33	33	SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 14
34	34	That the Laws of Maryland read as follows: 15

40	40	(a) (1) In this section the following words have the meanings indicated. 18

42	42	(2) “Community college” includes Baltimore City Community College. 19

44	44	(3) “Eligible project” means a facility renewal project, including 20
45	45	improvements, repairs, and deferred maintenance, that has a total estimated cost of not 21
46	46	more than $1,000,000 and has been submitted to the Commission as part of an annual 22
47	47	master plan or a 10–year master plan. 23

51	51	(4) “Program” means the Community College Facilities Renewal Grant 1
52	52	Program. 2

54	54	(b) (1) There is a Community College Facilities Renewal Grant Program that 3
55	55	shall provide State funds to community colleges for improvements, repairs, and deferred 4
56	56	maintenance projects in accordance with this section. 5

58	58	(2) The Commission shall administer the Program. 6

60	60	(c) (1) (i) In fiscal years 2019 through 2021, the Governor shall annually 7
61	61	appropriate in the operating budget of the Commission an amount equal to 5% of the 8
62	62	appropriation to the Community College Construction Grant Program in the same fiscal 9
63	63	year. 10

65	65	(ii) In fiscal [year 2022 and each fiscal year thereafter] YEARS 2023 11
66	66	AND 2024, the Governor shall annually appropriate in the operating or capital budget of 12
67	67	the Commission an amount equal to 5% of the appropriation to the Community College 13
68	68	Construction Grant Program in the same fiscal year. 14

70	70	(III) IN FISCAL YEAR 2025 AND EACH FISCAL YEAR THEREAFTER , 15
71	71	THE GOVERNOR SHALL ANNUAL LY APPROPRIATE IN TH E OPERATING OR CAPIT AL 16
72	72	BUDGET OF THE COMMISSION AN AMOUNT EQUAL TO 10% OF THE APPROPRIATION 17
73	73	TO THE COMMUNITY COLLEGE CONSTRUCTION GRANT PROGRAM IN THE SAME 18
74	74	FISCAL YEAR. 19

76	76	(2) The appropriation required under paragraph (1) of this subsection shall 20
77	77	be in addition to and may not supplant the amount appropriated to the Community College 21
78	78	Construction Grant Program in the State budget. 22

80	80	(d) (1) On or before September 1 of the fiscal year preceding the fiscal year of 23
81	81	the grant award, a community college shall provide to the Commission information about 24
82	82	the eligible project for which the community college is requesting a grant. 25

84	84	(2) (i) The Commission [may make up to eight] SHALL DISTRIBUTE 26
85	85	grants OF EQUAL AMOUNT S TO EACH COMMUNITY CO LLEGE in each fiscal year. 27

87	87	(ii) [1. Subject to subsubparagraph 2 of this subparagraph, a 28
88	88	community college may not receive a grant in 2 consecutive fiscal years. 29

90	90	2. If a community college does not request funds in a fiscal 30
91	91	year, the community college may not receive a grant until the second following fiscal year. 31

93	93	(iii) 1. Subject to subsubparagraph 2 of this subparagraph, a 32
94	94	community college may not receive more than $500,000 in a fiscal year under the Program. 33

98	98	2. If the appropriation provided under subsection (c) of this 1
99	99	section is less than $4,000,000 in a fiscal year, the appropriation shall be awarded equally 2
100	100	to each community college that is eligible for a grant in that fiscal year. 3

108	108	determine which community colleges will receive a grant for eligible projects under the 9
109	109	Program in each fiscal year.] 10

111	111	(e) The Commission, in collaboration with the community colleges, shall adopt 11
112	112	any regulations necessary to carry out the provisions of this section. 12

114	114	SECTION 2. AND BE IT FURTHER ENACTED, That this Act shal l take effect July 13
115	115	1, 2024, and shall be applicable beginning in fiscal year 2025. 14
