Food Service Facilities – Automated External Defibrillator Program 2
(Joe Sheya Act) 3
FOR the purpose of requiring the owner and operator of a certain food service facility to 4
develop and, beginning on a certain date, implement an automated external 5
defibrillator program that meets certain requirements; requiring the Maryland 6
Department of Health and the Maryland Institute for Emergency Medical Services 7
Systems jointly to adopt certain regulations; and generally relating to an automated 8
external defibrillator program for food service facilities. 9

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15

AN ANNUAL GROSS INCO ME OF $400,000 OR LESS. 20
(B) THE OWNER AND OPERATO R OF A FOOD SERVICE FACILITY SHALL 21
DEVELOP AND , BEGINNING JANUARY 1, 2025, IMPLEMENT AN AUTOMAT ED 22
EXTERNAL DEFIBRILLAT OR PROGRAM THAT MEET S THE REQUIREMENTS O F § 23
13–517 OF THE EDUCATION ARTICLE. 24 2 HOUSE BILL 288
(C) THE DEPARTMENT AND THE MARYLAND INSTITUTE FOR EMERGENCY 1
MEDICAL SERVICES SYSTEMS JOINTLY SHALL ADOPT REGULATIONS TH AT: 2
(1) ESTABLISH GUIDELINES FOR PERIODIC INSPECT IONS AND 3
ANNUAL MAINTENANCE O F THE AUTOMATED EXTE RNAL DEFIBRILLATORS ; AND 4
(2) ASSIST THE OWNER AND OPERATOR OF A FO OD SERVICE FACILITY 5
IN CARRYING OUT THE PROVISIONS OF THIS S ECTION. 6
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 7
October 1, 2023. 8
