34	34	SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15

41	41	(a) (1) In this section the following words have the meanings indicated. 19

43	43	(2) “Community college” includes Baltimore City Community College. 20

45	45	(3) “Eligible project” means a facility renewal project, including 21
46	46	improvements, repairs, and deferred maintenance, that has a total estimated cost of not 22
47	47	more than $1,000,000 and has been submitted to the Commission as part of an annual 23

52	52	(4) “Program” means the Community College Facilities Renewal Grant 1
53	53	Program. 2

55	55	(b) (1) There is a Community College Facilities Renewal Grant Program that 3
56	56	shall provide State funds to community colleges for improvements, repairs, and deferred 4
57	57	maintenance projects in accordance with this section. 5

59	59	(2) The Commission shall administer the Program. 6

61	61	(c) (1) (i) In fiscal years 2019 through 2021, the Governor shall annually 7
62	62	appropriate in the operating budget of the Commission an amount equal to 5% of the 8
63	63	appropriation to the Community College Construction Grant Program in the same fiscal 9
64	64	year. 10

66	66	(ii) In fiscal [year 2022 and each fiscal year thereafter] YEARS 2022 11
67	67	AND 2023, the Governor shall annually appropriate in the operating or capital budget of 12
68	68	the Commission an amount equal to 5% of the appropriation to the Community College 13
69	69	Construction Grant Program in the same fiscal year. 14

71	71	(III) IN FISCAL YEAR 2024 AND EACH FISCAL YEAR THEREAFTER , 15
72	72	THE GOVERNOR SHALL ANNUAL LY APPROPRIATE IN TH E OPERATING OR CAPIT AL 16
73	73	BUDGET OF THE COMMISSION AN AMOUNT EQUAL TO 10% OF THE APPROPRIATION 17
74	74	TO THE COMMUNITY COLLEGE CONSTRUCTION GRANT PROGRAM IN THE SAME 18
75	75	FISCAL YEAR. 19

77	77	(2) The appropriation required under paragraph (1) of this subsection shall 20
78	78	be in addition to and may not supplant the amount appropriated to the Community College 21
79	79	Construction Grant Program in the State budget. 22

81	81	(d) (1) On or before September 1 of the fiscal year preceding the fiscal year of 23
82	82	the grant award, a community college shall provide to the Commission information about 24
83	83	the eligible project for which the community college is requesting a grant. 25

85	85	(2) (i) The Commission may make up to [eight] 16 grants in each fiscal 26
86	86	year. 27

88	88	(ii) [1. Subject to subsubparagraph 2 of this subparagraph, a 28
89	89	community college may not receive a grant in 2 consecutive fiscal years. 29

91	91	2. If a community college does not request funds in a fiscal 30
92	92	year, the community college may not receive a grant until the second following fiscal year. 31

94	94	(iii) 1. Subject to subsubparagraph 2 of this subparagraph, a 32
95	95	community college may not receive more than $500,000 in a fiscal year under the Program. 33

99	99	2. If the appropriation provided under subsection (c) of this 1
100	100	section is less than $4,000,000 in a fiscal year, the appropriation shall be awarded equally 2
101	101	to each community college that is eligible for a grant in that fiscal year. 3

103	103	3. Subject to the limitation established in subsubparagraph 4
104	104	1 of this subparagraph, a] A community college may receive funding for more than one 5
105	105	eligible project in a fiscal year. 6

107	107	[(iv)] (III) The Commission shall consult with each community 7
108	108	college to determine which community colleges will receive a grant for eligible projects 8
109	109	under the Program in each fiscal year. 9

111	111	(e) The Commission, in collaboration with the community colleges, shall adopt 10
112	112	any regulations necessary to carry out the provisions of this section. 11

114	114	SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 12
115	115	1, 2023, and shall be applicable beginning in fiscal year 2024. 13
