30 10 SENATE BILL 930 (II) COMPENSATE THE DEALER FOR WARRANTY SERVICE 1 PERFORMED BY THE DEA LER THAT IS COVERED BY THE WARRANTY ; AND 2 (III) PROVIDE THE DEALER A SCHEDULE OF COMPENSA TION TO 3 BE PAID AND THE REAS ONABLE TIME ALLOWANC E FOR THE PERFORMA NCE OF ANY 4 SERVICE AND REPAIRS UNDER A WARRANTY . 5 (2) IF THE SCHEDULE OF CO MPENSATION DOES NOT INCLUDE A 6 PARTICULAR SERVICE O R REPAIR, A WARRANTOR SHALL RE IMBURSE THE DEALER 7 A REASONABLE AMOUNT FOR THE SERVICE OR R EPAIR. 8 (B) (1) A WARRANTOR SHALL REIMBURSE THE DEALER FOR ANY 9 WARRANTY PART AT WHO LESALE COST PLUS A 30% HANDLING CHARGE . 10 (2) THE MAXIMUM HANDLING CHARGE UNDER THIS SU BSECTION IS 11 $300. 12 (3) A WARRANTOR SHALL REIM BURSE A DEALER THE C OST OF 13 FREIGHT TO RETURN A WARRANTY PART , AN ACCESSO RY, OR A COMPONENT TO TH E 14 WARRANTOR , IF THE RETURN IS REQ UESTED BY THE WARRAN TOR. 15 (C) WARRANTY AUDITS OF DE ALER RECORDS MAY BE CONDUCTED BY THE 16 WARRANTOR ON A REASO NABLE BASIS. 17 (D) (1) A DEALER SHALL SUBMIT A WARRANTY CLAIM WIT HIN 45 DAYS 18 AFTER COMPLET ING THE WORK. 19 (2) A WARRANTOR MAY ONLY D ISAPPROVE WARRANTY C LAIMS IN 20 WRITING WITHIN 45 DAYS AFTER THE DATE THE WARRANTY CLAIM W AS SUBMITTED 21 BY THE DEALER IN THE MANNER PRESCRIBED BY THE WARRANTOR . 22 (3) CLAIMS NOT DISAPPROVE D IN WRITING WITHIN 45 DAYS SHALL 23 BE DEEMED TO BE APPR OVED AND SHALL BE PA ID BY THE WARRANTOR WITHIN 60 24 DAYS. 25 (E) A DEALER SHALL GIVE NO TICE TO A WARRANTOR AS SOON AS 26 REASONABLY POSSIBLE IF THE DEALER IS UNA BLE OR UNWILLING TO PERFORM 27 MATERIAL OR REPETITI VE WARRANTY REPAIRS . 28 (F) IT IS A VIOLATION OF THIS SECTION FOR ANY WARRANTOR TO : 29 (1) FAIL TO PERFORM ANY O F ITS WARRANTY OBLIG ATIONS WITH 30 RESPECT TO ITS WARRA NTED PRODUCTS ; 31 SENATE BILL 930 11 (2) FAIL TO INCLUDE WRITT EN NOTICES OF FACTOR Y CAMPAIGNS TO 1 RECREATIONAL VEHICLE OWNERS AND DEALERS F OR THE EXPECTED DATE BY 2 WHICH PARTS AND EQUI PMENT WILL BE AVAILA BLE TO DEALERS TO PE RFORM THE 3 CAMPAIGN WORK ; 4 (3) IF THE CARRIER IS DES IGNATED BY THE MANUF ACTURER, 5 DISTRIBUTOR, OR WARRANTOR , FAIL TO COMPENSATE A DEALER FOR AUTHORIZE D 6 REPAIRS PERFORMED BY A DEALER FOR A PRODU CT DAMAGED IN TRANSI T TO THE 7 DEALER; 8 (4) FAIL TO COMPENSATE AN Y DEALER FOR AUTHORI ZED WARRANTY 9 SERVICE IN ACCORDANC E WITH THE TIME ALLO WANCES SET FORTH IN THE 10 SCHEDULE OF COMPENSA TION, IF PERFORMED IN A TI MELY MANNER ; 11 (5) INTENTIONALLY MISREPR ESENT TO PURCHASERS OF 12 RECREATIONAL VEHICLE S THAT A DEALER IS A WARRANTOR OR CO –WARRANTOR ; 13 OR 14 (6) REQUIRE A DEALER TO M AKE WARRANTIES TO CU STOMERS IN 15 ANY MANNER RELATED T O THE MANUFACTURING OF A RECREATIONAL VE HICLE. 16 (G) IT IS A VIOLATION OF THIS SEC TION FOR A DEALER TO : 17 (1) FAIL TO PERFORM PREDE LIVERY INSPECTION FU NCTIONS AS 18 SPECIFIED BY THE WAR RANTOR; 19 (2) FAIL TO PERFORM WARRA NTY SERVICE WORK AUT HORIZED BY 20 THE WARRANTOR IN A R EASONABLY TIMELY MAN NER ON ANY TRANSIENT 21 CUSTOME R’S RECREATIONAL VEHIC LE OF THE SAME LINE –MAKE; 22 (3) FAIL TO TRACK ACTUAL TIME EXPENDED TO PER FORM WARRANTY 23 WORK NOT GOVERNED BY TIME ALLOWANCE IN TH E SCHEDULE OF COMPEN SATION; 24 (4) CLAIM AN AGENCY RELAT IONSHIP WITH A WARRA NTOR; OR 25 (5) MISREPRESENT THE TERMS OF A WARRA NTY. 26 (H) UNLESS SPECIFIED IN T HE TERMS OF A DEALER AGREEMENT , IT IS A 27 VIOLATION OF THIS SE CTION FOR: 28 (1) A WARRANTOR TO FAIL TO INDEMNIFY, DEFEND, AND HOLD 29 HARMLESS A DEALER AG AINST ANY LOSSES OR DAMAGES TO THE EXTEN T THE 30 12 SENATE BILL 930 LOSSES OR DAMAGES ARE CAUSED B Y THE NEGLIGENCE OR MISCONDUCT OF THE 1 WARRANTOR ; OR 2 (2) A DEALER TO FAIL TO IN DEMNIFY, DEFEND, AND HOLD HARMLESS 3 A WARRANTOR AGAINST ANY LOSSES OR DAMAGE S TO THE EXTENT THE LOSSES OR 4 DAMAGES ARE CAUSED B Y THE NEGLIGENCE OR MISCONDUC T OF THE DEALER . 5 (I) INDEMNIFICATION UNDER THIS SUBSECTION SHAL L INCLUDE COURT 6 COSTS, REASONABLE ATTORNEY ’S FEES, AND EXPERT WITNESS F EES INCURRED BY 7 THE DEFENDING PARTY . 8 15–906. 9 (A) WHEN A NEW RECREATION AL VEHICLE IS DAMAGE D BEFORE TRANSIT 10 TO THE DEALER, OR IS DAMAGED IN TRA NSIT TO THE DEALER A ND THE 11 MANUFACTURER OR DIST RIBUTOR WAS RESPONSI BLE FOR TRANSIT , THE DEALER 12 SHALL: 13 (1) NOTIFY THE MANUFACTUR ER OR DISTRIBUTOR OF THE DAMAGE 14 WITHIN THE TIME FRAM E SPECIFIED IN THE D EALER AGREEMENT ; 15 (2) REQUEST AUTHORIZATION TO REPLACE THE COMPO NENTS, 16 PARTS, OR ACCESSORIES DAMAG ED; AND 17 (3) REJECT THE RECREATION AL VEHICLE WITHIN 2 DAYS AFTER 18 PHYSICAL DELIVERY OF THE RECREATIONAL VEH ICLE. 19 (B) (1) IF A DEALER DETERMINE S THAT A RECREATIONA L VEHICLE AT 20 THE TIME OF DELIVERY HAS AN UNREASONABLE AMOU NT OF MILES ON THE 21 ODOMETER , THE RECREATIONAL VEH ICLE MAY BE SUBJECT TO REJECTION BY THE 22 DEALER AND REVERSION OF THE RECREATIONAL VEHICLE TO THE MANUF ACTURER 23 OR DISTRIBUTOR . 24 (2) A DEALER MAY NOT DEEM LESS THAN TH E DISTANCE BETWEEN 25 THE DEALER AND THE M ANUFACTURER ’S FACTORY OR A DISTR IBUTOR’S POINT OF 26 DISTRIBUTION, AS APPROPRIATE , PLUS 100 MILES AS AN UNREASON ABLE AMOUNT 27 OF MILES. 28 15–907. 29 (A) (1) IN THIS SECTION, “COERCE” MEANS TO COMPEL OR A TTEMPT TO 30 COMPEL BY T HREAT OF HARM , BREACH OF CONTRACT , OR OTHER ADVERSE ACT ION 31 SENATE BILL 930 13 OR CONSEQUENCES , INCLUDING THE LOSS O F ANY INCENTIVE OR O THER BENEFIT 1 MADE AVAILABLE TO OT HER DEALERS OF THE S AME LINE–MAKE IN THE STATE. 2 (2) “COERCE” INCLUDES THREATENING TO TERMINATE , CANCEL, OR 3 NOT RENEW A DEALER A GREEMENT WITHOUT GOO D CAUSE, OR HOLD OR DELAY 4 PRODUCT DELIVERY . 5 (B) A MANUFACTURER OR DIST RIBUTOR, WHETHER DIRECTLY OR 6 THROUGH AN AGENT , AN EMPLOYEE , AN AFFILIATE, OR A REPRESENTATIVE , MAY 7 NOT COERCE OR ATTEMP T TO COERCE A DEALER TO: 8 (1) PURCHASE A PRODUCT TH E DEALER DID NOT ORD ER; 9 (2) ENTER INTO AN AGREEME NT WITH THE MANUFACT URER OR 10 DISTRIBUTOR; 11 (3) TAKE ACTION THAT IS U NFAIR OR UNREASONABL E TO THE 12 DEALER; OR 13 (4) FORGO EXERCISING A RI GHT AUTHORIZED BY A DEALER 14 AGREEMENT OR ANY LAW GOVERNING THE BUSINESS RELATIO NSHIP. 15 15–908. 16 (A) NOTWITHSTANDING ANY A DMINISTRATIVE OR CRI MINAL SANCTIONS 17 IMPOSED BY THIS SUBT ITLE, IF A PERSON SUFFERS FINANCIAL INJURY OR OTHER 18 DAMAGE AS A RESULT O F A VIOLATION OF THI S SUBTITLE BY ANY OT HER PERSON, 19 WHETHER OR NOT THAT OTHER PERSON HAS BEE N FOUND GUILTY OF A CRIMINAL 20 VIOLATION, THE INJURED PERSON M AY RECOVER DAMAGES A ND REASONABLE 21 ATTORNEY’S FEES IN ANY COURT OF COMPETENT JURISDI CTION. 22 (B) (1) BEFORE BRINGING A CIV IL ACTION UNDER THIS SECTION, THE 23 PARTY BRINGING THE A CTION SHALL SERVE A WRITTEN DEMAND FOR M EDIATION 24 ON THE OFFENDING PAR TY. 25 (2) THE PARTIES TO MEDIAT ION SHALL PAY THEIR OWN COSTS FOR 26 ATTORNEY’S FEES AND DIVIDE TH E MEDIATOR COST EQUA LLY. 27 (3) THIS SUBSECTION DOES NOT APPLY T O AN ACTION FOR 28 INJUNCTIVE RELIEF . 29 14 SENATE BILL 930 (C) A DEALER, MANUFACTURER , DISTRIBUTOR, OR WARRANTOR MAY 1 APPLY FOR A GRANT OF INJUNCTIVE RELIEF FR OM A VIOLATION OF TH IS SUBTITLE 2 OR A REFUSAL TO COMP LY WITH A REQUIREMEN T OF THIS SUBTITLE. 3 15–909. 4 (A) THE ADMINISTRATION MAY SUSPEND OR REVOKE ANY DEALER , 5 MANUFACTURER , OR DISTRIBUTOR ’S LICENSE ON A FINDI NG THAT A PARTY 6 VIOLATED THIS SUBTIT LE. 7 (B) THE ADMINISTRATION MAY IM POSE A FINE NOT EXCE EDING $1,000 FOR 8 EACH VIOLATION OF TH IS SUBTITLE. 9 (C) A DEALER, MANUFACTUR ER, DISTRIBUTOR, OR WARRANTOR IS 10 ENTITLED TO A HEARIN G UNDER TITLE 12, SUBTITLE 2 OF THIS ARTICLE TO 11 CONTEST AN ACTION OR FINE IMPOSED UNDER T HIS SECTION. 12 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 13 October 1, 2023. 14
