21	21	FOR the purpose of altering the requirements for procurement policies of the University 4
22	22	System of Maryland, Morgan State University, St. Mary’s College of Maryland, and 5
23	23	Baltimore City Community College to authorize rather than require, to the 6
24	24	maximum extent practicable, the purchasing of supplies and services in accordance 7
25	25	with certain procurement preferences; and generally relating to procurement and 8

40	40	SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 20
41	41	That the Laws of Maryland read as follows: 21

52	52	(2) Except as otherwise provided in this subsection, this Division II does 1
53	53	not apply to the University System of Maryland, Morgan State University, St. Mary’s 2
54	54	College of Maryland, or Baltimore City Community College. 3

56	56	(4) The policies of a University or Baltimore City Community College 4

59	59	(i) [to the maximum extent practicable, require the purchasing of] 6
60	60	MAY AUTHORIZE THE PURCHASE OF supplies and services in accordance with Title 14, 7
61	61	Subtitle 1 of this article; 8

63	63	(ii) SHALL promote the purposes of the regulations adopted by the 9
64	64	Department of General Services governing the procurement of architectural and 10
65	65	engineering services; 11

67	67	(iii) SHALL promote the purposes of § 13–402 of the State Personnel 12
68	68	and Pensions Article; 13

70	70	(iv) to the maximum extent practicable, SHALL be similar to § 14
71	71	13–218.1 of this article; and 15

73	73	(v) to the maximum extent practicable, SHALL require the 16
74	74	procurement of food in accordance with Title 14, Subtitle 7 of this article. 17

76	76	(5) (i) Except as provided in paragraph (7) of this subsection, the 18
77	77	following provisions of Division II of this article apply to a University and to Baltimore City 19

108	108	policies adopted in accordance with this subsection, the procurement contract is void or 8
109	109	voidable in accordance with the provisions of § 11–204 of this subtitle. 9

111	111	SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 10
112	112	October 1, 2022. 11
