44 | 44 | | (i) where the allegedly abused or neglected child lives; or 20 |

46 | 46 | | (ii) if different, where the abuse or neglect is alleged to have taken 21 |
---|

54 | 54 | | clinical, or medical report or evaluation related to the allegedly abused or neglected child, 3 |
---|
55 | 55 | | a sibling of the child, or another child in the household, family, or care of the alleged abuser 4 |
---|

58 | 58 | | (5) “Secretary” means the Secretary of Human Services. 6 |

60 | 60 | | (b) [(1)] Notwithstanding any other provision of law, the local director or the 7 |
---|
61 | 61 | | Secretary shall, on request, disclose information concerning child abuse or neglect in 8 |
---|
62 | 62 | | accordance with subsection (c) of this section if: 9 |
---|
63 | 63 | | |
---|
64 | 64 | | [(i)] (1) the information is limited to actions or omissions of the 10 |
---|
65 | 65 | | local department, the Department of Human Services, or an agent of the Department of 11 |
---|
66 | 66 | | Human Services; 12 |

68 | 68 | | [(ii)] (2) the child named in a report of abuse or neglect has suffered 13 |
---|
69 | 69 | | a fatality or near fatality; and 14 |

---|

---|
89 | 89 | | subparagraph (i) of this paragraph, the local director or the Secretary shall disclose 30 |
---|

107 | 107 | | (2) the date of the report of the alleged child abuse or neglect and of any 6 |

108 | 108 | | prior or subsequent reports; 7 |
---|

110 | 110 | | (3) the findings made by the local department at the conclusion of its 8 |
---|
111 | 111 | | investigation and the disposition made by the local department based on its findings; 9 |
---|

---|
113 | 113 | | (4) any services provided to the alleged abuser or neglector, the allegedly 10 |
---|
114 | 114 | | abused or neglected child, and the household or family members; 11 |
---|
115 | 115 | | |
---|
116 | 116 | | (5) the number of referrals for professional services for the alleged abuser 12 |
---|
117 | 117 | | or neglector, the allegedly abused or neglected child, and the household or family members; 13 |
---|
118 | 118 | | |
---|
119 | 119 | | (6) any prior adjudication as a child in need of assistance of the allegedly 14 |
---|
120 | 120 | | abused or neglected child, a sibling of the child, or another child in the household, family, 15 |
---|
121 | 121 | | or care of the alleged abuser or neglector; 16 |
---|
122 | 122 | | |
---|
123 | 123 | | (7) the status of any case involving the child that was open at the time of 17 |
---|
124 | 124 | | the fatality or near fatality; 18 |
---|
125 | 125 | | |
---|
126 | 126 | | (8) a summary of the facts of the fatality or near fatality, including the date 19 |
---|
127 | 127 | | of the fatality or near fatality and, in the case of a fatality, the cause of death reported by 20 |
---|
128 | 128 | | the medical examiner; and 21 |
---|

---|
130 | 130 | | (9) any information concerning the circumstances of the alleged child 22 |
---|
131 | 131 | | abuse or neglect and the investigation of the circumstances, if the local director or the 23 |
---|
132 | 132 | | Secretary determines that the disclosure is consistent with the public interest. 24 |

134 | 134 | | (e) (1) The local director or the Secretary may not: 25 |
---|

---|
136 | 136 | | (i) disclose the identity of or provide an identifying description of 26 |
---|
137 | 137 | | the person who made the report; 27 |

139 | 139 | | (ii) disclose the name of a child who has suffered a near fatality, a 28 |
---|
140 | 140 | | sibling of the allegedly abused or neglected child, a parent of the allegedly abused or 29 |
---|
141 | 141 | | neglected child, an individual legally responsible for the child, the alleged abuser or 30 |
---|
142 | 142 | | neglector, or another household or family member; 31 |

---|
144 | 144 | | (iii) except as provided in paragraph (2) of this subsection, disclose a 32 |

153 | 153 | | local director or the Secretary may disclose a medical report related to the cause of the 4 |
---|
154 | 154 | | child’s injury or death as a result of the alleged abuse or neglect. 5 |
---|

---|
156 | 156 | | (f) In consultation with the local directors, the Secretary shall develop a form for 6 |
---|
157 | 157 | | disclosure of the information described in subsection (d) of this section. 7 |
---|

---|
159 | 159 | | (g) This section does not grant a right to any person to receive the information 8 |
---|
160 | 160 | | described in subsection (d) of this section. 9 |
