BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 9 That the Laws of Maryland read as follows: 10 Article – General Provisions 11 3–307. 12 (a) This section applies only to the following public bodies: 13 (1) the Board of Directors of the Bainbridge Development Corporation; 14 (2) the Canal Place Preservation and Development Authority; 15 (3) the Maryland 9–1–1 Board; 16 (4) the Board of Directors of the Maryland Agricultural and 17 Resource–Based Industry Corporation; 18 (5) the Board of Directors of the Maryland Clean Energy Center; 19 (6) the Board of Directors of the Maryland Economic Development 20 Corporation; 21 (7) the Board of Directors of the Maryland Environmental Service; 22 (8) the Maryland Food Center Authority; 23 (9) the Maryland Health and Higher Educational Facilities Authority; 24 (10) the Maryland Industrial Development Financing Authority; 25 (11) the Maryland Stadium Authority; 26 (12) the Maryland Transportation Authority; 27 (13) the Northeast Maryland Waste Disposal Authority; [and] 5 (19) the Maryland Aviation Commission; AND 6 (20) THE MARYLAND DEPARTMENT OF TRANSPORTATION , WITH 7 RESPECT TO QUARTERLY PUBLIC MEETINGS HELD BY THE VISION ZERO 8 COORDINATOR ON THE I MPLEMENTATION OF VISION ZERO UNDER § 8–1004 OF THE 9 TRANSPORTATION ARTICLE. 10 (b) A public body specified in subsection (a) of this section shall make publicly 11 available on its website: 12 (1) each open meeting agenda, together with a summary of any finalized 13 documents, written testimony from the public, and other materials that the public body 14 will vote on at the open meeting: 15 (i) at least 48 hours in advance of each meeting; or 16 (ii) if the meeting is being held due to an emergency, a natural 17 disaster, or any other unanticipated situation, as far in advance of the meeting as 18 practicable; 19 (2) meeting minutes from the portions of a meeting that were held in open 20 session, not more than 2 business days after the minutes are approved; and 21 (3) subject to subsections (f) and (g) of this section, live video streaming of 22 each portion of a meeting that is held in open session. 23 (c) To the extent practicable, each open meeting agenda shall indicate: 24 (1) whether the public body intends to adjourn the open session to a closed 25 session; and 26 (2) if applicable, the expected time at which the public body intends to 27 adjourn the open session to a closed session. 28 (d) (1) The public body shall approve meeting minutes in a timely manner. 29 4 HOUSE BILL 344 (2) Each open meeting agenda shall include consideration of the meeting 1 minutes from the most recent meeting. 2 (3) The requirement under paragraph (2) of this subsection does not apply 3 to the agenda of an emergency meeting of a public body if consideration of the meeting 4 minutes from the most recent meeting is not practicable because of the need to hold an 5 emergency meeting. 6 (e) The public body shall maintain on its website: 7 (1) meeting minutes made available under subsection (b) of this section for 8 a minimum of 5 years after the date of the meeting; and 9 (2) except as provided in subsections (f) [and (g)], (G), AND (G–1) of this 10 section, a complete and unedited archived video recording of each open meeting for which 11 live video streaming was made available under subsection (b) of this section for a minimum 12 of 1 year after the date of the meeting. 13 (f) (1) This subsection applies only to the Maryland Stadium Authority. 14 (2) If the Maryland Stadium Authority meets by telephone conference, the 15 Authority shall: 16 (i) make publicly available on its website live audio streaming of 17 each portion of the meeting that is held in open session; and 18 (ii) maintain on its website a complete and unedited archived audio 19 recording of each meeting for which live audio streaming was made available for a 20 minimum of 1 year after the date of the meeting. 21 (g) (1) This subsection applies only to the Maryland Transportation Authority. 22 (2) The Maryland Transportation Authority is required to provide live 23 video streaming of a meeting only if the meeting is held at: 24 (i) the headquarters of the Maryland Transportation Authority; or 25 (ii) a location where the Maryland Transportation Authority held at 26 least 10 meetings during the immediately preceding calendar year. 27 (G–1) THE MARYLAND DEPARTMENT OF TRANSPORTATION , WITH RESPECT 28 TO QUARTERLY PUBLIC MEETINGS HELD BY THE VISION ZERO COORDINATOR ON 29 THE IMPLEMENTATION O F VISION ZERO UNDER § 8–1004 OF THE TRANSPORTATION 30 ARTICLE, SHALL MAINTAIN ON IT S WEBSITE A COMPLETE AND UNEDITED ARCHIVE D 31 VIDEO RECORDING OF THE MEETING FOR A MINIMUM OF 5 YEARS AFTER THE DATE 32 OF THE MEETING . 33 HOUSE BILL 344 5 (h) The Department of Information Technology shall provide the technical staff, 1 support, and equipment necessary to livestream the open meetings of: 2 (1) the Maryland Transportation Authority; 3 (2) the State Board of Elections; and 4 (3) the State Ethics Commission. 5 (i) For purposes of this title, a project site visit or educational field tour may not 6 be considered a meeting of a public body listed under subsection (a) of this section if no 7 organizational business is conducted. 8 (j) Nothing in this section may be construed to prevent a public body from 9 altering the agenda of a meeting after the agenda has been made available to the public. 10 (k) The requirements of this section are in addition to the other requirements of 11 this subtitle. 12 Article – Transportation 13 8–1001. 14 (a) In this subtitle the following words have the meanings indicated. 15 (b) “Coordinator” means the individual designated by the Department to oversee 16 the implementation of Vision Zero throughout the State. 17 (c) “Vision Zero” means a program for planning and developing a State roadway 18 system that has zero vehicle–related deaths or serious injuries. 19 8–1002. 20 There is a program within the Department known as Vision Zero. 21 8–1003. 22 (a) The purpose of Vision Zero is to develop strategies to make roadways safer for 23 drivers and passengers of motor vehicles, bicyclists, and pedestrians. 24 (b) The goal of Vision Zero is to have zero vehicle–related deaths or serious 25 injuries on roadways by the year 2030. 26 8–1004. 27 6 HOUSE BILL 344 (a) The Department shall designate a coordinator to oversee the implementation 1 of Vision Zero throughout the State. 2 (b) (1) In implementing Vision Zero, the coordinator shall collaborate with 3 other State agencies and local authorities, including local transportation agencies, law 4 enforcement agencies, educational institutions, and fire and rescue services, TO: 5 (I) IDENTIFY STRATEGIES F OR ACHIEVING THE VISION ZERO 6 GOAL ESTABLISHED UND ER § 8–1003(B) OF THIS SUBTITLE AS ENU MERATED UNDER 7 § 8–1005 OF THIS SUBTITLE; 8 (II) ANALYZE INFRASTRUCTUR E REVIEWS COMPLETED UNDER 9 § 8–204.2 OF THIS TITLE; 10 (III) PROVIDE GUIDANCE ON A NY OTHER ISSUE DIREC TLY 11 RELATED TO ROADWAY S AFETY; AND 12 (IV) ADVISE THE GOVERNOR AND STATE AND LOCAL AGENC IES 13 ON: 14 1. THE IMPLEMENTATION OF VISION ZERO; 15 2. POLICIES, PROGRAMS, AND SERVICES AFFECTI NG 16 TRAFFIC SAFETY FOR P EDESTRIANS, BICYCLISTS, AND DRIVERS AND PASS ENGERS 17 OF MOTOR VEHICLES ; AND 18 3. PRIORITIES AND NEEDS FOR ROADWAY SA FETY. 19 (2) (I) THE COORDINATOR SHALL HOLD A QUARTERLY PUB LIC 20 MEETING ON THE IMPLE MENTATION OF VISION ZERO WITH: 21 1. THE ADMINISTRATOR OR THE ADMINISTRATOR ’S 22 DESIGNEE; 23 2. THE MOTOR VEHICLE ADMINISTRATOR OR THE 24 MOTOR VEHICLE ADMINISTRATOR ’S DESIGNEE; 25 3. THE EXECUTIVE DIRECTOR OF THE MARYLAND 26 TRANSPORTATION AUTHORITY OR THE EXECUTIVE DIRECTOR’S DESIGNEE; AND 27 4. A REPRESENTATIVE OF TH E OFFICE OF THE 28 SECRETARY AS DESIGNAT ED BY THE SECRETARY. 29 HOUSE BILL 344 7 (II) THE COORDINATOR MAY R EQUEST THAT ANY OTHE R 1 APPROPRIATE STATE OR LOCAL OFFICI AL PARTICIPATE IN OR TAKE QUESTIONS AT 2 A QUARTERLY PUBLIC M EETING. 3 (III) AT A QUARTERLY PUBLIC MEETING, THE PARTICIPANTS 4 IDENTIFIED UNDER SUB PARAGRAPH (I) OF THIS PARAGRAPH SH ALL: 5 1. ADDRESS A ND MAKE RECOMMENDATI ONS ON ANY 6 VISION ZERO DEVELOPMENT AND IMPLEMENTATION ISSUE S IDENTIFIED BY THE 7 COORDINATOR UNDER PA RAGRAPH (1)(I) OF THIS SUBSECTION ; 8 2. A. DISCUSS EACH INFRASTR UCTURE REVIEW 9 COMPLETED UNDER § 8–204.2 OF THIS TITLE AND AN ALYZED BY THE COORDINATOR ; 10 AND 11 B. VOTE TO ACCEPT THE IN FRASTRUCTURE REVIEW OR 12 TO RETURN THE INFRAS TRUCTURE REVIEW TO T HE PERSON THAT CONDU CTED IT 13 FOR A RESPONSE TO QU ESTIONS OR COMMENTS OR FOR FURTHER REVIE W AS 14 APPROPRIATE ; AND 15 3. DISCUSS AND RECOMMEND ANY GUIDANCE OR 16 ADVICE FOR THE COORD INATOR TO PROVIDE UN DER PARAGRAPH (1) OF THIS 17 SUBSECTION. 18 (IV) 1. A QUARTERLY PUBLIC MEE TING SHALL BE 19 LIVESTREAMED . 20 2. THE DEPARTMENT SHALL MAIN TAIN ON ITS WEBSITE 21 A COMPLETE AND UNEDI TED ARCHIVED VIDEO R ECORDING OF EACH QUARTERLY 22 PUBLIC MEETING FOR A MINIMUM OF 5 YEARS AFTER THE DATE OF THE MEETING . 23 8–1005. 24 The implementation of Vision Zero shall include [strategies for achieving the goal 25 established under § 8–1003(b) of this subtitle, including] strategies for: 26 (1) Identifying State and local laws, policies, and regulations that hinder 27 the development and implementation of Vision Zero; 28 (2) Proposing changes to State and local laws to allow for innovative 29 engineering and traffic calming; 30 (3) Creating a Vision Zero website that contains information related to 31 Vision Zero; 32 8 HOUSE BILL 344 (4) Collecting and publishing motor vehicle collision data; 1 (5) Connecting with other states and communities that have implemented 2 a similar Vision Zero program; 3 (6) Reviewing existing traffic safety programs to determine their 4 effectiveness; 5 (7) Working with research organizations to develop best practices; 6 (8) Prioritizing resources for investment in the communities most affected 7 by motor vehicle collisions; 8 (9) Proactively engaging community members to address their traffic 9 safety concerns; 10 (10) Developing and publishing a long–term plan for the continued 11 development of Vision Zero; and 12 (11) Investing more resources into construction needs for high–accident 13 intersections and roadway sections. 14 8–1006. 15 Funds for Vision Zero shall be as provided by the Governor in the State budget. 16 8–1007. 17 (a) On or before December 31 each year, the Department shall submit a report 18 [on the status of Vision Zero] to the Governor and, in accordance with § 2–1257 of the State 19 Government Article, the General Assembly THAT INCLUDES : 20 (1) THE STATUS OF VISION ZERO; AND 21 (2) THE ACTIVITIES, AND ANY FINDINGS AND RECOMME NDATIONS, 22 OF THE VISION ZERO ADVISORY COMMISSION ESTABLISHE D UNDER § 8–1008 OF 23 THIS SUBTITLE COORDINATOR ; AND 24 (3) A SUMMARY OF EACH QUAR TERLY PUBLIC MEETING HELD IN THE 25 PREVIOUS YEAR . 26 (b) The Department shall make the report required under subsection (a) of this 27 section available on its website. 28 8–1008. 29 HOUSE BILL 344 9 (A) IN THIS SECTION, “COMMISSION” MEANS THE VISION ZERO ADVISORY 1 COMMISSION. 2 (B) THERE IS A VISION ZERO ADVISORY COMMISSION. 3 (C) THE PURPOSE OF THE COMMISSION IS TO ADVI SE THE DEPARTMENT ON 4 BEST PRACTICES INTEN DED TO ELIMINATE DEA THS AND SERIOUS INJURIES ON 5 ROADWAYS IN ALL MODE S OF GROUND TRANSPOR TATION USING DATA –DRIVEN 6 PREVENTION STRATEGIE S, WITH AN EMPHASIS ON A SAFE SYSTEM APPROACH . 7 (D) THE COMMISSION CONSISTS O F THE FOLLOWING MEMB ERS: 8 (1) ONE MEMBER OF THE SENATE OF MARYLAND, APPOINTED BY THE 9 PRESIDENT OF THE SENATE; AND BE IT FURTHER ENACTED, That the terms of the initial 13 members of the Vision Zero Advisory Commission appointed by the Governor under § 14 8–1008(c)(11) of the Transportation Article, as enacted by Section 1 of this Act, shall expire 15 as follows: 16 (1) eight members in 2026; 17 (2) eight members in 2027; and 18 (3) seven members in 2028. 19 SECTION 3. 2.
