A BILL ENTITLED 
 
AN ACT concerning 1 
 
Correctional Services – Correctional Officers – Polygraph Testing 2 
 
FOR the purpose of authorizing, instead of requiring, the Secretary of Public Safety and 3 
Correctional Services to require an individual to pass a polygraph examination 4 
before being appointed to serve as a correctional officer in a correctional facility ; and 5 
generally relating to polygraph testing of correctional officers. 6 
 
BY repealing and reenacting, with amendments, 7 
 Article – Correctional Services 8 
Section 3–215(f) 9

 (2017 Replacement Volume and 2021 Supplement) 11 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12 
That the Laws of Maryland read as follows: 13 
 
Article – Correctional Services 14 
 
3–215. 15 
 
 (f) (1) The Secretary [shall] MAY require an individual to pass a polygraph 16 
examination before being appointed to serve as a correctional officer in a correctional 17 
facility. 18 
 
 (2) The Secretary shall adopt regulations governing the administration of 19 
the polygraph examination [required] AUTHORIZED under paragraph (1) of this 20 
subsection. 21 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 22 
October 1, 2022. 23
