BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 26 That the Laws of Maryland read as follows: 27 2 SENATE BILL 672 Article – Transportation 1 21–202.1. 2 (c) This section applies to a violation of § 21–202(h) of this subtitle at an 3 intersection monitored by a traffic control signal monitoring system. 4 (e) (1) Subject to the provisions of paragraphs (2) through (4) of this 5 subsection, an agency shall mail to the owner liable under subsection (d) of this section a 6 citation which shall include: 7 (i) The name and address of the registered owner of the vehicle; 8 (2) The agency may mail a warning notice in lieu of a citation to the owner 9 liable under subsection (d) of this section. 10 (6) TO MAIL THE CITATION OR WARNING NOTICE , AN AGENCY SHALL 11 USE: 12 (I) THE CURRENT MAILING A DDRESS ON FILE WITH THE 13 ADMINISTRATION ; OR 14 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 15 RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 16 21–704.1. 17 (b) This section applies only in Montgomery County and Prince George’s County. 18 (e) (1) Unless the driver of the motor vehicle received a citation from a police 19 officer at the time of the violation, the owner or, in accordance with subsection (h)(5) of this 20 section, the driver of a motor vehicle is subject to a civil penalty if the motor vehicle is 21 recorded by an automated railroad grade crossing enforcement system during the 22 commission of a violation. 23 (f) (1) Subject to the provisions of paragraphs (2) through (4) of this 24 subsection, an agency shall mail to the owner liable under subsection (e) of this section a 25 citation that shall include: 26 (i) The name and address of the registered owner of the vehicle; 27 (2) The agency may mail a warning notice in lieu of a citation to the owner 28 liable under subsection (e) of this section. 29 (5) TO MAIL THE CITATION OR WARNING NOTICE , AN AGENCY SHALL 30 SENATE BILL 672 3 USE: 1 (I) THE CURRENT MAILING A DDRESS ON FILE WITH THE 2 ADMINISTRATION ; OR 3 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 4 RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 5 21–706.1. 6 (c) (1) A school bus monitoring camera may not be used in a local jurisdiction 7 under this section unless its use is authorized by the governing body of the local jurisdiction 8 by local law enacted after reasonable notice and a public hearing. 9 (f) (1) Subject to the provisions of paragraphs (2) through (5) of this 10 subsection, a law enforcement agency shall mail to the owner liable under subsection (e) of 11 this section a citation that shall include: 12 (i) The name and address of the registered owner of the vehicle; 13 (2) The law enforcement agency may mail a warning notice in place of a 14 citation to the owner liable under subsection (e) of this section. 15 (6) TO MAIL THE CITATION OR WARNING NOTICE , A LAW 16 ENFORCEMENT AGENCY SHALL U SE: 17 (I) THE CURRENT MAILING A DDRESS ON FILE WITH THE 18 ADMINISTRATION ; OR 19 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 20 RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 21 21–809. 22 (b) (1) (i) A speed monitoring system may not be used in a local jurisdiction 23 under this section unless its use is authorized by the governing body of the local jurisdiction 24 by local law enacted after reasonable notice and a public hearing. 25 (d) (1) Subject to the provisions of paragraphs (2) through (4) of this 26 subsection, an agency shall mail to an owner liable under subsection (c) of this section a 27 citation that shall include: 28 (i) The name and address of the registered owner of the vehicle; 29 (2) (i) Except as provided in subparagraph (ii) of this paragraph, an 30 agency may mail a warning notice instead of a citation to the owner liable under subsection 31 4 SENATE BILL 672 (c) of this section. 1 (6) TO MAIL THE CITATION OR WARNING NOTICE , AN AGENCY SHALL 2 USE: 3 (I) THE CURRENT MAILING A DDRESS ON FILE WITH THE 4 ADMINISTRATION ; OR 5 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 6 RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 7 21–810. 8 (b) (1) A work zone speed control system that meets the requirements of this 9 subsection may be used to record the images of motor vehicles traveling on a highway: 10 (i) Within a work zone; 11 (ii) That is an expressway or a controlled access highway as defined 12 in § 21–101 of this title; and 13 (iii) On which the speed limit, established using generally accepted 14 traffic engineering practices, is 45 miles per hour or greater. 15 (d) (1) Subject to the provisions of paragraphs (2) through (4) of this 16 subsection, a local police department, State police department, or police department 17 contractor shall mail to the owner liable under subsection (c) of this section a citation that 18 shall include: 19 (i) The name and address of the registered owner of the vehicle; 20 (2) The local police department or State police department may mail a 21 warning notice instead of a citation to the owner liable under subsection (c) of this section. 22 (6) TO MAIL THE CITATION OR WARNING NOTICE , A LOCAL POLICE 23 DEPARTMENT , STATE POLICE DEPARTME NT, OR POLICE DEPARTMENT 24 CONTRACTOR SHALL USE : 25 (I) THE CURRENT MAILING A DDRESS ON FILE WITH THE 26 ADMINISTRATION ; OR 27 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 28 RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 29 21–1134. 30 SENATE BILL 672 5 (b) This section applies only in Baltimore City. 1 (f) (1) Unless the driver of the motor vehicle received a citation from a police 2 officer at the time of the violation, the owner or, in accordance with subsection (i)(5) of this 3 section, the driver of a motor vehicle is subject to a civil penalty if the motor vehicle is 4 recorded by a bus lane monitoring system during the commission of a violation. 5 (g) (1) Subject to the provisions of paragraphs (2) through (5) of this 6 subsection, the Baltimore City Police Department or a contractor of the police department 7 shall mail to the owner liable under subsection (f) of this section a citation that shall 8 include: 9 (i) The name and address of the registered owner of the vehicle; 10 (2) (i) Subject to subparagraph (ii) of this paragraph, the Baltimore 11 City Police Department may mail a warning notice in place of a citation to the owner liable 12 under subsection (f) of this section. 13 (6) TO MAIL THE CITATION OR WARNING NOTICE, THE BALTIMORE 14 CITY POLICE DEPARTMENT OR A CONTR ACTOR OF THE POLICE DEPARTMENT 15 SHALL USE: 16 (I) THE CURRENT MAILING A DDRESS ON FILE WITH THE 17 ADMINISTRATION ; OR 18 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 19 RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 20 21–1414. 21 (b) (1) Except as provided in subsection (g) of this section, the registered owner 22 of a motor vehicle shall be liable to the Authority for payment of a video toll as provided for 23 in the regulations of the Authority. 24 (2) The Authority shall send the registered owner of a motor vehicle that 25 has incurred a video toll a notice of toll due. 26 (3) Except as provided in subsection (g) of this section, the person alleged 27 to be liable who receives a notice of toll due shall have at least 30 days to pay the video toll. 28 (4) TO MAIL THE NOTICE OF TOLL DUE, THE AUTHORITY SHALL USE : 29 (I) THE CURRENT MAILING A DDRESS ON F ILE WITH THE 30 ADMINISTRATION ; OR 31 6 SENATE BILL 672 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 1 RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 2 (c) (1) Failure of the person alleged to be liable to pay the video toll under a 3 notice of toll due by the date stated on the notice shall constitute a toll violation subject to 4 a civil citation and a civil penalty, which shall be assessed 15 days after the toll violation 5 occurs, as provided for in the regulations of the Authority. 6 (d) (1) (I) The Authority or its duly authorized agent shall send a citation 7 via first–class mail, no later than 60 days after the toll violation, to the person alleged to 8 be liable under this section. 9 (II) TO MAIL THE CITATION , THE AUTHORITY OR ITS DULY 10 AUTHORIZED AGENT SHA LL USE: 11 1. THE CURRENT MAILING A DDRESS ON FILE WITH THE 12 ADMINISTRATION ; OR 13 2. IF A MAILING ADDRESS IS UNAVAILABLE , THE 14 CURRENT RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 15 24–111.3. 16 (b) This section applies only in Baltimore City, Baltimore County, Harford 17 County, and Prince George’s County. 18 (c) (1) A vehicle height monitoring system may be used to record images of 19 vehicles traveling on a highway in a local jurisdiction under this section only if the use of 20 vehicle height monitoring systems is authorized by local law adopted by the governing body 21 of the local jurisdiction after reasonable notice and a public hearing. 22 (f) (1) Subject to the provisions of paragraphs (2) and (3) of this subsection, a 23 local government agency or, in Baltimore City, the Baltimore City Department of 24 Transportation shall mail to an owner liable under this section a citation that shall include: 25 (i) The name and address of the registered owner of the motor 26 vehicle; 27 (2) A local government agency or, in Baltimore City, the Baltimore City 28 Department of Transportation shall, for a first violation, mail a warning notice instead of 29 a citation to an owner liable under this section. 30 (5) TO MAIL THE CITATION OR WARNING NOTICE , A LOCAL 31 GOVERNMENT AGENCY OR , IN BALTIMORE CITY, THE BALTIMORE CITY 32 DEPARTMENT OF TRANSPORTATION SHALL USE: 33 SENATE BILL 672 7 (I) THE CURRENT MAILING A DDRESS ON FILE WITH THE 1 ADMINISTRATION ; OR 2 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 3 RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 4 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 5 October 1, 2024. 6
