Maryland Medical Assistance Program and Health Insurance – Coverage for 2 
Anesthesia – Prohibiting Time Limitations 3 
 
FOR the purpose of requiring the Maryland Medical Assistance Program, managed care 4 
organizations, and certain insurers, nonprofit health service plans, and health 5 
maintenance organizations, if providing coverage for the delivery of anesthesia for a 6 
procedure for which a licensed medical professional issues an order, to provide the 7 
coverage in a certain manner; and generally relating to health insurance coverage 8 
for the delivery of anesthesia. 9

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 11 
That the Laws of Maryland read as follows: 12 
 
Article – Health – General 13

 (M) BEGINNING JANUARY 1, 2026, THE PROVISIONS OF § 15–861 OF THE 15 
INSURANCE ARTICLE APPLY TO MANA GED CARE ORGANIZATIO NS IN THE SAME 16 
MANNER THAT THEY APP LY TO CARRIERS. 17

 (a) (1) The Secretary shall administer the Maryland Medical Assistance 19 
Program. 20 
 
 (2) The Program: 21 
 
 (xxiii) Beginning on July 1, 2025, shall provide, subject to the 22 
limitations of the State budget, and as permitted by federal law, coverage for biomarker 23 
testing in accordance with § 15–859 of the Insurance Article; [and] 24 
 
 (xxiv) Beginning on January 1, 2025, shall provide coverage for 25 
prostheses in accordance with § 15–844 of the Insurance Article; AND 26 
 
 (XXV) BEGINNING ON JANUARY 1, 2026, IF PROVIDING COVERAG E 27 
FOR THE DELIVERY OF ANESTHESIA, SHALL PROVIDE COVERA GE FOR THE DELIVERY 28 
OF ANESTHESIA IN ACCORDANCE WITH § 15–861 OF THE INSURANCE ARTICLE. 29

 IF THE PROGRAM COVERS THE DE LIVERY OF ANESTHESIA FOR A PROCEDURE 31 
FOR WHICH A LICENSED MEDICAL PROFESSIONAL ISSUES AN ORDER , THE 32

 (1) SHALL PROVIDE COVERAG E FOR THE: 1 
 
 (I) THE DELIVERY OF ANESTHESIA FOR THE ENTIRE DURAT ION 2 
OF THE PROCEDURE ; AND 3 
 
 (II) MEDICAL CARE RELATED 	TO THE DELIVERY OF 4 
ANESTHESIA FOR THE P ROCEDURE THAT IS PRO VIDED IMMEDIATELY BE FORE AND 5 
AFTER THE PROCEDURE ; AND  6 
 
 (2) MAY NOT PLACE ESTABLISH, IMPLEMENT, OR ENFORCE A POLICY , 7 
PRACTICE, OR PROCEDURE THAT PL ACES TIME LIMITATIONS ON THE DELIVERY OF 8 
ANESTHESIA. 9

 (A) THIS SECTION APPLIES TO: 12 
 
 (1) INSURERS AND NONPROF IT HEALTH SERVICE PL ANS THAT 13 
PROVIDE HOSPITAL , MEDICAL, OR SURGICAL BENEFITS TO INDIVIDU ALS OR GROUPS 14 
ON AN EXPENSE –INCURRED BASIS UNDER HEALTH INSURANCE POL ICIES OR 15 
CONTRACTS THAT ARE I SSUED OR DELIVERED I N THE STATE; AND 16 
 
 (2) HEALTH MAINTENANCE O	RGANIZATIONS THAT PR OVIDE 17 
HOSPITAL, MEDICAL, OR SURGICAL BENEFITS TO INDIVIDUALS OR GROUPS UN DER 18 
CONTRACTS THAT ARE I SSUED OR DELIVERED I N THE STATE. 19 
 
 (B) AN ENTITY SUBJECT TO THIS SECTION THAT CO VERS THE DELIVERY OF 20 
ANESTHESIA FOR A PRO CEDURE FOR WHICH A L ICENSED MEDICAL PROF ESSIONAL 21 
ISSUES AN ORDER : 22 
 
 (1) SHALL PROVIDE COVERAGE FOR : 23 
 
 (I) THE DELIVERY OF ANES THESIA FOR THE ENTIR E DURATION 24 
OF THE PROCEDURE ; AND 25 
 
 (II) MEDICAL CARE RELATED TO THE DELIVERY OF A NESTHESIA 26 
FOR THE PROCEDURE TH AT IS PROVIDED IMMED IATELY BEFORE AND AF TER THE 27 
PROCEDURE ; AND  28

 (2) MAY NOT PLACE ESTABLISH, IMPLEMENT, OR ENFORCE A POLICY , 1 
PRACTICE, OR PROCEDURE THAT PL ACES TIME LIMITATIONS ON THE DELIVERY OF 2

 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall apply to all 4 
policies, contracts, and health benefit plans issued, delivered, or renewed in the State on or 5 
after January 1, 2026. 6 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 7 
January 1, 2026.  8
