AN ACT concerning 1 
 
Maryland Longitudinal Data System Center – Student Information – United 2 
States Census Bureau 3 
 
FOR the purpose of authorizing the Governing Board of the Maryland Longitudinal Data 4 
System Center to authorize the Center to send certain student information to the 5 
United States Census Bureau; and generally relating to the Maryland Longitudinal 6 
Data System Center. 7

 SECTION 1. BE IT ENACTED BY THE GENERA L ASSEMBLY OF MARYLAND, 18 
That the Laws of Maryland read as follows: 19 
 
Article – Education 20 
 
24–701. 21 
 
 (a) In this subtitle the following words have the meanings indicated. 22 
 
 (e) “Governing Board” means the Governing Board of the Maryland Longitudinal 23

 (a) (1) In this section the following words have the meanings indicated. 2 
 
 (2) “Aggregated data” means de–identified data that is summarized by 3 
type of program of study or educational institution. 4 
 
 (3) “Student information” means: 5 
 
 (i) Student Social Security number; 6 
 
 (ii) Program of study; 7 
 
 (iii) Enrollment; and 8 
 
 (iv) Name of educational institution. 9 
 
 (4) “Tax information” means income tax records, wage information, and 10 
other data stored by the Comptroller. 11 
 
 (b) (1) The Center and the Comptroller jointly shall develop a protocol for 12 
research purposes for the: 13 
 
 (i) Center to send student information to the Comptroller; 14 
 
 (ii) Comptroller to match student information to tax information; 15 
and 16 
 
 (iii) Comptroller to produce aggregated data from the matched 17 
information on the average amount of wage or salary earnings from self–employment or 18 
other sources of income for individuals within each educational institution or program of 19 
study. 20 
 
 (2) The Comptroller may not produce any aggregated data that may be 21 
identifiable based on the size or uniqueness of the population under consideration. 22 
 
 (c) The Center and the Comptroller jointly shall develop data handling and 23 
security standards for the Comptroller to utilize for the protocol, including: 24 
 
 (1) Data retention and disposition policies; 25 
 
 (2) Authorized access and authentication for authorized access policies; 26 
 
 (3) Privacy compliance standards; and 27 
 
 (4) Breach notification and procedures. 28   	HOUSE BILL 634 	3 
 
 
 
 (d) The Comptroller shall comply with any data privacy and security standards 1 
in accordance with the federal Family Educational Rights and Privacy Act and other 2 
relevant privacy laws and policies. 3 
 
 (E) THE GOVERNING BOARD MAY AUTHORIZE T HE CENTER TO SEND 4 
STUDENT INFORMATION TO THE UNITED STATES CENSUS BUREAU. 5 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 6 
October 1, 2024. 7
