25 | 25 | | SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 7 |

28 | 28 | | (a) In this section, “Local Fire and Police System” means the Local Fire and Police 9 |
---|
29 | 29 | | System established under Title 28 of the State Personnel and Pensions Article. 10 |

31 | 31 | | (b) This section applies to an individual who: 11 |

---|
33 | 33 | | (1) is an active member of the State Police Retirement System; 12 |
---|
34 | 34 | | |
---|
35 | 35 | | (2) is eligible for a vested benefit from the Local Fire and Police System; 13 |
---|
36 | 36 | | |
---|
37 | 37 | | (3) is not an active member in the Local Fire and Police System; and 14 |
---|
38 | 38 | | |
---|
39 | 39 | | (4) incurred a break in employment: 15 |
---|
40 | 40 | | |
---|
41 | 41 | | (i) after ceasing employment in a position in which the individual 16 |
---|
42 | 42 | | was required to be a member in the Local Fire and Police System; and 17 |
---|

---|
44 | 44 | | (ii) before beginning employment as a member of the State Police 18 |
---|
45 | 45 | | Retirement System. 19 |

47 | 47 | | (c) Notwithstanding § 37–202(a) of the State Personnel and Pensions Article, an 20 |

48 | 48 | | individual described under subsection (b) of this section may transfer the individual’s 21 2 SENATE BILL 1114 |

51 | 51 | | creditable service in the Local Fire and Police System to the State Police Retirement System 1 |

52 | 52 | | in accordance with Title 37 of the State Personnel and Pensions Article. 2 |

54 | 54 | | (d) An individual described under subsection (b) of this section shall make a 3 |

55 | 55 | | request to transfer service in accordance with subsection (c) of this section: 4 |

57 | 57 | | (1) on or before December 31, 2024; and 5 |

---|
59 | 59 | | (2) by submitting to the Board of Trustees for the State Retirement and 6 |
---|
60 | 60 | | Pension System a form provided by the State Retirement Agency for the purpose of electing 7 |
---|
61 | 61 | | to transfer service under this Act. 8 |

---|
63 | 63 | | SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 9 |
---|
64 | 64 | | 1, 2024. It shall remain effective for a period of 6 months and, at the end of December 31, 10 |
---|
65 | 65 | | 2024, this Act, with no further action required by the General Assembly, shall be abrogated 11 |
---|
66 | 66 | | and of no further force and effect. 12 |
