A BILL ENTITLED 
 
AN ACT concerning 1 
 
Health Occupations – Prescriptions for Children Subject to Joint Custody 2 
 
FOR the purpose of requiring health care providers who are authorized to prescribe to 3 
double the amount of each drug prescribed for a child if a parent of the child presents 4 
the prescriber with a court order of joint legal custody with a right of medical decision 5 
making; requiring a health care provider authorized to dispense prescription drugs 6 
to dispense the doubled prescription under certain circumstances; and generally 7 
relating to joint legal custody and prescriptions. 8

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 14 
That the Laws of Maryland read as follows: 15

 (A) IF A PARENT PRESENTS A HEALTH CARE PROVIDER AUTHORIZED TO 18 
PRESCRIBE UNDER THIS ARTICLE WITH A COURT ORDER OF JOI NT LEGAL CUSTODY 19 
WITH A RIGHT OF MEDI CAL DECISION MAKING, THE HEALTH CARE PROVIDER SHALL 20 
DOUBLE THE AMOUNT OF EACH DRUG THE HEALTH CARE PROVIDER PRESCRIBES 21 
FOR A CHILD OF THE PARENT . 22 
 
 (B) IF A PARENT PRESENTS A HEALTH CA RE PROVIDER AUTHORIZ ED TO 23 
DISPENSE PRESCRIPTIO N DRUGS OR DEVICES U NDER THIS ARTICLE WI TH A COURT 24  2 	SENATE BILL 1016  
 
 
ORDER OF JOINT LEGAL CUSTODY WITH A RIGHT OF MEDICAL DECISION MAKING 1 
AND A PRESCRIPTION A UTHORIZED UNDER SUBS ECTION (A) OF THIS SECTION, THE 2 
HEALTH CARE PROVIDER SHALL FILL THE PRESC RIPTION. 3 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 4 
October 1, 2024. 5
