NARY PROVISION IN PA RAGRAPH (5) 1 OF THIS SUBSECTION . 2 3–10A–04. 3 (a) The president of the county board is entitled to receive $4,000 annually as 4 compensation and the other [voting] ELECTED members each are entitled to receive $3,500 5 annually as compensation. 6 (b) The president of the county board and other ELECTED members each are 7 entitled to reimbursement not to exceed $1,000 a year for travel and other expenses. 8 (c) The Queen Anne’s County Commissioners may increase the annual salary of 9 the county board. 10 3–1101. 11 (a) The St. Mary’s Board consists of: 12 (1) Five [voting] ELECTED members; and 13 (2) One student member. 14 (b) (1) The student member shall: 15 [(1)] (I) Be an 11th or 12th grade student in the St. Mary’s County Public 16 School System; 17 [(2)] (II) Serve for 1 year; AND 18 [(3)] Be a nonvoting member; and 19 (4)] (III) Advise the county board on the thoughts and feelings of the 20 students. 21 (2) EXCEPT AS PROVIDED IN PARAGRAPHS (3), (4), AND (5) OF THIS 22 SUBSECTION, THE STUDENT MEMBER H AS THE SAME RIGHTS A ND PRIVILEGES AS AN 23 ELECTED MEMBER . 24 [(c)] (3) Unless invited to attend by an affirmative vote of a majority of the 25 county board, the student member may not attend an executive session of the county board 26 RELATING TO HEARINGS HELD UNDER § 6–202(A) OF THIS ARTICLE . 27 HOUSE BILL 797 25 (4) SUBJECT TO PARAGRAPH (5) OF THIS SUBSECTION , THE STUDENT 1 REPRESENTATIVES SHAL L VOTE ON AND PARTIC IPATE IN ALL MATTERS EXCEPT 2 THOSE RELATING TO § 6–202(A) OF THIS ARTICLE. 3 (5) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE COUNTY 4 BOARD MAY DETERMINE , ON A CASE–BY–CASE BASIS, WHETHER A MATTER UND ER 5 CONSIDERATION IS COV ERED BY THE EXCLUSIO NARY PROVISION IN PA RAGRAPH (4) 6 OF THIS SUBSECTION. 7 [(d)] (C) (1) (i) 1. A candidate elected to the county board shall be a 8 resident and registered voter of St. Mary’s County. 9 2. A member who is no longer a resident and a registered 10 voter of St. Mary’s County may not continue as a member of the county board. 11 (ii) A candidate who files to represent one of the commissioner 12 election districts must be a resident of that election district. 13 (iii) Candidates filing for office to represent the county at large may 14 reside anywhere in the county. 15 (2) An individual subject to the authority of the county board at the time 16 of filing is ineligible to be a candidate. 17 [(e)] (D) (1) The St. Mary’s County Board consists of five [voting] members 18 who shall be elected as follows: 19 (i) One member shall be elected from the county at large; and 20 (ii) One member shall be elected from each of the four commissioner 21 districts. 22 (2) [Voting] ELECTED members of the county board shall be elected: 23 (i) At a general election as required by this section; and 24 (ii) On a general countywide ticket. 25 (3) Members of the county board elected in the 1996 general election from 26 Commissioner Districts One and Three shall serve for an initial term of 2 years. An election 27 shall be conducted in 1998 and every 4 years thereafter. 28 (4) Members of the county board elected in the 1996 general election from 29 Commissioner Election Districts Two and Four and from the county at large shall serve for 30 an initial term of 4 years. An election shall be conducted in 2000 and every 4 years 31 thereafter. 32 26 HOUSE BILL 797 (5) Except as specified in this section, elections shall be conducted in 1 accordance with Title 8, Subtitle 8 of the Election Law Article. 2 [(f)] (E) (1) The student member of the county board shall be elected by 3 qualified students of the St. Mary’s County Public School System. The student member 4 shall not be subject to approval by the county board. 5 (2) The [voting] ELECTED members of the county board shall: 6 (i) Determine which students in the St. Mary’s County Public 7 School System may elect the student member of the county board; and 8 (ii) Develop nomination and election procedures governing the 9 election of the student member. 10 [(g)] (F) (1) Except as specified in this section, an elected member shall serve 11 for a term of 4 years. The term of each member shall commence on the first Monday in 12 December after the member’s election and shall continue until a successor is elected and 13 qualifies. 14 (2) The term of the student member shall commence on the first Monday 15 in July and continue for 1 year. 16 (3) If a vacancy occurs on the county board, the St. Mary’s Board of County 17 Commissioners shall appoint a qualified individual to serve for the remainder of that term 18 and until a successor is elected and qualifies. 19 [(h)] (G) (1) The State Board may remove a member of the county board for: 20 (i) Immorality; 21 (ii) Misconduct in office; 22 (iii) Incompetence; or 23 (iv) Willful neglect of duty. 24 (2) Before removing a member, the State Board shall send the member a 25 notice, by registered mail, return receipt requested, that specifies the charges against the 26 member. 27 (3) (i) Within 15 days from the date the State Board sends the notice, 28 the member may request a public hearing. The member shall send this request to the 29 county board by registered mail, return receipt requested. 30 HOUSE BILL 797 27 (ii) If the member requests a hearing, the State Board shall conduct 1 a hearing promptly, but not before the 11th day from the date the State Board sent notice 2 to the member. 3 (iii) The member shall have the right to a public hearing and to 4 representation by counsel at the hearing. 5 (4) A member removed under this subsection has the right to a de novo 6 review of the removal by the Circuit Court of St. Mary’s County. 7 3–1201. 8 (a) The Somerset County Board shall [be elected and consists] CONSIST of [one]: 9 (1) ONE member elected from each commissioner district in the county; 10 AND 11 (2) ONE STUDENT MEMBER . 12 (F) (1) THE STUDENT MEMBER OF THE COUNTY BOARD SHA LL BE 13 ELECTED BY THE HI GH SCHOOL STUDENTS O F THE COUNTY IN ACCO RDANCE WITH 14 PROCEDURES ESTABLISH ED BY THE COUNTY BOARD . 15 (2) THE STUDENT MEMBER SH ALL: 16 (I) BE AN ELEVENTH OR TWE LFTH GRADE STUDENT , IN GOOD 17 STANDING, AND REGULARLY ENROLL ED IN THE SOMERSET COUNTY PUBLIC 18 SCHOOL SYSTEM; 19 (II) SERVE FOR 1 YEAR BEGINNING JULY 1 AFTER THE 20 ELECTION OF THE MEMB ER; 21 (III) EXCEPT AS OTHERWISE P ROVIDED IN PARAGRAPH (3) OF 22 THIS SUBSECTION , BE A VOTING MEMBER ; AND 23 (IV) ADVISE THE COUNTY BOA RD ON THE THOUGHTS A ND 24 FEELINGS OF STUDEN TS IN THE SOMERSET COUNTY PUBLIC SCHOOLS . 25 (3) (I) EXCEPT AS PROVIDED IN SUBPARAGRAPH S (II) THROUGH 26 (IV) OF THIS PARAGRAPH , THE STUDENT MEMBER H AS THE SAME RIGHTS A ND 27 PRIVILEGES AS AN ELE CTED MEMBER . 28 (II) UNLESS INVITED TO ATT END BY AN AFFIRMATIV E VOTE OF 29 A MAJORITY OF THE CO UNTY BOARD, THE STUDENT MEMBER M AY NOT ATTEND AN 30 28 HOUSE BILL 797 EXECUTIVE SESSION OF THE COUNTY BOARD REL ATING TO HEARINGS HE LD UNDER 1 § 6–202(A) OF THIS ARTICLE. 2 (III) SUBJECT TO SUBPARAGRA PH (IV) OF THIS PARAGRAPH , 3 THE STUDENT MEMBER SHALL VOTE ON AND PARTICIP ATE IN ALL MATTERS E XCEPT 4 THOSE RELATING TO § 6–202(A) OF THIS ARTICLE. 5 (IV) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE 6 COUNTY BOARD MAY DET ERMINE, ON A CASE–BY–CASE BASIS, WHETHER A MATTER 7 UNDER CONSIDERATION IS COVERED BY THE EXCLUSIONARY PROVISI ON IN 8 SUBPARAGRAPH (III) OF THIS PARAGRAPH . 9 3–1202. 10 At its first meeting at the beginning of each year, the county board shall elect a 11 chairman from among its ELECTED members. 12 3–1203. 13 (a) Annual compensation for the board is as follows: 14 (1) Chairman – $3,000; and 15 (2) [Member] ELECTED MEMBER – $2,700. 16 (b) The chairman and other ELECTED members are entitled to: 17 (1) Reimbursement for expenses incurred in official duties performed 18 outside Somerset County; and 19 (2) $500 per member per year for expenses incurred in official duties 20 performed within Somerset County. 21 3–12A–01. 22 (a) The Talbot County Board consists of: 23 (1) Seven [voting] ELECTED members, one member elected from each of 24 the seven election districts for the county board established in accordance with this subtitle; 25 and 26 (2) Two [nonvoting] student members from the public high schools in the 27 county. 28 (e) (1) Each [voting] ELECTED member serves for a term of 4 years beginning 29 on December 1 after the member’s election and until a successor is elected and qualifies. 30 HOUSE BILL 797 29 (2) [A voting] AN ELECTED member may not serve for more than three 1 consecutive terms. 2 (f) The terms of the [voting] ELECTED members are staggered as follows: 3 (1) One member elected from each of districts 1, 3, 4, and 7 at the 2006 4 general election, and every 4 years thereafter; and 5 (2) One member elected from each of districts 2, 5, and 6 at the 2008 6 general election, and every 4 years thereafter. 7 (g) (1) The Governor shall appoint a new member to fill any vacancy on the 8 county board until a successor is elected and qualifies at the next congressional election. 9 (2) A resident of the district in which a vacancy exists may apply for 10 appointment by the Governor to fill the vacancy. 11 (h) The student members shall be [appointed] ELECTED and serve on the county 12 board in accordance with § 3–12A–06 of this subtitle. 13 3–12A–04. 14 (a) Subject to subsection (b) of this section, the [voting] ELECTED members shall 15 receive compensation as set by the County Council. 16 (b) (1) The salary of each [voting] ELECTED member of the county board shall 17 be at least $3,200. 18 (2) The salary of the president of the county board shall be at least $3,600. 19 3–12A–06. 20 (a) (1) There shall be two [nonvoting] student members on the Talbot County 21 Board of Education. 22 (2) The student members shall advise the other members of the county 23 board on the viewpoint of students who attend Talbot County public schools. 24 (b) (1) Each of the [nonvoting] student members of the county board shall be: 25 (i) A regularly enrolled 11th or 12th grade student in good standing 26 at a Talbot County public school; 27 (ii) Qualified according to eligibility requirements established by the 28 county board; and 29 30 HOUSE BILL 797 (iii) Of good character. 1 (2) Each student member shall be [appointed] ELECTED for a 1–year term 2 during the school year prior to the school year that the member is to serve on the county 3 board. 4 (3) One student member shall be a student from St. Michaels High School 5 and one student member shall be a student from Easton High School. 6 (4) The county board shall adopt procedures for the [appointment] 7 ELECTION of the student members. 8 (5) [If a vacancy in the position of student member occurs during the term 9 of a student member, the county board shall appoint another student member to fill the 10 vacancy in accordance with its procedures] THE PROCEDURES ADOPTE D UNDER 11 PARAGRAPH (4) OF THIS SUBSECTION SHALL INCLUDE A METHOD TO FILL A 12 VACANCY OF A STUDENT MEMBER IF A VACANCY OCCURS DURIN G THE TERM OF THE 13 STUDENT MEMBER . 14 (6) EXCEPT AS PROVIDED IN PARAGRAPHS (7), (8), AND (9) OF THIS 15 SUBSECTION, THE STUDENT MEMBER H AS THE SAME RIGHTS A ND PRIVILEGES AS AN 16 ELECTED MEMBER . 17 [(6)] (7) Unless invited to attend by an affirmative vote of a majority of 18 the county board, the student members may not attend an executive session of the county 19 board RELATING TO HEARINGS HELD UNDER § 6–202(A) OF THIS ARTICLE . 20 (8) SUBJECT TO PARAGRAPH (9) OF THIS SUBSECTION , THE STUDENT 21 MEMBER SHALL VOTE ON AND PARTICIPATE IN A LL MATTERS EXCEPT TH OSE 22 RELATING TO § 6–202(A) OF THIS ARTICLE. 23 (9) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE COUNTY 24 BOARD MAY DETERMINE , ON A CASE–BY–CASE BASIS, WHETHER A MATTER UND ER 25 CONSIDERATION IS COV ERED BY THE EXCLUSIO NARY PROVISION IN PA RAGRAPH (8) 26 OF THIS SUBSECTION . 27 3–1301. 28 (a) The Washington County Board consists of [seven]: 29 (1) SEVEN ELECTED members; AND 30 (2) ONE STUDENT MEMBER . 31 HOUSE BILL 797 31 (b) [All seven] THE ELECTED members of the Washington County Board shall 1 be elected from Washington County at large at a general election every 4 years beginning 2 in 1978. 3 (c) (1) Each ELECTED member serves for a term of 4 years beginning on the 4 first Tuesday in December after the member’s election and until a successor is elected and 5 qualifies. 6 (2) The terms of ELECTED members are staggered as required by the 7 terms of the members serving on the county board as of July 1, 1986. 8 (3) At the end of a term, [a] AN ELECTED member continues to serve until 9 a successor is elected and qualifies. 10 (4) In accordance with subsection (e) of this section, the County 11 Commissioners shall appoint a qualified individual to fill any vacancy on the county board 12 for the remainder of that term and until a successor is elected and qualifies. 13 (F) (1) THE STUDENT MEMBER OF THE COUNTY BOARD SHA LL BE 14 ELECTED BY THE HIGH SCHOOL STUDENTS OF T HE COUNTY IN ACCORDA NCE WITH 15 PROCEDURES ESTABLISH ED BY THE COUNTY BOA RD. 16 (2) THE STUDENT MEMBER SHALL : 17 (I) BE AN ELEVENTH OR TWE LFTH GRADE STUDENT , IN GOOD 18 STANDING, AND REGULARLY ENROLL ED IN THE WASHINGTON COUNTY PUBLIC 19 SCHOOL SYSTEM ; 20 (II) SERVE FOR 1 YEAR BEGINNING JULY 1 AFTER THE 21 ELECTION OF THE MEMB ER; 22 (III) EXCEPT AS OTHERWISE PROVIDED I N PARAGRAPH (3) OF 23 THIS SUBSECTION , BE A VOTING MEMBER ; AND 24 (IV) ADVISE THE COUNTY BOA RD ON THE THOUGHTS A ND 25 FEELINGS OF STUDENTS IN THE WASHINGTON COUNTY PUBLIC SCHOOLS . 26 (3) (I) EXCEPT AS PROVIDED IN SUBPARAGRAPH S (II) THROUGH 27 (IV) OF THIS PARAGRAPH , THE STUDENT MEMBER H AS THE SAME RIGHTS A ND 28 PRIVILEGES AS AN ELE CTED MEMBER . 29 (II) UNLESS INVITED TO ATT END BY AN AFFIRMATIV E VOTE OF 30 A MAJORITY OF THE CO UNTY BOARD, THE STUDENT MEMBER M AY NOT ATTEND AN 31 32 HOUSE BILL 797 EXECUTIVE SESSION OF THE COUNTY BOARD RELATING TO HEARINGS HELD UND ER 1 § 6–202(A) OF THIS ARTICLE. 2 (III) SUBJECT TO SUBPARAGRA PH (IV) OF THIS PARAGRAPH , 3 THE STUDENT MEMBER SHALL VOTE ON AND PARTICIP ATE IN ALL MATTERS E XCEPT 4 THOSE RELATING TO § 6–202(A) OF THIS ARTICLE. 5 (IV) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE 6 COUNTY BOARD MAY DET ERMINE, ON A CASE–BY–CASE BASIS, WHETHER A MATTER 7 UNDER CONSIDERATION IS COVERED BY THE EX CLUSIONARY PROVISION IN 8 SUBPARAGRAPH (III) OF THIS PARAGRAPH . 9 3–1302. 10 (a) (1) The president of the county board and the other ELECTED members are 11 entitled to receive compensation annually as set by the County Commissioners of 12 Washington County under Title 28, Subtitle 2 of the Local Government Article. 13 (2) Each ELECTED member of the Washington County Board of Education 14 is entitled to health insurance and to other fringe benefits regularly provided to employees 15 of the board of education. 16 (b) After submitting vouchers, ELECTED members shall be reimbursed for travel 17 and other expenses within the limit set by the Washington County Commissioners. 18 3–13A–01. 19 (a) (1) The Wicomico County Board consists of [seven]: 20 (I) SEVEN nonpartisan elected [voting] members; AND 21 (II) ONE STUDENT MEMBER . 22 (2) The seven ELECTED members shall be elected as follows: 23 (i) One member from each of the five councilmanic districts in the 24 county, elected by the voters of that district; and 25 (ii) Two members at large, elected by the voters of the county. 26 3–13A–02. 27 (a) The seven ELECTED members of the Wicomico County Board shall be elected: 28 HOUSE BILL 797 33 (1) At the general election in 2018 and at the general election every 4 years 1 thereafter; and 2 (2) In accordance with § 3–13A–01 of this subtitle and Title 8, Subtitle 8 3 of the Election Law Article. 4 (b) (1) The terms of the ELECTED members are as provided in this subsection. 5 (2) Each term of office begins on the first Monday in December after the 6 election of a member and until a successor is elected and qualifies. 7 (3) The term of office of each member is 4 years. 8 3–13A–03. 9 (a) (1) There is a Wicomico County School Board Nominating Commission. 10 (2) The purpose of the Commission is to select nominees to recommend to 11 the Wicomico County Council as qualified candidates for appointment to fill a vacancy OF 12 AN ELECTED MEMBER on the Wicomico County Board. 13 3–13A–04. 14 (a) Except as provided in subsection (b) of this section, the Wicomico County 15 Council shall appoint an individual to fill a vacancy OF AN ELECTED MEMBER on the 16 county board in accordance with § 3–13A–03 of this subtitle. 17 (b) (1) If a vacancy for [a] AN ELECTED member occurs before the date that is 18 30 days before the date for filing a certificate of candidacy for the primary election in the 19 presidential election year, the individual appointed under subsection (a) of this section shall 20 serve only until a successor is elected by the voters at the next general election. 21 (2) Candidates for the vacated office may be nominated at a primary 22 election in the same manner as for any other position on the county board. 23 3–13A–06. 24 At the first meeting of the county board in December of each year, the county board 25 shall elect a chair and vice chair from among the ELECTED members. 26 3–13A–07. 27 (A) THE STUDENT MEMBER OF THE COUNTY BOARD SHA LL BE ELECTED BY 28 THE HIGH SCHOOL STUDENTS OF THE COUNTY IN ACC ORDANCE WITH PROCEDU RES 29 ESTABLISHED BY THE C OUNTY BOARD . 30 34 HOUSE BILL 797 (B) THE STUDENT MEMBER SH ALL: 1 (1) BE AN ELEVENTH OR TWE LFTH GRADE STUDENT , IN GOOD 2 STANDING, AND REGULARLY ENROLL ED IN THE WICOMICO COUNTY PUBLIC 3 SCHOOL SYSTEM; 4 (2) SERVE FOR 1 YEAR BEGINNING JULY 1 AFTER THE ELECTION O F 5 THE MEMBER ; 6 (3) EXCEPT AS OTHERWISE P ROVIDED IN SUBSECTIO N (C)(3) OF THIS 7 SECTION, BE A VOTING MEMBER ; AND 8 (4) ADVISE THE COUNTY BOA RD ON THE THOUGHTS A ND FEELINGS 9 OF STUDENTS IN THE WICOMICO COUNTY PUBLIC SCHOOLS . 10 (C) (1) EXCEPT AS PROVIDED IN PARAGRAPHS (2) THROUGH (4) OF THIS 11 SUBSECTION, THE STUDENT MEMBER H AS THE SAME RIGHTS A ND PRIVILEGES AS AN 12 ELECTED MEMBER . 13 (2) UNLESS INVITED TO ATT END BY AN AFFIRMATIV E VOTE OF A 14 MAJORITY OF THE COUN TY BOARD, THE STUDENT MEMBER M AY NOT ATTEND AN 15 EXECUTIVE SESSION OF THE COUNTY BOARD REL ATING TO HEARINGS HE LD UNDER 16 § 6–202(A) OF THIS ARTICLE. 17 (3) SUBJECT TO PARAGRAPH (4) OF THIS SUBSECTION , THE STUDENT 18 MEMBER SHALL VOTE ON AND PARTICIPATE IN ALL MAT TERS EXCEPT THOSE 19 RELATING TO § 6–202(A) OF THIS ARTICLE. 20 (4) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE COUNTY 21 BOARD MAY DETERMINE , ON A CASE–BY–CASE BASIS, WHETHER A MATTER UND ER 22 CONSIDERATION IS COV ERED BY THE EXCLUSIO NARY PROVISION IN PARAGRAPH (3) 23 OF THIS SUBSECTION . 24 3–1401. 25 (a) The Worcester County Board consists of seven [voting] ELECTED members 26 and one [nonvoting] student member from each public high school in the county. 27 (b) (1) The seven [voting] ELECTED members of the Worcester County Board 28 shall be elected at a general election. 29 (2) Members of the Worcester County Board shall be elected in accordance 30 with Title 8, Subtitle 8 of the Election Law Article. 31 HOUSE BILL 797 35 (c) (1) A member from a county commissioner district shall be a resident of the 1 district. 2 (2) A member from a county commissioner district who no longer resides in 3 the district may not continue as a member of the county board. 4 (3) Notwithstanding § 3–114(g) of this title or any other law, a school bus 5 contractor is eligible to serve as a member of the county board. 6 (d) Of the seven [voting] ELECTED members of the county board, one shall be 7 elected from each of the seven county commissioner districts. 8 (e) A member serves for a term of 4 years beginning on the January 1 after the 9 member’s election and until a successor is elected and qualifies. 10 (f) (1) One member shall be elected from each of the county commissioner 11 districts 1, 4, 6, and 7 at the November 2002 general election. 12 (2) One member shall be elected from each of the county commissioner 13 districts 2, 3, and 5 at the November 2004 general election. 14 (g) (1) The county commissioners shall appoint a new member to fill any 15 vacancy on the county board for the remainder of that term and until a successor is elected 16 and qualifies. 17 (2) A resident of the district in which a vacancy exists may apply to the 18 county commissioners to fill the vacancy. 19 (3) The county commissioners shall adopt rules for the application 20 procedure to fill a vacancy on the county board. 21 (h) (1) Each student member shall: 22 (i) Be a 12th grade student in the Worcester County public school 23 system elected by the high school students of the public school which the student attends, 24 in accordance with procedures established by the school system; 25 (ii) Serve for 1 year beginning on July 1 after the election of the 26 member; 27 (iii) Be a [nonvoting] VOTING member; and 28 (iv) Advise the board on the interests of students. 29 (2) EXCEPT AS PROVIDED IN PARAGRAPH S (3), (4), AND (5) OF THIS 30 SUBSECTION, THE STUDENT MEMBER H AS THE SAME RIGHTS A ND PRIVILEGES AS A 31 VOTING MEMBER . 32 36 HOUSE BILL 797 [(2)] (3) Unless invited to attend by an affirmative vote of a majority of 1 the county board, the student members may not attend an executiv e session THAT 2 RELATES TO HEARINGS HELD UNDER § 6–202(A) OF THIS ARTICLE . 3 (4) SUBJECT TO PARAGRAPH (5) OF THIS SUBSECTION , THE STUDENT 4 MEMBER SHALL VOTE ON ALL MATTERS EXCEPT T HOSE RELATING TO § 6–202(A) OF 5 THIS ARTICLE. 6 (5) ON A MAJORITY VOTE OF THE ELECTED MEMBERS , THE COUNTY 7 BOARD MAY DETERMINE , ON A CASE–BY–CASE BASIS, WHETHER A MATTER UND ER 8 CONSIDERATION IS COV ERED BY THE EXCLUSIO NARY PROVISION IN PA RAGRAPH (4) 9 OF THIS SUBSECTION . 10 3–1403. 11 At its first meeting at the beginning of each calendar year, the county board shall 12 elect a president and a vice president from among its ELECTED members. 13 3–1404. 14 (a) Subject to subsection (b) of this section, the ELECTED members shall receive 15 compensation as set by the county commissioners. 16 (b) (1) The salary of each ELECTED member of the county board shall be at 17 least $3,200. 18 (2) The salary of the president of the county board shall be at least $3,600. 19 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect June 20 1, 2022. 21
