5252 (b) Subject to subsection (d) of this section, the Director shall use the Fund to pay: 1

6969 (c) The liability of the Board, Director, Fund, State Treasurer, and State for all 12
7070 proper charges against the Fund is limited to the assets of the Fund. 13

7272 (d) Beginning in fiscal year 2021, the Director may use the Fund to pay for the 14
7373 administration of the Fund only if an appropriation is included in the State budget for this 15
7474 purpose. 16

7676 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be construed to 17
7777 apply retroactively and shall be applied to and interpreted to affect any workers’ 18
7878 compensation claims filed before the effective date of this Act. 19

8080 SECTION 3. AND BE IT FURTHER ENACTED, That this Act is an emergency 20
8181 measure, is necessary for the immediate preservation of the public health or safety, has 21
8282 been passed by a yea and nay vote supported by three–fifths of all the members elected to 22
8383 each of the two Houses of the General Assembly, and shall take effect from the date it is 23
8484 enacted. 24
