56	56	(a) Except as otherwise provided in this section, an individual shall be licensed 3
57	57	by the Board before the individual may practice as a nursing home administrator in this 4
58	58	State. 5

60	60	(C) AN INDIVIDUAL WHO HOLDS AN ACTIVE NURSING HOME 6
61	61	ADMINISTRATOR LICENSE, IN GOOD STANDING , IN ANOTHER STATE MAY PRACTICE 7
62	62	IN THIS STATE IF THE INDIVIDUAL HAS A MINIMUM OF: 8

64	64	(1) 3 YEARS OF EXPERIENCE AS A NURS ING HOME ADMINISTRAT OR; 9

72	72	(a) To qualify for a license, an applicant shall be an individual who: 14

74	74	(1) Submits to a criminal history records check in accordance with § 15
75	75	9–302.1 of this subtitle; and 16

77	77	(2) Meets the requirements of this section. 17

79	79	(b) The applicant shall be of good moral character. 18

81	81	(c) The applicant shall be at least 21 years old. 19

83	83	(d) (1) The applicant shall: 20

85	85	(i) 1. Have a baccalaureate or master’s degree in health care 21
86	86	administration from an accredited college or university; or 22

88	88	2. A. Have a baccalaureate or master’s degree in a field 23
89	89	other than health care administration from an accredited college or university; and 24

91	91	B. Have satisfactorily completed a minimum of 100 hours in 25
92	92	a course of study in health care administration approved by the Board; and 26

94	94	(ii) 1. Have completed an administrator–in–training program 27
95	95	approved by the Board; [or] 28

99	99	2. Have completed [1 year] 9 MONTHS of full–time nursing 1

102	102	3. HAVE COMPLETED 6 MONTHS OF FULL–TIME 3

105	105	A. HAVE COMPLETED AN INTERNS HIP IN A NURSING 5
106	106	HOME OR ASSISTED LIV ING PROGRAM ; 6

108	108	B. HOLD AN ACTIVE CERTIFICATI ON ISSUED BY THE 7
109	109	STATE BOARD OF NURSING AND HAVE AT LEAST 10 YEARS OF EXPERIENCE AT A 8
110	110	NURSING HOME ; OR 9

112	112	C. HAVE AT LEAST 3 YEARS OF EXPERIENCE AS A 10
113	113	DIRECTOR OF NURSING. 11

115	115	(2) The requirements of paragraph (1) of this subsection do not apply to an 12
116	116	individual who: 13

118	118	(i) Was in possession of a valid license on December 15, 1988; or 14

120	120	(ii) 1. Had applied for a license by December 15, 1988; and 15

122	122	2. Met all of the other requirements for licensure. 16

124	124	(e) The Board [may] SHALL waive any education requirement of subsection (d) 17
125	125	of this section for an individual who was licensed, REMAINS IN GOOD STAN DING, and 18
126	126	practiced as a nursing home administrator for at least 3 years in another state. 19

128	128	(f) (1) Notwithstanding the provisions of subsection (d)(1)(i)1 or 2A of this 20
129	129	section, the Board may not require an applicant to have a baccalaureate degree if the 21
130	130	applicant: 22

132	132	(i) Is a registered nurse who: 23

134	134	1. Has an associate in arts degree in nursing; or 24

136	136	2. Is a diplomate nurse; 25

138	138	(ii) Has been working as a nursing home director of nursing for a 26
139	139	period of at least 5 years, with at least 3 years experience at the same facility, prior to the 27
140	140	date the applicant submits an application to the Board for a license; 28

142	142	(iii) Has completed at least 6 months of full–time nursing home 29
143	143	administration in a training program approved by the Board; and 30

147	147	(iv) Has satisfactorily completed a minimum of 100 hours in a course 1
148	148	of study in health care administration, or equivalent, approved by the Board. 2

150	150	(2) Whenever federal law requires that an applicant for a license to practice 3
151	151	as a nursing home administrator must have a baccalaureate degree in health care 4
152	152	administration or in a field other than health care administration the provisions of this 5
153	153	section shall cease to be effective. 6

155	155	(g) Except as otherwise provided in this title, the applicant shall pass an 7
156	156	examination given by the Board under this subtitle. 8

158	158	SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 9
159	159	October 1, 2022. 10
