[Brackets] indicate matter deleted from existing law. *hb1012* HOUSE BILL 1012 J2 5lr2946 By: Delegate Kerr Introduced and read first time: February 3, 2025 Assigned to: Health and Government Operations A BILL ENTITLED AN ACT concerning 1 Massage Therapy – Continuing Education Requirements 2 FOR the purpose of requiring the State Board of Massage Therapy Examiners to establish 3 certain continuing education requirements; authorizing the Board to refuse to renew 4 the license of a licensed massage therapist who fails to attend the required course or 5 submit certification of attendance at the required courses; and generally relating to 6 continuing education requirements for licensed massage therapists. 7 BY repealing and reenacting, without amendments, 8 Article – Health Occupations 9 Section 6–101(a), (b), (d), (e), and (i) 10 Annotated Code of Maryland 11 (2021 Replacement Volume and 2024 Supplement) 12 BY adding to 13 Article – Health Occupations 14 Section 6–305.1 15 Annotated Code of Maryland 16 (2021 Replacement Volume and 2024 Supplement) 17 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18 That the Laws of Maryland read as follows: 19 Article – Health Occupations 20 6–101. 21 (a) In this title the following words have the meanings indicated. 22 (b) “Board” means the State Board of Massage Therapy Examiners. 23 2 HOUSE BILL 1012 (d) “License” means, unless the context requires otherwise, a license issued by the 1 Board to practice massage therapy. 2 (e) “Licensed massage therapist” means an individual who is licensed by the 3 Board to practice massage therapy. 4 (i) “Supervised hands–on techniques” means massage techniques that are 5 performed under the direct, in–person supervision of a qualified licensed instructor who is 6 on–site in: 7 (1) A classroom; 8 (2) A laboratory; 9 (3) A school clinic; or 10 (4) A health care setting. 11 6–305.1. 12 (A) IN ADDITION TO ANY OT HER QUALIFICATIONS A ND REQUIREMENTS 13 ESTABLISHED BY THE BOARD, THE BOARD SHALL ESTABLISH CONTINUING 14 EDUCATION REQUIREMEN TS AS A CON DITION OF THE RENEWAL OF A LICENSE 15 UNDER THIS TITLE . 16 (B) THE BOARD SHALL ADOPT REG ULATIONS TO: 17 (1) APPROVE CONTINUING ED UCATION COURSES REQUIRED UNDER 18 THIS SECTION; AND 19 (2) ESTABLISH THE NUMBER OF HOURS OF CONTINUING EDUCATION 20 REQUIRED, AT LEAST HALF OF WHICH MUST INCLUDE SUPERVISED HANDS –ON 21 TECHNIQUES . 22 (C) AT THE TIME A LICENSE E APPLIES FOR LICENS E RENEWAL , THE 23 APPLICANT SHALL SUBMIT TO THE BOARD, ON A FORM PROVIDED B Y THE BOARD, A 24 CERTIFICATION THAT T HE APPLICANT HAS ATTENDED THE REQ UIRED COURSES . 25 (D) THE BOARD MAY REFUSE TO R ENEW THE LICENSE OF A LICENSED 26 MASSAGE THERAPIST WHO HAS: 27 (1) FAILED TO ATTEND THE REQUIRED COURSES ; OR 28 (2) FAILED TO SUBMIT CERTIFICATI ON OF ATTENDANCE AT THE 29 REQUIRED COURSES . 30 HOUSE BILL 1012 3 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 1 1, 2026. 2
