BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 21 That the Laws of Maryland read as follows: 22 2 HOUSE BILL 1090 Article – Human Services 1 5–502. 2 Except as provided in [§ 5–503] §§ 5–503 AND 5–503.1 of this subtitle, if any 3 provision of this subtitle conflicts with any federal law, the federal law shall prevail. 4 5–503.1. 5 (A) THE DEPARTMENT SHALL PROV IDE FOOD SUPPLEMENT BENEFITS TO A 6 STUDENT WHO : 7 (1) IS A RESIDENT OF THE STATE; 8 (2) IS ENROLLED IN AN INSTITUTION OF HIGHER EDUCATION IN THE 9 STATE; 10 (3) IS ELIGIBLE TO PARTI CIPATE IN A STATE– OR FEDERALLY 11 FINANCED WORK STUDY PROGRAM FOR AT LEAST ONE SEMESTER DURING AN 12 ACADEMIC YEAR ; AND 13 (4) PARTICIPATES IN A WO RK STUDY PROGRAM FOR AN AVERAGE O F 14 20 HOURS PER WEEK THROU GHOUT A SEMESTER . 15 (B) A STUDENT ELIGIBLE FOR FOOD SUPPLEMENT BENE FITS UNDER 16 SUBSECTION (A) OF THIS SECTION SHAL L REMAIN ELIGIBLE FO R BENEFITS FOR AN 17 ENTIRE ACADEMIC YEAR REGARDLESS OF THE LE NGTH OF ANY BREAK DU RING THE 18 ACADEMIC YEAR. 19 SECTION 2. AND BE IT FURTHER ENACTED, That: 20 (a) On or before August 1, 2025, the Maryland Higher Education Commission 21 shall add to the Maryland College Aid Processing System application a question regarding 22 whether, in the previous 6 months, the applicant has missed a meal because of an inability 23 to afford the meal. 24 (b) The Maryland Higher Education Commission may not require a student to 25 answer the question required under subsection (a) of this section in the affirmative in order 26 for the student to be eligible for financial aid. 27 SECTION 3. 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 28 July 1, 2025. 29
