AN ACT concerning 1 
 
Public Information Act – Surveillance Images – Illegal Dumping in Baltimore 2 
City 3 
 
FOR the purpose of repealing a certain provision of law requiring a custodian to deny 4 
inspection of certain surveillance images of illegal dumping in Baltimore City except 5 
under certain circumstances requiring a custodian to allow inspection of certain 6 
surveillance images of illegal dumping in Baltimore City altering a requirement that 7 
a custodian deny inspection of certain surveillance images of illegal dumping in 8 
Baltimore City to allow inspection by certain employees or agents of Baltimore City; 9 
authorizing the Baltimore City Department of Housing and Community Development 10 
to publicly disseminate a surveillance image under certain circumstances; and 11 
generally relating to the inspection of surveillance images of illegal dumping in 12 
Baltimore City.  13

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 5 
That the Laws of Maryland read as follows: 6 
 
Article – General Provisions 7 
 
[4–322. 8 
 
 (a) In this section, “surveillance image” has the meaning stated in § 10–112 of the 9 
Criminal Law Article. 10 
 
 (b) Except as provided in subsection (c) of this section, a custodian of a 11 
surveillance image shall deny inspection of the surveillance image. 12 
 
 (c) A custodian shall allow inspection of a surveillance image: 13 
 
 (1) as required in § 10–112 of the Criminal Law Article; 14 
 
 (2) (1) by any person issued a citation under § 10–112 of the Criminal 15 
Law Article, or by an attorney of record for the person; OR or  16 
 
 (3) BY AN EMPLOYEE OR AG ENT OF THE BALTIMORE CITY 17 
DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT IN AN INV ESTIGATION 18 
OR A PROCEEDING UNDE R § 10–112 OF THE CRIMINAL LAW ARTICLE; OR  19 
 
 (3) (4) (2) by an employee or agent of the Baltimore City Department of 20 
Public Works HOUSING AND COMMUNITY DEVELOPMENT in an investigation or a 21 
proceeding relating to the imposition of or indemnification from civil liability under §  22 
10–112 of the Criminal Law Article.] 23 
 
 (D) NOTWITHSTANDING SUBSE CTION (B) OF THIS SECTION , THE 24 
BALTIMORE CITY DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT MAY 25 
PUBLICLY DISSEMINATE A SURVEILLANCE IMAGE AS PART OF AN INVEST IGATION.  26 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 27 
October 1, 2024.  28
