AN ACT concerning 1 
 
Health Insurance – Labor and Delivery Services – Cost–Sharing Requirements 2 
 
FOR the purpose of requiring certain insurers, nonprofit health service plans, and health 3 
maintenance organizations to provide coverage for labor and delivery services 4 
without certain cost–sharing requirements; and generally relating to cost–sharing 5 
requirements for labor and delivery services. 6

Section 15–811.1 9

 (2017 Replacement Volume and 2023 Supplement) 11 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12 
That the Laws of Maryland read as follows: 13 
 
Article – Insurance 14 
 
15–811.1. 15 
 
 (A) THIS SECTION APPLIES TO: 16 
 
 (1) INSURERS AND NONPROF IT HEALTH SERVICE PL ANS THAT 17 
PROVIDE LABOR AND DE LIVERY COVERAGE TO I NDIVIDUALS OR GROUPS ON AN 18 
EXPENSE–INCURRED BASIS UNDER HEALTH INSURANCE POL ICIES OR CONTRACTS 19 
THAT ARE ISSUED OR D ELIVERED IN THE STATE; AND 20 
 
 (2) HEALTH MAINTENANCE ORGANIZA TIONS THAT PROVIDE L ABOR 21 
AND DELIVERY COVERAG E TO INDIVIDUALS OR GROUPS UNDER CONTRAC TS THAT 22 
ARE ISSUED OR DELIVE RED IN THE STATE. 23  2 	SENATE BILL 535  
 
 
 
 (B) AN ENTITY SUBJECT TO THIS SECTION SHALL C OVER LABOR AND 1 
DELIVERY SERVICES WI THOUT A DEDUCTIBLE , COINSURANCE, COPAYMENT , OR ANY 2 
OTHER COST–SHARING REQUIREMENT . 3 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall apply to all 4 
policies, contracts, and health benefit plans issued, delivered, or renewed in the State on or 5 
after January 1, 2025. 6 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 7 
January 1, 2025. 8
