FOR the purpose of requiring that citations and notices issued as a result of automated 4 
enforcement under the Maryland Vehicle Law be sent to certain addresses; and 5 
generally relating to automated enforcement under the Maryland Vehicle Law. 6

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 4 
That the Laws of Maryland read as follows: 5 
 
Article – Transportation 6 
 
21–202.1. 7 
 
 (c) This section applies to a violation of § 21–202(h) of this subtitle at an 8 
intersection monitored by a traffic control signal monitoring system. 9 
 
 (e) (1) Subject to the provisions of paragraphs (2) through (4) of this 10 
subsection, an agency shall mail to the owner liable under subsection (d) of this section a 11 
citation which shall include: 12 
 
 (i) The name and address of the registered owner of the vehicle; 13 
 
 (2) The agency may mail a warning notice in lieu of a citation to the owner 14 
liable under subsection (d) of this section. 15 
 
 (6) TO MAIL THE CITATION OR WARNING NOTICE, AN AGENCY SHALL 16 
USE: 17 
 
 (I) THE CURRENT MAILING A DDRESS ON FILE WITH THE 18 
ADMINISTRATION ; OR 19 
 
 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 20 
RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 21

 (b) This section applies only in Montgomery County and Prince George’s County. 23 
 
 (e) (1) Unless the driver of the motor vehicle received a citation from a police 24 
officer at the time of the violation, the owner or, in accordance with subsection (h)(5) of this 25 
section, the driver of a motor vehicle is subject to a civil penalty if the motor vehicle is 26 
recorded by an automated railroad grade crossing enforcement system during the 27 
commission of a violation. 28 
 
 (f) (1) Subject to the provisions of paragraphs (2) through (4) of this 29 
subsection, an agency shall mail to the owner liable under subsection (e) of this section a 30 
citation that shall include: 31

 (i) The name and address of the registered owner of the vehicle; 1 
 
 (2) The agency may mail a warning notice in lieu of a citation to the owner 2 
liable under subsection (e) of this section. 3 
 
 (5) TO MAIL THE CITATION OR WARNING NOTICE , AN AGENCY SHALL 4 
USE: 5 
 
 (I) THE CURRENT MAILING A DDRESS ON FILE WITH THE 6 
ADMINISTRATION ; OR 7 
 
 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 8 
RESIDENTIA L ADDRESS ON FILE WI TH THE ADMINISTRATION . 9

 (c) (1) A school bus monitoring camera may not be used in a local jurisdiction 11 
under this section unless its use is authorized by the governing body of the local jurisdiction 12 
by local law enacted after reasonable notice and a public hearing. 13 
 
 (f) (1) Subject to the provisions of paragraphs (2) through (5) of this 14 
subsection, a law enforcement agency shall mail to the owner liable under subsection (e) of 15 
this section a citation that shall include: 16 
 
 (i) The name and address of the registered owner of the vehicle; 17 
 
 (2) The law enforcement agency may mail a warning notice in place of a 18 
citation to the owner liable under subsection (e) of this section. 19 
 
 (6) TO MAIL THE CITATION OR WARNING NOTICE , A LAW 20 
ENFORCEMENT AGENCY S HALL USE: 21 
 
 (I) THE CURRENT MAILING A DDRESS ON FILE WITH THE 22 
ADMINISTRATION ; OR 23 
 
 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 24 
RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 25

 (b) (1) (i) A speed monitoring system may not be used in a local jurisdiction 27 
under this section unless its use is authorized by the governing body of the local jurisdiction 28 
by local law enacted after reasonable notice and a public hearing. 29 
 
 (d) (1) Subject to the provisions of paragraphs (2) through (4) of this 30  4 	SENATE BILL 672  
 
 
subsection, an agency shall mail to an owner liable under subsection (c) of this section a 1 
citation that shall include: 2 
 
 (i) The name and address of the registered owner of the vehicle; 3 
 
 (2) (i) Except as provided in subparagraph (ii) of this paragraph, an 4 
agency may mail a warning notice instead of a citation to the owner liable under subsection 5 
(c) of this section. 6 
 
 (6) TO MAIL THE CITATION OR WARNING NOTICE , AN AGENCY SHALL 7 
USE: 8 
 
 (I) THE CURRENT MAILING A DDRESS ON FILE WITH T HE 9 
ADMINISTRATION ; OR 10 
 
 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 11 
RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 12

 (b) (1) A work zone speed control system that meets the requirements of this 14 
subsection may be used to record the images of motor vehicles traveling on a highway: 15 
 
 (i) Within a work zone; 16 
 
 (ii) That is an expressway or a controlled access highway as defined 17 
in § 21–101 of this title; and 18 
 
 (iii) On which the speed limit, established using generally accepted 19 
traffic engineering practices, is 45 miles per hour or greater. 20 
 
 (d) (1) Subject to the provisions of paragraphs (2) through (4) of this 21 
subsection, a local police department, State police department, or police department 22 
contractor shall mail to the owner liable under subsection (c) of this section a citation that 23 
shall include: 24 
 
 (i) The name and address of the registered owner of the vehicle; 25 
 
 (2) The local police department or State police department may mail a 26 
warning notice instead of a citation to the owner liable under subsection (c) of this section. 27 
 
 (6) TO MAIL THE CITATION OR WARNING NOTICE , A LOCAL POLICE 28 
DEPARTMENT , STATE POLICE DEPARTME NT, OR POLICE DEPARTMENT 29 
CONTRACTOR SHALL USE : 30 
 
 (I) THE CURRENT MAILING A DDRESS ON FILE WITH THE 31   	SENATE BILL 672 	5 
 
 
ADMINISTRATION ; OR 1 
 
 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 2 
RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 3

 (b) This section applies only in Baltimore City. 5 
 
 (f) (1) Unless the driver of the motor vehicle received a citation from a police 6 
officer at the time of the violation, the owner or, in accordance with subsection (i)(5) of this 7 
section, the driver of a motor vehicle is subject to a civil penalty if the motor vehicle is 8 
recorded by a bus lane monitoring system during the commission of a violation. 9 
 
 (g) (1) Subject to the provisions of paragraphs (2) through (5) of this 10 
subsection, the Baltimore City Police Department or a contractor of the police department 11 
shall mail to the owner liable under subsection (f) of this section a citation that shall 12 
include: 13 
 
 (i) The name and address of the registered owner of the vehicle; 14 
 
 (2) (i) Subject to subparagraph (ii) of this paragraph, the Baltimore 15 
City Police Department may mail a warning notice in place of a citation to the owner liable 16 
under subsection (f) of this section. 17 
 
 (6) TO MAIL THE CITATION OR WARNING NOTICE, THE BALTIMORE 18 
CITY POLICE DEPARTMENT OR A CONTR ACTOR OF THE POLICE DEPARTMENT 19 
SHALL USE: 20 
 
 (I) THE CURRENT MAILING A DDRESS ON FILE WITH THE 21 
ADMINISTRATION ; OR 22 
 
 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 23 
RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 24

 (b) (1) Except as provided in subsection (g) of this section, the registered owner 26 
of a motor vehicle shall be liable to the Authority for payment of a video toll as provided for 27 
in the regulations of the Authority. 28 
 
 (2) The Authority shall send the registered owner of a motor vehicle that 29 
has incurred a video toll a notice of toll due. 30 
 
 (3) Except as provided in subsection (g) of this section, the person alleged 31 
to be liable who receives a notice of toll due shall have at least 30 days to pay the video toll. 32  6 	SENATE BILL 672  
 
 
 
 (4) TO MAIL THE NOTICE OF TOLL DUE, THE AUTHORITY SHALL USE : 1 
 
 (I) THE CURRENT MAILING A DDRESS ON FILE WITH THE 2 
ADMINISTRATION ; OR 3 
 
 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 4 
RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 5 
 
 (c) (1) Failure of the person alleged to be liable to pay the video toll under a 6 
notice of toll due by the date stated on the notice shall constitute a toll violation subject to 7 
a civil citation and a civil penalty, which shall be assessed 15 days after the toll violation 8 
occurs, as provided for in the regulations of the Authority. 9 
 
 (d) (1) (I) The Authority or its duly authorized agent shall send a citation 10 
via first–class mail, no later than 60 days after the toll violation, to the person alleged to 11 
be liable under this section. 12 
 
 (II) TO MAIL THE CITATION , THE AUTHORITY OR ITS DULY 13 
AUTHORIZED AGENT SHA LL USE: 14 
 
 1. THE CURRENT MAILING A DDRESS ON FILE WITH THE 15 
ADMINISTRATION ; OR 16 
 
 2. IF A MAILING ADDRESS IS UNAVAILABLE , THE 17 
CURRENT RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 18

 (b) This section applies only in Baltimore City, Baltimore County, Harford 20 
County, and Prince George’s County. 21 
 
 (c) (1) A vehicle height monitoring system may be used to record images of 22 
vehicles traveling on a highway in a local jurisdiction under this section only if the use of 23 
vehicle height monitoring systems is authorized by local law adopted by the governing body 24 
of the local jurisdiction after reasonable notice and a public hearing. 25 
 
 (f) (1) Subject to the provisions of paragraphs (2) and (3) of this subsection, a 26 
local government agency or, in Baltimore City, the Baltimore City Department of 27 
Transportation shall mail to an owner liable under this section a citation that shall include: 28 
 
 (i) The name and address of the registered owner of the motor 29 
vehicle; 30 
 
 (2) A local government agency or, in Baltimore City, the Baltimore City 31   	SENATE BILL 672 	7 
 
 
Department of Transportation shall, for a first violation, mail a warning notice instead of 1 
a citation to an owner liable under this section. 2 
 
 (5) TO MAIL THE CITATION OR WARNING NOTICE , A LOCAL 3 
GOVERNMENT AGENCY OR , IN BALTIMORE CITY, THE BALTIMORE CITY 4 
DEPARTMENT OF TRANSPORTATION SHALL USE: 5 
 
 (I) THE CURRENT MAILING A DDRESS ON FILE WITH THE 6 
ADMINISTRATION ; OR 7 
 
 (II) IF A MAILING ADDRESS IS UNAVAILABLE , THE CURRENT 8 
RESIDENTIAL ADDRESS ON FILE WITH THE ADMINISTRATION . 9 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 10 
October 1, 2024. 11
