21	21	FOR the purpose of extending the termination date for certain provisions of law that reduce 4
22	22	the school facilities surcharge for certain multifamily housing, exempt certain 5
23	23	dwelling units from the school facilities surcharge, authorize the governing body of 6
24	24	Prince George’s County to reduce the school facilities surcharge up to a certain 7
25	25	portion for certain dwelling units, and require Prince George’s County to conduct a 8
26	26	certain review and report its findings to certain persons on or before a certain date; 9
27	27	and generally relating to the school facilities surcharge and the public safety 10
28	28	surcharge in Prince George’s County. 11

50	50	SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND , 1
51	51	That the Laws of Maryland read as follows: 2

57	57	(b–1) (1) The school facilities surcharge under this section shall be reduced by 5
58	58	50% for multi–family housing projects, with a building permit issued on or after April 1, 6
59	59	2019, constructed: 7

61	61	(A) Within an approved transit district overlay zone; or 8

63	63	(B) Where there is no approved transit district overlay zone, within 9
64	64	one–quarter mile of a Metro station or a MARC station. 10

66	66	(2) The school facilities surcharge under this section does not apply to a 11
67	67	dwelling unit that is a studio apartment or an efficiency apartment if the dwelling unit is 12
68	68	located: 13

70	70	(A) Within the Regional Transit Districts and Local Centers (Growth 14
71	71	Policy areas), as defined in the approved Prince George’s County General Plan (Plan 2035), 15
72	72	including in the area of the approved 2010 Central US 1 Corridor Approved Sector Plan 16
73	73	and Sectional Map Amendment; 17

75	75	(B) Within an approved transit district overlay zone; or 18

77	77	(C) Where there is no approved transit district overlay zone, within 19
78	78	one–quarter mile of a Metro station or a MARC station. 20

80	80	(3) The governing body of Prince George’s County may reduce the school 21
81	81	facilities surcharge by a percentage not exceeding 50% for dwelling units in multi–family 22
82	82	housing constructed where there is no approved transit district overlay zone, within 23
83	83	one–quarter mile of a Purple Line station. 24

87	87	SECTION 3. AND BE IT FURTHER ENACTED, That Prince George’s County shall: 26

89	89	(1) review and make recommendations on the impact of the school facilities 27
90	90	surcharge and the public safety surcharge and the need for any changes to the surcharges, 28
91	91	including whether changes to the school facilities surcharge and the public safety surcharge 29
92	92	might have a positive impact on the ability to construct and maintain affordable housing; 30

95	95	(2) on or before December 1, 2022, report its findings to the Prince George’s 32
96	96	County Council, the Prince George’s County School Board, and, in accordance with § 33 SENATE BILL 1123 3

99	99	2–1246 of the State Government Article, the members of the Prince George’s County 1
100	100	Delegation to the General Assembly. 2

102	102	SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall take effect July 3
103	103	1, 2019. Sections 2 and 3 of this Act shall remain effective for a period of [5] 8 years and, 4
104	104	at the end of June 30, [2024] 2027, Sections 2 and 3 of this Act, with no further action 5
105	105	required by the General Assembly, shall be abrogated and of no further force and effect. 6

107	107	SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 7
