[Brackets] indicate matter deleted from existing law. *sb0844* SENATE BILL 844 J1 2lr2577 By: Senator Carter Introduced and read first time: February 7, 2022 Assigned to: Finance A BILL ENTITLED AN ACT concerning 1 Medical Cannabis – Dispensaries – Operation at Multiple Locations 2 FOR the purpose of requiring an applicant for a medical cannabis dispensary license to 3 provide the number of locations the applicant intends to operate under the license 4 and the physical addresses of the locations; providing that a medical cannabis 5 dispensary license authorizes the licensee to operate up to a certain number of 6 locations under the license; requiring a dispensary licensee that operates at more 7 than one location to report certain information for each location and in aggregate; 8 and generally relating to medical cannabis dispensaries. 9 BY repealing and reenacting, without amendments, 10 Article – Health – General 11 Section 13–3301(a) and (f) and 13–3307(a)(1) 12 Annotated Code of Maryland 13 (2019 Replacement Volume and 2021 Supplement) 14 BY repealing and reenacting, with amendments, 15 Article – Health – General 16 Section 13–3307(b), (d), and (l) 17 Annotated Code of Maryland 18 (2019 Replacement Volume and 2021 Supplement) 19 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 20 That the Laws of Maryland read as follows: 21 Article – Health – General 22 13–3301. 23 (a) In this subtitle the following words have the meanings indicated. 24 2 SENATE BILL 844 (f) “Dispensary” means an entity licensed under this subtitle that acquires, 1 possesses, transfers, transports, sells, distributes, dispenses, or administers cannabis, 2 products containing cannabis, related supplies, related products containing cannabis 3 including edible cannabis products, tinctures, aerosols, oils, or ointments, or educational 4 materials for use by a qualifying patient or caregiver. 5 13–3307. 6 (a) (1) A dispensary shall be licensed by the Commission. 7 (b) To be licensed as a dispensary, an applicant shall submit to the Commission: 8 (1) An application fee in an amount to be determined by the Commission 9 consistent with this subtitle; and 10 (2) An application that includes: 11 (i) The legal name and physical address of the proposed dispensary; 12 (ii) The name, address, and date of birth of each principal officer and 13 each director, none of whom may have served as a principal officer or director for a 14 dispensary that has had its license revoked; [and] 15 (iii) Operating procedures that the dispensary will use, consistent 16 with Commission regulations for oversight, including storage of cannabis and products 17 containing cannabis only in enclosed and locked facilities; AND 18 (IV) SUBJECT TO SUBSECTION (D)(2) OF THIS SECTION , THE 19 NUMBER OF LOCATIONS AT WHICH THE APPLICANT INTENDS TO OPERATE AND THE 20 PHYSICAL ADDRESS OF EACH LOCATION . 21 (d) (1) The Commission shall allow a person to have an ownership interest in 22 or control of, including the power to manage and operate, up to four dispensaries under this 23 section. 24 (2) A DISPENSARY LICENSE I SSUED BY THE COMMISSION 25 AUTHORIZES THE HOLDER OF THE LI CENSE TO OPERATE AT UP TO FOUR 26 LOCATIONS, AS DESIGNATED IN THE APPLICATION UNDER SU BSECTION (B) OF THIS 27 SECTION. 28 (l) (1) Each dispensary licensed under this section shall submit to the 29 Commission a quarterly report. 30 (2) The quarterly report shall include: 31 (i) The number of patients served; 32 SENATE BILL 844 3 (ii) The county of residence of each patient served; 1 (iii) The medical condition for which medical cannabis was 2 recommended; 3 (iv) The type and amount of medical cannabis dispensed; and 4 (v) If available, a summary of clinical outcomes, including adverse 5 events and any cases of suspected diversion. 6 (3) The quarterly report may not include any personal information that 7 identifies a patient. 8 (4) A DISPENSARY LICENSEE THAT OPERATES AT MORE THAN ONE 9 LOCATION SHALL PROVI DE THE INFORMATION R EQUIRED UNDER PARAGR APH (2) 10 OF THIS SUBSECTION : 11 (I) FOR EACH LOCATION OPERAT ED UNDER THE LICENSE ; AND 12 (II) IN AGGREGATE FOR ALL LO CATIONS OPERATED UND ER THE 13 LICENSE. 14 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 15 October 1, 2022. 16
