A BILL ENTITLED 
 
AN ACT concerning 1 
 
Criminal Law – Reckless Endangerment – Use of Motor Vehicle 2 
 
FOR the purpose of repealing an exclusion of conduct involving the use of a motor vehicle 3 
applicable to the crime of reckless endangerment; and generally relating to reckless 4 
endangerment. 5 
 
BY repealing and reenacting, with amendments, 6 
 Article – Criminal Law 7 
Section 3–204 8 
 Annotated Code of Maryland 9 
 (2021 Replacement Volume and 2023 Supplement) 10 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 11 
That the Laws of Maryland read as follows: 12 
 
Article – Criminal Law 13 
 
3–204. 14 
 
 (a) A person may not recklessly: 15 
 
 (1) engage in conduct that creates a substantial risk of death or serious 16 
physical injury to another; or 17 
 
 (2) discharge a firearm from a motor vehicle in a manner that creates a 18 
substantial risk of death or serious physical injury to another. 19 
 
 (b) A person who violates this section is guilty of the misdemeanor of reckless 20 
endangerment and on conviction is subject to imprisonment not exceeding 5 years or a fine 21 
not exceeding $5,000 or both. 22

 (c) (1) Subsection (a)(1) of this section does not apply to conduct involving[: 1 
 
 (i) the use of a motor vehicle, as defined in § 11–135 of the 2 
Transportation Article; or 3 
 
 (ii)] the manufacture, production, or sale of a product or commodity. 4 
 
 (2) Subsection (a)(2) of this section does not apply to: 5 
 
 (i) a law enforcement officer or security guard in the performance of 6 
an official duty; or 7 
 
 (ii) an individual acting in defense of a crime of violence as defined 8 
in § 5–101 of the Public Safety Article. 9 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 10 
October 1, 2024. 11
